NCAA's swift blow to Penn State

NCAA president Mark Emmert announces swift, substantial, unprecedented punishments against Penn State and its football program.

Last year alone it generated $72 million in revenue, all guided by an iconic coach, Joe Paterno, who had been at Penn State's helm for nearly a half-century. As the face of not just the football program but the university, Paterno was sainted with a statue outside Beaver Stadium. His Division I record for coaching victories (409) dated to 1966.

To bring the program back to earth, the NCAA might not have given the school the dreaded "death penalty," which would have meant the elimination of the program for a year or longer.

But by cutting its scholarships, banning it from bowl games for four years, issuing a $60 million fine and stripping it of every victory since 1998 — including 111 of Paterno's wins to drop him to 12th on the all-time list — a program that took decades to build has been leveled in a matter of weeks.


 The NCAA has slammed Penn State with an unprecedented series of penalties, including a $60 million fine and the loss of all coach Joe Paterno's victories from 1998-2011, in the wake of the Jerry Sandusky child sex abuse scandal.
Other sanctions include a four-year ban on bowl games, and the loss of 20 scholarships per year over four years.
NCAA President Mark Emmert announced the staggering sanctions Monday at a news conference in Indianapolis. Though the NCAA stopped short of imposing the "death penalty" -- shutting down the Nittany Lions' program completely -- the punishment is still crippling for a team that is trying to start over with a new coach and a new outlook.
Sandusky, a former Penn State defensive coordinator, was found guilty in June of sexually abusing young boys, sometimes on campus.

Penn State football was all but dismantled Monday by an NCAA ruling that wiped away 14 years of coach Joe Paterno's victories and imposed a mountain of fines and penalties, crippling a program whose pedophile assistant coach spent years molesting children, sometimes on school property.
The sanctions by the governing body of college sports also imposed unprecedented fines of $60 million, ordered Penn State to sit out the postseason for four years, capped scholarships at 20 below the normal limit for four years and placed football on five years' probation.
Current or incoming football players are free to immediately transfer and compete at another school.
The NCAA's sanctions following the worst scandal in the history of college football stopped short of delivering the "death penalty" -- shutting down the sport completely. It actually did everything but kill it.
"The sanctions needed to reflect our goals of providing cultural change," NCAA President Mark Emmert said as he announced the penalties at a news conference in Indianapolis.
The NCAA ruling holds the university accountable for the failure of those in power to protect children and insists that all areas of the university community are held to the same high standards of honesty and integrity.

"Against this backdrop, Penn State accepts the penalties and corrective actions announced today by the NCAA," Penn State President Rodney Erickson said in a statement. "With today's announcement and the action it requires of us, the University takes a significant step forward."
Paterno's family said in a statement that the NCAA sanctions defamed the coach's legacy, and were a panicked response to the sex abuse scandal.
The family also says that punishing "past, present and future" students because of Jerry Sandusky's crimes did not serve justice.
The Big Ten announced that Penn State would not be allowed to share in the conference's bowl revenue during the NCAA's postseason ban, an estimated loss of about $13 million. And the NCAA reserved the right to add additional penalties.
Sandusky, a former Penn State defensive coordinator, was found guilty in June of sexually abusing young boys, sometimes on campus. An investigation commissioned by the school and released July 12 found that Paterno, who died in January, and several other top officials at Penn State stayed quiet for years about accusations against Sandusky.
Emmert fast-tracked penalties rather than go through the usual circuitous series of investigations and hearings. The NCAA said the $60 million is equivalent to the annual gross revenue of the football program.

The money must be paid into an endowment for external programs preventing child sexual abuse or assisting victims and may not be used to fund such programs at Penn State.
"Football will never again be placed ahead of educating, nurturing and protecting young people," Emmert said.
By vacating 112 Penn State victories from 1998-2011, the sanctions cost Paterno 111 wins. Former Florida State coach Bobby Bowden will now hold the top spot in the NCAA record book with 377 major-college wins. Paterno, who was fired days after Sandusky was charged, will be credited with 298 wins. Vacated wins are not the same as forfeits -- they don't count as losses or wins for either school.
"I didn't want it to happen like this," Bowden told the AP. "Wish I could have earned it, but that's the way it is."
The scholarship reductions mean Penn State's roster will be capped at 65 scholarship players beginning in 2014. The normal scholarship limit for major college football programs is 85. Playing with 20 less is devastating to a program that tries to compete at the highest level of the sport.
In comparison, the harsh NCAA sanctions placed upon USC several years ago left the Trojans with only 75 scholarships per year over a three-year period.
The postseason ban is the longest handed out by the NCAA since it gave a four-year ban to Indiana football in 1960.
Bill O'Brien, who was hired to replace Paterno, now faces the daunting task of building future teams with severe limitations, and trying to keep current players from fleeing to other schools. Star players such as tailback Silas Redd and linebacker Gerald Hodges are now essentially free agents.
"I knew when I accepted the position that there would be tough times ahead," O'Brien said. "But I am committed for the long term to Penn State and our student athletes."
Big Ten Commissioner Jim Delany said that players will likely be allowed to transfer within the conference, something that is usually restricted. The possible exodus isn't confined to just the next few months. Penn State players currently on the roster are free to transfer without restrictions for the length of their careers.
Penn State players left a team meeting on campus in State College, Pa., without talking to reporters. Penn State's season starts Sept. 1 at home against Ohio University.
The sanctions came a day after the school took down a statue of Paterno that stood outside Beaver Stadium and was a rallying point for the coaches' supporters throughout the scandal.
At a student union on campus, several dozen alumni and students gasped, groaned and whistled as they watched Emmert's news conference.
"It was kind of just like a head shaker," said Matt Bray, an 18-year-old freshman from West Chester, Pa. "You knew it was coming, but it was hard to hear."
Emmert had earlier said he had "never seen anything as egregious" as the horrific crimes of Sandusky and the cover-up by Paterno and others at the university, including former Penn State President Graham Spanier and athletic director Tim Curley.
The Penn State investigation headed by former FBI Director Louis Freeh said school officials kept what they knew from police and other authorities for years, enabling the abuse to go on.
There had been calls across the nation for Penn State to receive the "death penalty," and Emmert had not ruled out that possibility as late as last week -- though Penn State did not fit the criteria for it. That punishment is for teams that commit a major violation while already being sanctioned.
"This case is obviously incredibly unprecedented in every aspect of it," Emmert said, "as are these actions that we're taking today."
Penn State football under Paterno was built on -- and thrived upon -- the premise that it did things the right way. That it was not a football factory where only wins and losses determined success. Every major college football program tries to send that message, but Penn State built its brand on it.
Paterno's "Grand Experiment" was about winning with integrity, graduating players and sending men into the world ready to succeed in life, not just football. But he still won a lot -- a record-setting 409 victories.
The NCAA had never sanctioned, or seriously investigated Penn State. Few, if any, national powers could make that claim.
Southern California, Ohio State, Alabama, all have run afoul of the NCAA. Even Notre Dame went on probation for two years after a booster lavished gifts on players in the 1990s.
The harshest penalty handed down to a football program came in the `80s, when the NCAA shut down SMU's team for a year. SMU football has never gotten back to the level of success it had before the "death penalty."
Emmert said there were concerns about the collateral damage of shutting down Penn State football for a year, and that's why the death penalty was ruled out.
"It hurts people who had absolutely nothing to do with this process, which is always the case," he said.
Emmert added that no attempt was made for the sanctions to be more severe than the death penalty.
"That isn't a comparison I or anyone else needs to make," he said. "People in the media can make those comparisons."
Delany said he believes Penn State is capable of bouncing back from the sanctions.

"I do have a strong sense that many of the ingredients of success are still at Penn State and will be there in future years," he said.

Cardinal Bernard F. Law resigns as ArchPriest of St. Mary Major

VATICAN CITY (RNS) Nine years after the clerical sex abuse scandal forced his resignation as archbishop of Boston, Cardinal Bernard F. Law has stepped down from his controversial post as head of a prominent basilica in Rome.

The Vatican announced on Monday (Nov. 21) that Pope Benedict XVI has named Spanish Archbishop Santos Abril y Castello as the new archpriest of the Papal Basilica of St. Mary Major.

The announcement made no reference to Law, who has served as archpriest since May 2004. Advocates for sex abuse victims criticized the late Pope John Paul II for giving Law the prestigious post after his mishandling of clergy sex abuse in Boston, which broke open the abuse scandals that shook the Catholic Church in the U.S.

Law turned 80 earlier this month, the normal retirement age for cardinals, and also lost his right to vote in any future papal election. The Rev. Federico Lombardi, the Vatican's chief spokesman, said Law's membership in several Vatican offices -- including the body that advises Benedict on the selection of bishops -- has expired.

Archpriests of papal basilicas often serve past retirement, however. Law's immediate two predecessors at St. Mary Major both held the largely ceremonial post until the age of 82.

Law has not announced where he will go next or what activities, if any, he will pursue. A spokesman for the Archdiocese of Boston referred reporters to the Holy See. Lombardi said that he had no knowledge of Law's plans, which he said would be "entirely up to his discretion."

VATICAN CITY Cardinal Bernard Law, who resigned in disgrace as Boston’s archbishop in 2002 after the priest sex abuse scandal erupted in the United States, has retired from his subsequent job as head of a major Roman basilica.

The Vatican said Monday that Pope Benedict XVI had accepted the 80-year-old Law’s resignation as archpriest of St. Mary Major basilica and had named Spanish Monsignor Santos Abril y Castello to replace him.

Law’s 2004 appointment as the archpriest of one of Rome’s most important basilicas had been harshly criticized by victims of sex abuse, who charged that bishops who covered up for pedophile priests should be punished, not rewarded.

Law turned 80 earlier this month. While the pope could have kept him on longer — the dean of the College of Cardinals will be 84 this week, for example — Benedict decided to replace him.

The Vatican announcement made no mention of Law’s resignation, though, merely noting in a perfunctory, two-line statement that Benedict had named a new archpriest for the basilica.

Law became the first and so far only U.S. bishop to resign for mishandling cases of priests who sexually abused children.

The abuse crisis erupted in Law’s Boston in 2002 after church records were made public showing that church officials had reports of priests molesting children, but kept the complaints secret and shuffled some priests from parish to parish rather than remove them or report them to police.

The crisis spread as similar sexual abuse complaints were uncovered in dioceses across the country. To date, U.S. dioceses have paid nearly $3 billion in settlements to victims and other costs.

Law himself was named in hundreds of lawsuits accusing him of failing to protect children from known child molesters. After 18 years leading the nation’s fourth-largest archdiocese, Law resigned in 2002, having asked Pope John Paul II twice before receiving permission to step down.

Ten months after he left office, Law’s successor, now-Cardinal Sean P. O’Malley, helped broker an $85 million settlement with more than 550 victims of pedophile priests.

While in Rome, Law has been a frequent presence at major Vatican ceremonial and diplomatic events, a lifestyle that galled many abuse victims who have long insisted that the Vatican crack down on bishops who would transfer abusive priests rather than report them to police.
Raymond Flynn, the former mayor of Boston and onetime U.S. ambassador to the Vatican, said Law also did plenty of good for the city. Law’s successor at St. Mary Major — one of the four basilicas under the direct jurisdiction of the Vatican — retired earlier this year as the Vatican’s ambassador to Slovenia and Macedonia.
Abril y Castello, 76, is also the No. 2 prelate who helps take care of matters dealing with a papal death and runs the Vatican until a new pontiff is elected in a conclave.
Now that he is 80, Law can no longer vote in a conclave, but he remains a cardinal.

Column: Penn State case bad, but church sex abuse worse

I didn't have much sympathy for people who complained about the punishment the NCAA doled out to Penn State, until I discovered how an even larger institution in the Keystone State has escaped punishment for shielding dozens of pedophiles in its midst.

In June, Jerry Sandusky, a longtime assistant football coach at Penn State, was found guilty of raping and sodomizing 10 young boys. Top university officials were told of Sandusky's deviant behavior years earlier and did nothing to stop him. They, apparently, were more worried about the damage that exposing him would do to the school's reputation than the harm he was doing to his victims.

For its inaction, Penn State on July 23 was fined $60 million, its football team was banned from post-season play for four years and the games it won from 1998 through 2011 — the span of time during which university officials were aware of Sandusky's pedophilia and looked the other way — were wiped off the record books.

Another troubling case

The next day, an even more troubling case of child sex abuse — given that so many more predators were involved — played out in a Philadelphia courtroom without any hint that justice would reach beyond a low-level official of that city's Catholic archdiocese.

Monsignor William Lynn was sentenced to three to six years in prison for covering up the actions of pedophile priests he was supposed to root out of the church. Instead, he sent them to unsuspecting parishes where other sexual assaults took place — an action his lawyers said was ordered by Cardinal Anthony Bevilacqua, who headed Philadelphia's archdiocese from 1988 to 2003. He died in January.

In 2011, a grand jury said it had "no doubt that (Bevilacqua's) knowing and deliberate actions during his tenure as archbishop also endangered thousands of children in the Philadelphia Archdiocese." Lynn, it said, was carrying out Bevilacqua's policies exactly as he directed. But Bevilacqua, who was in poor health, was not indicted along with his aide.

Church coverup

According to that grand jury report — and another in 2003 and 2005 — the Philadelphia archdiocese's coverup of pedophile priests started before Bevilacqua became its leader and lasted after he was replaced.

So why hasn't it been penalized in some way for its bad acts — for sending pedophile priests to counseling instead of turning them in to the cops? Why hasn't its tax-exempt status been revoked for a number of years? That might be a real deterrent against a repeat of such harmful indifference in Philadelphia and elsewhere.

But the Philadelphia archdiocese is not likely to suffer the same fate as Penn State, even though three grand juries found it left pedophile priests free to prey upon children for years after church officials became aware of them. That's because saving the church from scorn was more important to them than protecting children from those monsters.

"As powerful as Penn State officials are, their power pales before the power of the Catholic hierarchy," David Clohessy, director and spokesman for the Survivor's Network of those Abused by Priests, told me. "When sex abuse happens in a religious setting, many people back away. I think a degree of fatigue has set it."

I hope for the sake of the children who were abused, and those who might be victimized in the future if nothing is done, that what happened in Philadelphia will produce enough outrage to force the archdiocese there — like Penn State — to pay a hefty price for its indifference to the sexual abuse of children.

Many conservative religious leaders insist that houses of worship in America today struggle under intense persecution. To hear some of the Catholic bishops tell it, religious freedom may soon be a memory because they don’t always get their way in policy debates.
It would be highly ironic if the United States, the nation that perfected religious liberty and enshrined it in the Constitution’s First Amendment, had become hostile to the rights of religious groups.
But that’s not what’s happening. In reality, U.S. law is honeycombed with examples of preferential treatment and special breaks for religion. Some of these practices may grow out of the First Amendment command that the “free exercise” of religion must not be infringed. Others are traditions or were added to the law after lobbying efforts by religious groups. ...

. Criminal Investigations

The sentencing of Catholic cleric Msgr. William J. Lynn of Philadelphia to three to six years imprisonment for knowingly covering up evidence of clerical abuse of children by priests captured national headlines – because it was so unusual.
Lynn is the only church official sentenced to date in a long-running scandal implicating Catholic clergy nationwide. Victims of clerical abuse have had to resort to civil lawsuits to get justice, and even there have encountered numerous roadblocks.
Plenty of evidence indicates that church officials knowingly reassigned offending priests to other parishes instead of alerting law enforcement. In one especially egregious incident, a year-long investigation by the Dallas Morning News in 2004 found that priests accused of child molestation were often given special treatment by law enforcement, and in some cases priests from other countries were allowed to return home.
Observed the newspaper, “Since the clergy sex-abuse scandal exploded anew in 2002, Catholic leaders have taken the brunt of the blame. Overlooked is the role of police, prosecutors and judges – the people expected to hold abusers accountable when the church itself will not. Law enforcement typically has helped through inaction, but sometimes the aid has been direct.”
Efforts by victims to hold top church officials accountable have been stymied by the U.S. government. When victims charged in one lawsuit that Pope Benedict XVI had helped cover up the sexual abuse of children by priests, the Bush administration filed a legal brief asking the court to dismiss the case, arguing in part that the Vatican is a sovereign nation. Similar lawsuits have been filed since then, and the Obama administration has taken the same stand.

Penn State dedicates Paterno Catholic center

STATE COLLEGE, Pa. -- A new Catholic center on the Penn State campus has been dedicated to Sue Paterno, wife of veteran football coach Joe Paterno.

A local bishop on Saturday blessed the Suzanne Pohland Paterno Catholic Student Faith Center, which then celebrated its first Mass with Sue Paterno and her children and grandchildren in attendance.

The Rev. Joseph Adamec, bishop emeritus of the Altoona-Johnstown diocese, praised Sue Paterno and her late husband for helping to raise money for the $6.5 million center.

Sue Paterno said afterward that there is still work to be done on the center. She said her husband, who died in January, "is right behind me. I know he's watching us."

The diocese says Catholic Campus Ministry serves about one-quarter of the student population as well as faculty and staff.

Vatican 'accepted one billion lire' to bury crime boss in basilica next to former popes

Remains to be moved in attempt to stem rumours of murdered girl hidden in crypt.

The Vatican is facing a deepening controversy over the burial 22 years ago of a notorious crime boss, with reports emerging that the church accepted a one billion lire (£407,000) payment from the mobster's widow to allow his interment in a basilica.
A source at the Holy See told the Ansa news agency that "despite initial reluctance" the then vicar-general of Rome, Cardinal Ugo Poletti, "in the face of such a conspicuous sum, gave his blessing" to the controversial interment of Enrico De Pedis, the former boss of Rome's notorious Magliana gang. The money was reportedly used on missions and to restore the Basilica of St Apollinare, where the mobster was laid to rest next to popes and cardinals after his death in 1990.

The claims, which the Vatican has not commented on, may explain how such a reviled criminal was buried in such a hallowed site. Last week, to deflect growing criticism and to help resolve a 30-year-old murder mystery, it emerged that Vatican officials had decided to move the remains of De Pedis from his special crypt.

Pressure mounted earlier this month when a prosecuting magistrate, Giancarlo Capaldo, claimed senior officials at the Vatican knew much more than they were letting on about the Magliana gang's links to the Holy See, and the gang's suspected kidnap and murder of Emanuela Orlandi, the 15-year-old daughter of a Vatican official, in 1983. "There are people still alive, and still inside the Vatican, who know the truth," he said. Some believe Emanuela's father had evidence linking the Vatican Bank, Istituto per le Opere di Religione, to organised crime, and that she was snatched to keep him silent. The theory is that De Pedis, who was shot dead in 1990, organised the kidnapping.

For the past two decades, there has been speculation that Emanuela's remains were put in the tomb alongside De Pedis. The girl's brother, Pietro Orlandi, has joined those calling for the tomb to be opened.

The Vatican – under heavy scrutiny after a set of scandals – denies the claims and has hinted that investigators will be able to witness the re-opening of the crypt, in a bid to quash the rumours. "It seems that nothing has been concealed and there are no Vatican secrets to reveal," said a spokesman for Vatican, Father Federico Lombardin.

It is likely that the body of De Pedis will be moved to a less high-profile place of rest. The location may be decided at an upcoming meeting. Even if the girl's remains are not found in the crypt, the mystery surrounding her disappearance will remain.

Other theories surrounding her fate are not in short supply. One, more palatable for the Vatican, suggests that Magliana gang members snatched her at the behest of Turkish extremists, who wanted to use her as a bargaining tool to win the release of Mehmet Ali Agca, the Turkish gunman who tried to kill Pope John Paul II in 1981.

But others have implicated Paul Marcinkus, the disgraced and deceased former head of the Vatican bank, which was involved in the bankruptcy of Italy's largest private bank, the Banco Ambrosiano, in 1982.

Soon after the news of the scandal became public, the president of Banco Ambrosiano, Roberto Calvi, was found hanging beneath Blackfriars Bridge in London.

Sandusky Sentenced To 30-60 Years In Prison


BELLEFONTE, Pa. (KDKA) – Jerry Sandusky was sentenced to 30 to 60 years in prison Tuesday morning after being found guilty on 45 of 48 charges in a child sexual assault case earlier this year.

Sandusky arrived for the sentencing wearing a red prison jumpsuit with white tennis shoes. He remained handcuffed while being led into the courthouse by police.

During the sentencing, Judge John Cleland had some direct words for Sandusky.

“You have done much positive work. But you used that to conceal your vices. The reality is the nature of pedophiles is to gain the trust of parents and children, and then cover their crimes. The tragedy of this crime is that it’s a story of betrayal. Some of your victims had a genuine respect for you,” Judge Cleland said.


Regarding his taped statement from Monday, “like all conspiracy theories, it flows from the undeniable to the unbelievable,” Judge Cleland said.
Sandusky addressed Judge Cleland before the sentence was handed down.

“I feel a need to talk not from arrogance but from the heart. I did not do these disgusting acts. As I began to relive everything, it was a terrible feeling and my eyes filled with tears. Maybe some children who might have been abused will not be because of the publicity. The pain continues when I think about the people who’ve made the allegations. I’ve been confined to a small room. There are outbursts in the jail.”

“I told Dottie, ‘We’re definitely in the fourth quarter.’ Those who still believe in us are the only ones who matter. Not being able to hug my grandchildren, not being able to play with the dog. Yet, I get letters of support. I see family and friends, I see special inmates who smile at me,” Sandusky said.

He also read a letter of support he got in jail which ended with, ‘I love you Jerry.”

He also repeated several of the phrases released in his audio statement yesterday including, ‘My wife has been my only sex partner.”

The prosecutor said Sandusky’s taped statement attacking the victims and alleging conspiracy was an insult to the victims and the community.

Joseph McGettigan said Sandusky, “Whines of his own pain,” on the radio and thereby inflicts more pain upon victims and their families. He called The Second Mile, “a victim factory” for Sandusky.

McGettigan also said Sandusky’s words today will be, “deceitful and indecent as his acts were, and they will vanish in the wind.”

“The fact that he’s going to spend the rest of his life in jail is a testament to [the value of his statement.] It should disappear as if it never existed,” McGettigan said.

The defense chose to not provide evidence to challenge the Commonwealth’s contention that he is a sexually violent predator.

Judge Cleland ruled Sandusky is a sexually violent predator by, “clear and convincing evidence.”

Defense attorney Joe Amendola asked the judge to consider that the Sanduskys were, “kind and giving” and that they adopted six children over the years.

“I am asking the court not to ignore all of the good things that he did in his life,” Amendola said.

The defense was also unclear about the circumstances surrounding Sandusky’s taped message, which was released on Monday.

“My understanding is that tape had been made previously. The release was not under Mr. Sandusky’s control I’m told,” defense attorney Karl Rominger said. “The details of that I’m not certain of. I do know that the recording was made ahead of time and the exact release time was not in his control but my understanding is originally it was not to be released until after sentencing.”

The defense still claims it has ground for an appeal and plans to do so.

Several of the victims gave statements during the hearing:

Victim No. 9’s mother:
“I have had to endure my son’s suicide attempts all because of you. You’ve destroyed my family and I can never forgive you of that. Shame on you. Shame on you Mr. Sandusky,” she said.

Victim No. 1’s statement:
“There are no words to describe the pain and misery Jerry Sandusky has inflicted on my life. There are thoughts I didn’t want to think. I have been looking over my shoulder for a long time. There is no remorse in Jerry Sandusky, only evil.”

Victim No. 4′s statement:
“Rather than take accountability for your actions, you attacked us as though we did something wrong. I will never forgive you. I was in a troubled situation and you made it worse.”

Victim No. 5′s statement:
“He forcibly had me touch him. I am troubled with flashbacks of his naked body. I am tormented by nightmares and guilt. I will never erase the filthy images, but he must pay for his crimes. He took away my childhood the day he assaulted me. He should be sentenced accordingly.”

Victim No. 6′s statement:
“My personality changed for the worst. That night you called yourself the tickle monster so you could touch my 11-year-old body, has damaged me for life. The Bible says if we confess our sins he will forgive us. You are trying to speak forth your innocence. You are only fooling yourself. You won’t be able to receive forgiveness.”

Catholic officials admit that more than 6,000 US priests are proven, admitted or credibly accused child molesters. Yet no US bishop has ever been punished by the church hierarchy because of the abuse crisis – no matter how extensive, egregious or recent his wrongdoing may have been. None.

And only one US bishop has ever stepped down because of his role in covering up heinous child sex crimes.
Ten years ago, Cardinal Bernard Law resigned as the highest ranking Catholic official in the Boston archdiocese. More than 20 current and former US bishops have been accused of molesting kids. And nearly every bishop in recent years has been accused of - or proven to have – ignored, concealed, minimized or enabled clergy child sex crimes or cover ups.

Only Law, however, has resigned.

Still, for almost a decade, he remained an extraordinarily powerful figure, living and working in the literal and figurative power center of Catholicism. He was on six or eight important Vatican committees, including the one that recommended candidates for bishops across the globe. And he helped pick Pope Benedict.

Despite all of this, the anniversary of Law’s resignation should serve as a powerful reminder that even in a rigid, powerful, ancient, secretive monarchy, sometimes a small measure of justice, healing and prevention can be won, but only through the admirable bravery and persistence of child sex abuse victims and their supporters. When it comes to abuse and cover up, we see on-going recklessness, deceit and callousness – and painfully little reform – by top Catholic officials. Still, no one should ever lose sight of the fact that an incredibly well-connected and deeply-entrenched “prince of the church” was forced out. It may seem like a tiny achievement. But it’s not. The courageous and compassionate Boston victims – each and every one of them – should feel proud. The outraged church members and employees, especially the clerics who publicly called for Law’s removal – should also feel proud.And the rest of us should feel grateful to all of them and determined to continue to push for a safer church and community for children.

Cardinal Law still the only bishop to suffer personal consequences

hurch officials – Kansas City Bishop Robert Finn and Philadelphia Msgr. William Lynn – have been found criminally guilty of refusing to report known or suspected child sex crimes to law enforcement.

But that’s the secular justice system, not the church hierarchy, imposing a penalty on wrongdoers. Despite their convictions, both men have retained their positions within the church. In the case of Bishop Finn, he has steadfastly refused to step down from his post, despite the calls from parishioners and priests within his own diocese to do so.


Some thought these two convictions would be the crucial one-two knockout punch that would finally end the sick and self-protective clerical culture at the root of this awful crisis. Some thought “Surely, now that two members of the hierarchy have been found criminally guilty of endangering kids, things will change.” But that has yet to happen.

(Just last month, Miami’s archbishop finally suspended an accused predator priest after the fourth lawsuit was filed against him. The month before that, the head of the bishops’ child abuse committee tried to put a suspended, credibly accused priest back on the job.)

Rather than being denounced by other church officials across the country, Finn and Lynn have largely - and often publicly - been supported by bishops and rank-and-file priests. Virtually every Vatican official has been silent. So too has the National Review Board and the head of America's Catholic bishops, Cardinal Timothy Dolan.

The same Catholic officials who readily inject themselves in a wide range of issues and concerns absolutely refuse to denounce – much less discipline, demote or defrock - one of their own. They refuse to do this no matter how often or egregiously he protects predators, hides evidence, misleads parishioners or endangers kids.

If children are to be safer in the church, church officials must publicly speak out against their colleagues and supervisors who still protect the guilty and jeopardize the innocent. Sadly, it seems that bishops only denounce their clerics who favor women’s ordination or gay marriage. On the issue of child sex abuse, they continue to stand silently as one.

Is Boston willing to prepare the way of the Lord?

The Gospel today is a favorite of BCI and also has particular applicability to the Boston Archdiocese. This passage from Luke 3: 1-6 is the one that has always been powerful for BCI.

A voice of one crying out in the desert:
“Prepare the way of the Lord,
make straight his paths.
Every valley shall be filled
and every mountain and hill shall be made low.
The winding roads shall be made straight,
and the rough ways made smooth,
and all flesh shall see the salvation of God.”


During this season of Advent, in what ways in our own lives do we prepare the way of the Lord and make straight His paths? What things in our lives need to be straightened out? What mountains and hills should be lowered? What “winding roads” should be made straight? What rough ways made smooth?

Then there is the Boston Archdiocese. As discussed in “Is Boston Archdiocese Violating ‘Motu Proprio’ on Charity?” as of Monday, December 10, Cardinal Sean O’Malley, archbishop of Boston, will be in violation of the new Motu Proprio issued by Pope Benedict XVI for paying salaries to 17 lay executives which are nowhere near “in due proportion to analogous expenses of his diocesan Curia.” As we know from “Bloated Payroll” and numerous other posts, seventeen people at the Pastoral Center are paid salaries ranging from $150K to $325K today–about 4X-8X more per person than clergy are paid. In aggregate, they are paid somewhere close to $3.5M a year in salaries alone. This is about 6 times more than was paid in 2006 in $150K+ salaries.

The teenage victim of a Rabbi who subjected her to years of systematic rape and sexual abuse has described her joy at his conviction, declaring: 'Now he'll learn how it feels to be helpless.'
Rabbi Nechemya Weberman faces over 25 years in jail after he was found guilty of fondling the teen, forcing her to perform oral sex on him, and making her act out porn films, over the course of many years beginning when she was 12.
The girl's parents, now 17, sent her to Weberman, an influential religious counselor in New York, for extra tuition after she broke various rules of their ultra-orthodox and secretive Satmar Jewish sect.
But instead the 'master manipulator' subjected her to a campaign of sadistic abuse convincing her parents that she was a 'rebellious liar' who needed strict re-education.

And today, as Weberman awaited sentence in a New York prison cell, the girl told the Daily Post: 'I can’t wait until someone stronger, who weighs 350 pounds more, holds him down, lets him know how it feels to be so helpless.'
The depths of Weberman's sexual perversions appeared limitless and his cruel and premeditated programme of abuse grew into evermore painful and humiliating acts of domination.
They culminated one day during a 'lesson' in his study when he began burning her bare stomach with a lighter, simply because 'he found it arousing', she said.
'He told me, "When you go home, you put on peanut butter,"' she said. 'I stayed in my bed for three days. I didn’t get out of bed. I didn’t eat. I just wanted to die... I was 13, I think.'
She told how he turned her mother against her, threatening to cast the family out of the religious order if she didn't improve.
With no one left to turn to, she had no choice but to internalise the pain and live in silence.
'I didn’t love, I didn’t hate,' she said. 'I felt nothing. I froze my emotions. I wouldn’t let myself feel anything.'
The abuse finally stopped when she moved to a less religious school and was able to tell teachers of her ordeal.
Weberman, was yesterday led away in handcuffs after he was found guilty of 59 counts of sexual abuse. He faces 25 years in prison for the worst of the charges and two to seven years on lesser charges.

It took jurors a day and a half to decide the case, and defense attorneys are already vowing an appeal.
'We firmly believe that the jury got an unfairly sanitized version of the facts,' said attorney George Farkas. 'As a result, the truth did not come out and the struggle continues in full force to free this innocent man.'
Weberman was charged with 88 counts of sexual abuse and assault.
The trial cast a harsh light on the rules of the secretive community.
Prosecutors say the girl's parents sent their rebellious daughter to him for counselling after she broke several rules of the sect, including reading magazines like Cosmopolitan and People and wearing stockings that were too thin.
Rabbi Weberman was supposed to be re-indoctrinating the girl and bringing her back to the ultra-conservative standards of the community after she was branded a 'heretic.'
Instead, she told a counsellor years later, that he was abusing her.
'When you think about it,' assistant district attorney Kevin O’Donnell said, the alleged victim's parents 'were actually paying the defendant to have sex with their daughter.'
O'Donnell added that Weberman abused the girl, now age 17, 'over and over again.'
Her family paid him $12,800 in counseling fees during that time, the victim's mother testified Monday.
'I wanted to die rather than live with myself,' the accuser, who's identity has not been made public, testified. 'I didn't know how to fight. I was numb.'

The rabbi's lawyers fiercely denied the allegations. They say the girl made up the story to retaliate against him.
They claimed the girl went to police only after Weberman and her parents set up hidden cameras to secretly record the girl having sex with her boyfriend when she was still underage.
Weberman turned the tapes over to police in the hopes that the boyfriend would be prosecuted.
The charges against the boyfriend were later dropped.
Weberman's lawyers also claim that he had been business partners with the girl's parents and that the families had a falling out.
The Satmar Hasidic community in Williamsburg, Brooklyn, rallied around the rabbi - sponsoring fundraisers to pay for his legal defense.
The community numbers around 250,000 - the largest sect of its type outside of Israel.
Weberman's supporters were so protective of him they disrupted the course of the trial when they allegedly photographed the accuser during her testimony.
Four men were led out of a New York court room and arrested in late November after jumping up to take pictures of her on their phones while she gave evidence.
Each was a  members of the strict Satmar sect in Williamsburg, Brooklyn, of which Rabbi Weberman is leader.
One image of the girl was even posted to a Twitter account.

The judge criticised the men for outing the young woman, according to the Post.
'You know about the Torah, you know about rabbinical courts. This is a civil court,' Supreme Court Justice John Ingram told them.
'Your phones will be held for possible criminal prosecution. You may wish to avail yourself of counsel.'
The four - Lemon Juice, 30, Joseph Fried, 23, Yona Weisman, 23, and Abraham Zupnick, 23 - were taken from Brooklyn Supreme Court to the Brooklyn District Attorney’s Office for questioning. They face criminal contempt charges that could carry up to a year in prison, a source said.
Mr Weisman denied taking a picture, according to the Post. All spectators at the trial were then ordered to hand over their phones by the judge. One source is quoted as describing the move as being similar to what happens in a gang trial.

Pope Benedict XVI tapped the Archdiocese of Boston’s top canon law expert as the Vatican’s new prosecutor, an appointment hailed by church leaders but criticized by victims rights advocates who say his past positions cast doubt on whether he will be an impartial investigator of priest sexual abuse.
The Rev. Robert W. Oliver, a Bay Shore, N.Y., 
native, currently serves as the archdiocese’s assistant to the moderator of the Curia for Canonical Affairs.

“Fr. Robert Oliver is a gifted priest who has served the Archdiocese with distinction,” Cardinal Sean O’Malley said yesterday, describing the Dartmouth-educated Oliver as “a dis­tinguished canon lawyer who brings the requisite 
experience and an understanding of the importance of this office within the 
life of the Church.” ...

But his past handling of several controversial policy changes has critics questioning his objectivity.
“We are concerned that he is primarily someone who looks out for the rights of the accused priests,” said Anne Barrett Doyle, co-director of BishopAccountability.org. “The position … is a sensitive and important one and he will have to be equally a champion of victims. We wonder if he will be capable of being even-handed.”

In 2003, Oliver helped 
revise an archdiocese policy, altering it to curtail access by alleged victims of abuse to church records — a move that surprised lay leaders who sat on the Cardinal’s Commission for the Protection of Children.

Also that year, Oliver said the church went too far in immediately removing priests from their public ministries once they were accused of abuse. He implemented a new policy stripping them of duties only after claims are investigated.

Terrence Donilon, a spokesman for the archdiocese, called the criticism of Oliver “unfounded and just plain wrong,” adding, “He is a good and decent priest who is widely viewed as just, competent and committed to the truth.”

Pope Benedict XVI on Saturday appointed a Boston canon lawyer with extensive experience handling sexual abuse complaints to be the Vatican’s chief prosecutor of sex crimes against minors.

The Rev. Robert W. Oliver, 52, will become promoter of justice — a title akin to prosecutor in the American legal system — for the Congregation of the Doctrine of Faith, the Vatican office charged with protecting church doctrine. It oversees all serious crimes against the church, including the sexual abuse of children by priests.

Oliver is a longtime professor of theology and canon law who since 2002 has served in a variety of capacities in the church’s internal legal system, or canon law system, in Boston – as judge, promoter of justice, chief of investigations, and member of the archdiocesan review board that handles sexual abuse complaints. ...
The Boston tribunal, as the archdiocesan court is known, is still struggling to adjudicate a backlog of sexual abuse cases against priests. Fifteen cases have been languishing since 2004 or earlier.
Mitchell Garabedian, who has represented many sexual abuse victims in Boston, said he wondered whether Oliver’s departure would further delay some of those cases.
“Closure in these cases is such an important part of the healing process for sexual abuse victims,” he said.
Donilon said concluding the cases was a church priority. “Closure and the care of survivors and their families is important to the cardinal,” he said.

Pope Benedict XVI on Saturday appointed as the Vatican's new sex crimes prosecutor a priest who handled clergy sexual abuse cases in the Roman Catholic Church in Boston at the height of the scandal and for years afterward. ...

Father Oliver was among the canon lawyers brought in to advise Cardinal Bernard F. Law on sexual abuse cases in Boston, where the church's sexual abuse scandal erupted anew in 2002. He was put in charge of the office investigating charges against accused priests after the cardinal was forced to resign in 2002 amid an uproar over revelations that the cardinal had kept abusive priests working in parishes.

Father Oliver helped write the archdiocese's new abuse prevention policy in 2003. He has been serving as a canon lawyer for the archdiocese and as a visiting professor of canon law at Catholic University of America in Washington.

Advocates for abuse victims in the Boston Archdiocese criticized his record on Saturday. Anne Barrett Doyle, co-director of Bishop Accountability, a watchdog group that maintains an archive of abuse cases and documents, said in an interview, "Reverend Oliver is a champion of accused priests, which obviously does not bode well for the job he will do as promoter of justice."

She said that under that under Father Oliver's guidance, the Boston Archdiocese reported that between 2003 and 2005 it had cleared 32 of 71 accused priests, about 45 percent, saying it did not find "probable cause" to pursue abuse cases against them. That was a far higher clearance rate than the 10 percent reported by other dioceses nationwide,
according to a report in 2005 by the United States Conference of Catholic Bishops.

She also said the new policy on abuse that Father Oliver helped write in 2003 allows accused priests to remain in the ministry without being publicly identified while allegations against them are investigated. In contrast, laypeople suspected of abuse who work or volunteer for the church are to be immediately suspended.

Father Oliver is not expected to grant any interviews, said Terrence C. Donilon, a secretary for communications for the Archdiocese of Boston. But he said, "Any attacks on Father Oliver's distinguished track record of service to the church and his many contributions to the response to clergy sexual abuse are unfounded and just plain wrong."

The headline is a grabber - "Mahony Relieved of Duties."
On the surface it looks like Archbishop Jose H. Gomez has finally put the Archdiocese of Los Angeles on the road to righteousness by censoring his predecessor, Cardinal Roger Mahony.
But when you scratch the headline's surface, you only find more surface.
Sadly, Archbishop Gomez's condemnation of his predecessor is right out of his predecessor's playbook; Do the minimum while pretending to do the maximum.
Granted, a public rebuke of a cardinal by a prelate of a lower rank is exceptionally rare. But equally rare is the depth and breadth of Mahony's complicity in a conspiracy to obstruct justice.
While it's historically significant the church has finally taken official action against the holy man who helped cover up child rape and other crimes against children, it's important to remember this action comes only after the archdiocese had exhausted every other legal option. Read full article

Cardinal Mahony's deal with the devil

Do we have a little spat going on now at the Archdiocese of Los Angeles?

Archbishop Jose Gomez and Cardinal Roger M. Mahony seemed to be going at each other in recent days over the molestation scandal that just won't die, thanks to Mahony's years-long efforts to keep all the dirty little secrets under wraps.

On Wednesday, Bishop Gomez issued a rebuke, announcing that Mahony was being relieved of public duties now that the priest personnel records have been made public. And by the way, I'm not clear as to why it took Gomez two years to look into the files he describes as making "brutal and painful reading," for their descriptions of behavior that was "terribly sad and evil."
But even as Mahony was being kicked aside by Gomez, church spokesman Tod Tamberg was eagerly telling us Mahony is still "a priest in good standing" who can celebrate Mass and even, as a cardinal, vote for pope.

A priest in good standing? What in the world do you have to do to fall out of favor?


Editorial: L.A. Archdiocese's reaction too little, too late

The horror, the sordidness of the awful abuse of children by figures of spiritual authority is not much assuaged by current Archbishop Jose Gomez relieving Cardinal Mahony of "all public duties" after mounting evidence showed he shielded pedophile priests from law enforcement.
So Mahony won't be overseeing the Sacrament of Confirmation at Our Lady of the Angels anytime soon. But he is not only still a priest who can perform Mass - he is still one of the 120 cardinals who form the leadership of a church with more than 1.1 billion adherents worldwide, in a line going back to St. Peter.
Given what we now know about Mahony's active efforts to protect known and suspected sexual abusers in clerical collars, this removal of him from public life is not only not enough - it's no punishment at all.
And this crime deserves punishment. That was made clear by the heartbreaking letters that were made public last week.

The very first one in this alphabetical order was written by a anonymous parishioner molested as a child at a Colorado Roman Catholic Church summer camp by the Rev. Call me a hopeless optimist, but I think the developments in LA put more pressure on the Vatican to take action against Bishop Finn in Kansas City.

Don't misunderstand me: Mahony's so-called 'restrictions' and Curry's so-called 'resignation' are ineffectual symbolism and hollow gestures. Both retain their titles (Cardinal and Bishop, respectively). Both have ever-so-slightly lighter workloads. Both keep their salaries, health insurance, dental coverage, car allowances, and all the rest.

Both will be a little bit less visible. (That, however, may be advantageous for them, given how horrifically they've treated hundreds of victims and hundreds of thousands of Catholics.)

Still, something has been done in LA. In contrast, nothing has been done in KC.

One can argue "Mahony and Curry have been deceptive for much longer than Finn." True, but Finn's deception – in the Fr. Shawn Ratigan case and others - is far more recent.

Vindictive victims, greedy lawyers, salacious reporters, inept therapists, unfair laws - these are among the many targets of Cardinal Roger Mahony's favorite hobby - blaming others for his archdiocese's on-going clergy sex crimes and cover up crisis.
Today, he's added another culprit: his allegedly poor education.

According to the National Catholic Reporter, Mahony writes on his personal blog that "Nothing in my own background or education equipped me to deal with this grave problem. In graduate school earning a Master’s Degree in Social Work, no textbook and no lecture ever referred to the sexual abuse of children."

This may well be Mahony’s wildest claim yet. Even grade school drop outs know that laws prohibit child sex crimes and that when we know about or suspect child sex crimes, we are supposed to call the police. Period.

When Mahony was in school, there was probably no mention of gang rape or identity theft or child porn either. So because Mahony took no course in these crimes, it’s OK if he enables and conceals them?

Just in case this “poor education” excuse doesn’t fly, Mahony tosses out a few of his old favorites again, taking yet another swipe at the often-Catholic therapists he picked and paid to allegedly “evaluate” pedophile priests (and who often seemed to give Mahony the ‘diagnosis’ that coincidently seemed to be advantageous to him).

Just when you think things can’t get much worse for Cardinal Roger M. Mahony, along comes a stunning rebuke from his successor, Los Angeles Archbishop Jose Gomez.

“I find these files to be brutal and painful reading,” Gomez said of the molestation files Mahony tried desperately to keep out of the hands of police, even as known pedophiles claimed more victims. “The behavior described in these files is terribly sad and evil.”

So far, so good. But in The Times story on the decision by Gomez to distance the Archdiocese from Mahony, church spokesman and Mahony loyalist Tod Tamberg said the cardinal’s life would be largely unchanged and that he would remain “a priest in good standing.”

Excuse me?

How could he still be in good standing?


And why did it take until Thursday for the archdiocese to announce that Santa Barbara Auxiliary Bishop Thomas Curry, Mahony’s go-to man in the 1980s on molestation, has stepped down? The church has known for years what Curry’s role was in the scandal.

Last night, the Los Angeles Archdiocese of the Roman Catholic Church took two major actions: it released 12,000 documents relating to priests accused of child sexual abuse, and simultaneously announced Cardinal Roger Mahony had been relieved of his duties. Cardinal Mahony has been heavily criticized for his handling of sex-abuse charges against Church officials, and yesterday the Church also relieved his subordinate, Auxiliary Bishop Thomas Curry, the current Regional Bishop of Santa Barbara, of his responsibilities. As the former Vicar for Clergy, Bishop Curry served as Cardinal Mahony’s point person on claims of sex abuse within the Church.
Irwin Zalkin, an attorney with The Zalkin Law Firm who has represented numerous victims of child sexual abuse committed by Catholic priests, and has been directly involved in the efforts to obtain public release of the documents from the Los Angeles Archdiocese responded to questions today about the news from the Los Angeles Archdiocese.

Q: What do you think of Cardinal Mahony’s demotion?

A: The demotion of Cardinal Mahony is nothing more or less than a public relations ploy. He is retired and not very involved with the public anyway. This man is a criminal aider and abetter of child sexual abuse and should be criminally accountable. Criminal prosecution against him is long overdue.

Q: What’s the history of these records and why are we hearing about them now?

A: In the summer of 2007, a $660 million global settlement was reached between 508 victims of sexual abuse within the LA Archdiocese and several Catholic religious Orders. The settlement required the LA Archdiocese to release files on all priests who, over the last 50 years, had credible claims of sexual abuse made against them. While the settlement included a very clear process for identifying which records to make public, it has taken six years to get the LA Archdiocese to comply with that agreement. Finally, the world can know the whole truth about what they did to protect predator clergy members and the Church’s reputation at the expense of young innocent children.

In the summer of 1945, following a three-week trial, a jury convicted Maréchal Philippe Pétain of treason and sentenced him to death. The verdict excited controversy. Though, in four years as France’s chief of state, he had created a generally repressive regime and collaborated with Hitler, there was plenty to be said in Pétain’s favor. During the First World War, he had led French forces in resisting the Germans at Verdun. In the war that followed, he justified seeking peace with Germany with a kind of patriotic realism. The duty of the government, Pétain argued, was not to flee to England, but “to remain in the country, or it could not longer be regarded as the government.”

In Cardinal Roger Mahony’s record as Los Angeles archbishop, it’s possible to see a broadly comparable mixture of good and evil, prescience and stupidity. On the credit side, Mahony presided over the archdiocese in the years when it doubled in size, becoming the largest in the nation. He blazed a trail in reaching out to Latinos, and he did it in a spirit of charity — Rocco Palmo has called the relationship a “love story.”

But Mahony’s record on curbing priestly sex abuse is abysmal. As memos exchanged by the future cardinal and Msgr. Thomas Curry reveal, Mahony effectively shielded three abusive priests from civil authorities. Each of the three priests faced multiple allegations from victims as young as 12. Mahony recognized that some of those allegations amounted to first-degree felonies. Yet when Curry’s plans to keep them out of the courts (and out of the papers) showed an ingenuity that verged on cunning, Mahony approved. After Fr. Michael Baker admitted privately to abusing young boys, Mahony wrote of Curry’s advice, that the information be concealed from psychiatrists, “sounds good — please proceed!”
