The worst thing about the Victoria Police exposure of the Catholic Church’s deliberate and dedicated decades-long cover-up of sexual assaults on children by priests, is that it doesn’t surprise me. Not for a minute.

Even though it almost makes the gorge rise in the throat and makes me want to scream at everybody – at so-called church leaders, at some of the cops, and past governments – makes me want to shout: ‘What took you so frigging long?’

How many more innocent children have suffered at the hands of predatory priests because of systemic stonewalling and covering up and pervert protection in the name of God?

Catholic leaders are trotting out again. Same old pious bullshit. ‘We’re shocked and amazed by these latest allegations. Had no idea any of this was going on’. After all, remember, they haven’t reported to Police even one case of a priest sexually assaulting a child. Not one. They admit that in the past 14 years they’ve paid money to 300 victims. Hush money.

Church sex-abuse delusion shattered

THAT child sexual abuse by clergy has been found to be considered by Church hierarchy as “a short-term embarrassment” and not a reason to question their own culture is a toxic delusion hopefully to be exploded by today’s State Government report. It found the abuse of trust of children and parents was beyond comprehension.

Committee member Andrea Coote said the committee found current Catholic leadership saw child sexual abuse as something that could be minimalized and trivialised, and that “a sliding morality has emerged in the Catholic Church”. How terrifying, how dangerous and yes, how incomprehensible.

 Parents Anthony and Chrissie Foster, whose two daughters were serially raped by a paedophile priest, were in Parliament to see the report tabled.


As chairwoman Georgie Crozier said tabling the Betrayal of Trust report, and as became painfully clear during the committee’s hearings, the children betrayed by trusted figures in organisations of high standing suffered unimaginable harm.

“Parents experienced a betrayal beyond comprehension, and the community was betrayed by the failure of organisations to protect children in their care,” Ms Crozier told Parliament.

And yet, henceforth, all we have been given is half-hearted acknowledgment that past systems of governance may have failed (enabling paedophiles to be moved from parish to parish and to keep abusing), and mere lip service paid to the pain of victims and parents whose lives were damaged to the core.

There have been excuses, and carefully crafted answers, but no meaningful apology or talking of responsibility for Church attempts to cover up cases of abuse and actively hinder attempts to have offending priests charged.

Belated as it is, it’s in part thanks to the tireless efforts of people such as Anthony and Chrissie Foster, whose daughters Emma and Kate were serially raped by a priest at primary school, that this inquiry happened at all. Now ambassadors for the lobby group Adults Surviving Child Abuse, they fought for more to be done to expose the systemic abuse and cover-ups.

Early in 2008, Emma Foster died of a medication overdose at the age of 26. Katie became a binge drinker as a result of her abuse and was hit by a drunk driver in 1999. She was left physically and mentally disabled, requiring 24-hour care. 

The Fosters were in parliament to see the committee report handed down and hugged chair Georgie Crozier afterwards. 

The impact of the sex crimes of clergy and other people in positions of authority over children is impossible to measure; as the head of the Federal Government’s Royal Commission into institutional sex abuse, Justice Peter McClellan, said yesterday many people never tell their story and it takes others decades to come forward.

The Federal investigation has attracted so many people wanting to talk about what happened to them—often for the first time—that Justice McClellan said staff had been “inundated” to the point where 100 extra personnel were needed now to meet demand.

That inquiry has received more than 6000 calls from people wanting to make statements about abuse that happened to them as children at the hands of institutions.

Justice McClelland said in September that stories the commissioners are hearing from victims “will shock a nation”.

He said often “unbelievable violence” comes with the sexual abuse of children and even gathering this evidence has been “harrowing”.

It has been reassuring to hear on radio this morning that other victims and their families celebrated as this damning document was presented, but there is still much justice to be delivered to people whose suffering was compounded by the complicity of powerful figures in their community and Church in efforts—over decades—to shut them up.

Dr Napthine said the Catholic Church had failed in its duty to protect the welfare of young children who had suffered in the hands of people they had every right to trust.
"The leaders of the Catholic Church should hang their heads in shame," he said.
Dr Napthine criticised the Catholic Church for decades of concealing abuse and not taking action against the perpetrators responsible.
"The culture seemed to be putting the interests of the church and its priests ahead of the interests of children and victims, and that is totally and utterly wrong,' he said.

He has been warning for years about the disgraceful behaviour of the Catholic Church and other institutions with responsibility for caring for children
Sen-Sgt O'Connor said evidence suggested some priests chose to be priests because of the hold it would give them over children they could abuse, just as other paedophiles were attracted to jobs which gave them easy access to children.

The Victorian parliamentary inquiry into child abuse took Cardinal Pell to task in its report over his attempt to separate the church as a whole from the actions of senior religious figures it said had "minimalised and trivialised" the issue.
In a swipe at Cardinal Pell's evidence, its report said that following repeated questioning he agreed some bishops and religious superiors had covered up the issue.
"That is quite different from the whole church ... the whole church is not guilty of that," he told the inquiry.

Citing a Ballarat school at which four pedophile staff were employed in the 1970s, the report says pedophiles often relied on the protection of their religion.
"Offenders who were members of religious organisations were confident that they could abuse their victims and that their activities would not be revealed," the report, tabled in parliament on Wednesday, says.
"Victims have explained that upon reporting criminal child abuse to other members of the religious organisation, no action was taken or that they were physically punished."
The committee says it is concerned the Christian Brothers cannot explain the "startling" situation in which four staff at St Alipius primary school, including Brother Robert Best and Brother Edward Dowlan, were later convicted of sexual offences.

THE Christian Brothers spent more than $1.1m over 15 years defending paedophile Brother Robert Best before he was finally jailed 2011 after pleading guilty to aggravated indecent assaults against children.
On another occasion, the Catholic Order hired private investigators to investigate victims who had complained to police about one of its members.
Wednesday's report of the parliamentary inquiry into child abuse slammed the Catholic Church, saying it had "made a deliberate choice to pursue a course of concealing the problem of criminal child abuse."
Worse, Church leaders had conceded "the Church had adopted a policy of cover-up and that this involved concealing offending, and moving priests and other religious to areas where further abuse then occurred".

The Victorian State Parliamentary enquiry into child sexual abuse by clergy has presented its report, which contains 15 principal recommendations for the Victorian Government (see yesterday’s posting). Laws covering these recommendations are expected to be passed by the Parliament early next year.
While the bulk of the report reinforces the pre-existing perception that abuse was widespread, covered up and that victims were poorly treated, the focus for it has been the legislative changes required to do something about the problems. Any new laws will have to be carefully crafted to avoid loop-holes which the churches’ lawyers could exploit. It is probably, therefore, worthwhile, to commence an analysis of responses by stakeholders with members of the legal profession who are associated with the victims.
Melbourne lawyer, Angela Sdrinis, who acts on behalf of victims, said the legislative reforms and removal of the statute of limitations were very important. “Most historical abuse claimants face that defence that their claim is out of time,” she said. “The recommendations regarding ensuring that church entities can be sued in these cases of historical abuse is very important, but the recommendations regarding an alternative justice model are also very important.”
Ms Sdrinis said very few of the hundreds, if not thousands, of claims made against the Catholic Church had succeeded because of two “almost impregnable” legal defences. “The two important things for me as a lawyer representing people are the legislative reform and the abolition of the statute of limitations is obviously very important,” she said. Further, she hopes the government will act quickly to take on the recommendations, and not wait for the outcome of the federal royal commission into child sexual abuse

Prime Minister Tony Abbott's support for Cardinal George Pell over child sex abuse is inappropriate and factually wrong, victims say.
This new controversy came as the Speaker of the Victorian Parliament, Ken Smith, accused the former Melbourne vicar-general, Gerald Cudmore, of committing perjury in evidence he gave to a parliamentary inquiry in 1993. Mr Smith said highly placed Catholics stifled his inquiry's report.

Mr Abbott told Fairfax Radio that Cardinal Pell, a former Catholic archbishop of Melbourne, was the first senior cleric to take sexual abuse by clergy seriously.
Asked whether Cardinal Pell, now Archbishop of Sydney, carried any responsibility for the failures described by the report of the Victorian inquiry into the church's handling of child sexual abuse, Mr Abbott said he hadn't read it.
''As is pretty well known, I have a lot of time for George Pell … my understanding is that the first senior cleric who took this issue very seriously was in fact Cardinal Pell.''
The report, Betrayal of Trust, said the cardinal was reluctant to acknowledge and accept responsibility for the church's failings on criminal child abuse. It also strongly condemned the current Catholic leadership, saying it trivialised and minimised abuse, treated it as ''a short-term embarrassment'', and betrayed the church's purported values.

The committee established by the parliament of Victoria in Australia to conduct an inquiry into the handling of child abuse by religious and other non-governmental organizations has just presented its report to parliament. The report is entitled A Betrayal of Trust, and is online at the parliamentary website (part one is here, part two here, and an executive summary here; all are pdf files). As David Marr reports for The Guardian, the report is "unsparing" in its criticism of the Catholic church.
The report notes that it focuses on the Catholic church because the submissions it received from victims of abuse in Victoria when parliament established the inquiry were preponderantly from people who had experienced abuse by Catholic religious authority figures. A major theme of abuse survivors was the betrayal of trust by religious organizations they had previously trusted--as the report notes, "particularly the Catholic Church."
That betrayal of trust had eroded their sense of self-worth throughout their lives, survivors reported, resulting in mental health struggles, difficulty establishing healthy relationships, addiction issues, problems in education and employment, and so forth. Regarding religious groups and how their betrayal of victims' trust affected their lives, the report's executive summary states,
This feeling resulted from the inconsistent approaches by organisations to victims versus offenders—that is, giving inadequate support to victims, while providing pastoral, legal and financial support to offenders. They spoke of unfulfilled promises by leaders in the organisation and the trivializing of their experiences.
About the response of the Catholic church, in particular, the report states,
In regard to the Catholic Church specifically, the Committee found that rather than being instrumental in exposing the criminal abuse of children and the extent of the problem, senior leaders of the Church:

• trivialised the problem
• contributed to abuse not being disclosed or not being responded to at all prior to the 1990s
• ensured that the Victorian community remained uninformed of the abuse
• ensured that perpetrators were not held accountable, with the tragic result being that children continued to be abused by some religious personnel when it could have been avoided.

DENNIS Hayes doubts child sexual abuse victims will ever get over the horror.
The recent public scrutiny of institutionalised child sexual abuse, he said, would at least give them a degree of normality.
A big part of that process was the apology — four years ago tomorrow — from then prime minister Kevin Rudd to the “Forgotten Australians”.
These are the roughly 500,000 children who found themselves in orphanages or church-run or state homes between 1930 and 1970.
Mr Hayes does not want to reveal his own story, aside to say that growing up in 11 different institutions qualified him as one of “the forgotten”.
The apology, the federal government’s Royal Commission into Institutional Responses to Child Sexual Abuse and the Victorian Parliament’s inquiry into clergy child sexual abuse were important steps in helping victims, he said.

The report of the Inquiry into the Handling of Child Abuse by Religious and Other Non-Government Organisations has now been tabled in the Victorian Parliament. Entitled Betrayal of Trust, it is sober reading. It deserves to be read by everyone involved in the leadership of religious organisations in Australia to ensure that the widespread abuses and systemic failures it documents are never allowed to occur again.
If acted upon, its recommendations will see the most fundamental overhaul of the way the churches are governed in Victoria’s history. This is because the inquiry has taken seriously the complex structures and histories of religious institutions in governance, law, and authority.
The report recognises that churches should be free to determine their own beliefs and behaviours in purely religious matters. It also recognises that it is hard to define the limits of what is and what is not a religious matter.
At issue is not the separation of church and state. Rather, the question is the extent to which the state ought to regulate the churches in matters such as freedom of conscience, or freedom to discriminate.

HIGH-ranking members of the Catholic Church acted in "scandalous" fashion by ignoring claims of sexual abuse and attempting to protect an accused priest and the church brand, a judge has said.

In a scathing attack on the church, County Court judge Felicity Hampel today slammed it for not helping a young sexually abused altar boy and not referring the matter to police.

Depraved Catholic priest Russell Robert Walker sexually abused two altar boys over a four-year period in the 1970s - despite the Archbishop of Melbourne at the time being warned about him.

Walker had been confronted by the parents of one of the boys, only to reply: "How dare you accuse me of sleeping with your son."

The Catholic Church never took action, the judge said.

MELBOURNE'S Catholic archdiocese actively protected a paedophile priest by moving him to a different parish, where he continued to abuse a boy, a judge says.

Russell Robert Walker, 64, was a parish priest when he repeatedly abused two altar boys in the 1970s, despite Melbourne's then-archbishop Frank Little being warned by one victim's mother.

Jailing Walker for five years today, Victorian County Court Judge Felicity Hampel said the church's response to the warning was scandalous.

"Although you're not to be punished for the institutional response, what happened was scandalous," she said.

"This boy was not the only victim of clerical abuse in the Melbourne archdiocese, nor the only victim whose welfare was ignored while the church took active steps to protect the priest and itself."

A former Catholic priest has been jailed for five years for sexually abusing two altar boys during the 1970s.
County Court judge Felicity Hampel said Russell Vears, who later changed his name to Walker, had been a 27-year-old newly ordained priest in 1976 when appointed assistant priest to a parish in Melbourne's outer south-east.
Within a year of his arrival at the parish, Walker began sexually abusing two 14-year-old boys.
"Their families were active members of the congregation, and they were both altar boys. As a result you had easy access to them, and were trusted by them and their families," Judge Hampel said on Tuesday.

The judge said that by the third year of Walker's tenure at the parish, the parents of one of the boys suspected he was abusing their son.

Victims of clergy abuse and their advocates want to see more support to stop suicides in a Victorian inquiry's recommendations.
Support to stop the tragically high number of suicides among victims of clergy sexual abuse must be a key recommendation of a Victorian parliamentary inquiry, victims and advocates say.
Clergy abuse survivor Stephen Woods says the deaths are a indictment of the Catholic Church, with as many as 60 linked suicides in western Victoria.
He hopes the Victorian parliamentary inquiry will recommend providing funds for abuse survivors to pay for health bills, counselling, housing and living expenses.
"There are so many victims who are hurting and whose lives are still shattered from pedophilic activity, that society is going to have to support them for the rest of their lives - and that support needs to be adequate to stop the deaths," he told AAP.
"The number of suicides even from Ballarat has been just outrageous."

This archishop covered up a priest's crimes

A court has heard how one of Australia's most prominent Catholic archbishops, Most Reverend Sir Frank Little (of Melbourne), covered up the crimes of a priest (Father Russell Vears). A parent notified Archbishop Little about the crimes, but the church authorities managed to conceal the crimes from the police until one of the victims contacted the police three decades years later, in 2011.
Sir Frank Little was the archbishop of Melbourne (one of the largest Catholic dioceses in Australia) from 1974 to 1996 (when he was succeeded by Archbishop George Pell).
Father Russell Robert Vears (ordained in 1975) was protected by the Melbourne diocese until the 1980s. He later ceased working in parishes and changed his surname to Walker. However, although he no longer has a parish now, Vears/Walker still has not been officially stripped of his priesthood.

The Victorian State Parliamentary enquiry into child sexual abuse by clergy is expected to release its report on Wednesday, 13th November. It is also anticipated that many people will turn out at Parliament House to demonstrate their views on the possible recommendations.
Leaks to the media suggest that the report will include a call for a law to create a new criminal offence “for ministers of religion who fail to report physical or sexual abuse of children by other clergy.” The offence is likely to involve a prison sentence, although nothing has been revealed concerning the possible length of such sentences.
The Catholic Church has previously claimed that admissions revealed in the confession box would not be referred to the civil authorities. No less an official than Australia’s only Cardinal, George Pell (see previous postings) has expressed this view. Others have claimed they would rather face imprisonment than abide by such a law. Indeed, similar laws in Ireland have met with this response, although those laws have yet to be tested in the Irish courts.
A mandatory reporting law which includes clergy will have to be very carefully crafted, since the Catholic Church will undoubtedly attempt to challenge its validity in the courts. It will have very expensive lawyers at its disposal to push its case. It would be incumbent on the Victorian state Government to ensure it fully funds its defence of the laws if they do, indeed, come up before the courts. It should not be up to victims and their supporters to carry the cost of any legal challenge to the laws.

Melbourne's Catholic archdiocese actively protected a pedophile priest by moving him to a different parish, where he continued to abuse a boy, a judge says.
Russell Robert Walker, 64, was a parish priest when he repeatedly abused two altar boys in the 1970s, despite Melbourne's then-archbishop Frank Little being warned by one victim's mother.
Jailing Walker for five years on Tuesday, Victorian County Court Judge Felicity Hampel said the church's response to the warning was scandalous.
"Although you're not to be punished for the institutional response, what happened was scandalous," she said.

Royal Commission into child abuse swamped by submissions

How child sex abuse happens and how judges sentence offenders will be an important focus of the royal commission into child abuse, its chairman said on Tuesday.
Speaking in Melbourne, Justice Peter McClellan said the commission, having returned to Melbourne, would also look at the practical impact of the statute of limitations in preventing victims from suing perpetrators, which many people see as a "significant injustice", and whether there should be a general compensation scheme.
Justice McClellan, chairman of the Royal Commission into Institutional Responses to Child Sexual Abuse, said that up to last Friday the commission had received 6362 phone calls, 2775 written inquiries and 627 personal submissions.

It had conducted 742 private sessions with victims, with 524 approved but awaiting appointments, and another 1300 seeking a private session, of whom probably half would get one, he said.

He said the private sessions, which were set up by act of parliament, had worked well. Although traumatic for many, the sessions had allowed victims to talk to someone with authority about the deeply traumatic and life-defining experiences they suffered as children.

SARAH FARNSWORTH: When the Royal Commission into the Institutional Responses to Child Sexual Abuse was set up, the laws were changed to allow people to tell their stories in private sessions.
In a rare speech, the chair of the commission, Justice Peter McClellan, says those sessions have given a clear picture of the harrowing and traumatic experiences suffered by many.
PETER MCCLELLAN: It is not uncommon for men of my own age to break down and weep when describing the trauma of their childhood. For some it is the first time they have been able to tell anyone of their personal story.
It is common for them to report not only a sexual abuse, but extraordinary levels of physical abuse and psychological trauma.

Advocates urge action on Vic abuse report

Victims' advocates are urging a swift, bipartisan response to the Victorian parliament's landmark report on child sex abuse.
Advocacy group Commission of Inquiry Now (COIN) president Bryan Keon-Cohen said politicians must not await the outcome of the national royal commission when considering any recommendations made by the Victorian committee.
The report is due to be tabled on Wednesday after 12 months of submissions on the handling of child abuse by religious and other organisations, which began in October last year.
In November, then-prime minister Julia Gillard announced a royal commission into child sex abuse.
Dr Keon-Cohen said it would be a gross injustice if the state government deferred to the royal commission.

Former Catholic priest Russell Robert Walker sentenced to five years in jail for abusing boys

A former Catholic priest has been sentenced to five years in jail for abusing two 14-year-old boys more than 30 years ago.
Russell Robert Walker was at two parishes in Melbourne's south-east when the offences occurred.
He was arrested after one of his victims, who cannot be identified, went to the police in November 2011.
The Victorian County Court was told Walker began indecently assaulting the two altar boys within a year of joining the priesthood in 1976.
He gave one victim alcohol before abusing him and, on another occasion, indecently assaulted the boy on a bench.
Walker told the second boy he loved him and abused the boy more than half a dozen times.

The statement, which has been endorsed by Church leaders across Australia, acknowledges the damage sexual abuse has done. It acknowledges past failings including cover-ups, failures of leadership and not believing victims.
It also provides a commitment to work towards repairing past wrongs, listening to and hearing victims, putting victims’ needs first, and doing everything possible to ensure a safer future for children.
Mr Francis Sullivan, chief executive officer of the Catholic Church’s Truth Justice and Healing Council, has written to some 1100 priests suggesting they read the statement, first published in the Council’s Towards Healing submission to the Royal Commission in September, during Mass, make it available in church foyers and publish it on parish websites.

The Victorian Parliament's inquiry into the handling of child abuse by religious and other organisations has made 15 recommendations to the Government, several of which are likely to be strongly opposed by the Roman Catholic Church.
The two-volume report entitled Betrayal of Trust was tabled in the State Parliament's Upper House this morning.
Among the recommendations is a call to change laws to ensure anyone failing to report serious child abuse is guilty of an offence.
The Catholic Church hierarchy has always insisted that information gathered by priests in the confessional should remain secret.
The report also recommends the creation of new criminal offences of "grooming" children and "endangerment" where figures of authority within institutions can be sanctioned for not taking enough precautions.

A litany of abuse and betrayal

ENDEMIC criminality and cover-ups warrant strong responses. To that end, the recommendations of the Victorian inquiry into child sex abuse by religious and other organisations should be considered on a national basis by the royal commission into child abuse and by political leaders. The recommendations include lifting the statute of limitations to assist victims, making it an offence to conceal abuse, a statutory body to monitor and audit compliance on child protection requirements, and an independent body to handle victims' claims.
After years of frustration, the Victorian inquiry provided victims with much-needed comfort by hearing and understanding their painful experiences at the hands of clerics and others in positions of trust, especially in the Catholic and Anglican churches and Salvation Army. As one victim said: "Any abuse is dreadful ... but when it happens within the context of the Christian community, it damages your soul ... it attacks your meaning of life."
The behaviour of past church leaders was unconscionable. In 1993, for example, former archbishop Frank Little wrote a letter lauding the services of retired priest Desmond Gannon, when he knew the priest had admitted abusing five or six boys. The worst damage occurred in the decades up to the 1980s, when church responses were condemned as "seriously inadequate and sometimes non-existent". It was for that reason, Cardinal George Pell told the inquiry, he established the Melbourne Response in 1996. It was overseen by independent QC Peter O'Callaghan, an appointment welcomed by police. The inquiry was also scathing about the failure of church leaders in not reporting abuse to police. At that time, however, many victims refused to go to the police.

THE concealment of sexual abuse should be a crime, a Victorian parliamentary inquiry into child abuse says.
The inquiry committee's report recommends that people in positions of authority should be criminally responsible for placing children at risk of harm by other individuals.
The report, tabled in parliament on Wednesday, comes after months of committee hearings, during which victims and Victoria Police alleged the Catholic Church had concealed child sexual abuse by clergy members.
The church's procedures for sexual abuse complaints - the Melbourne Response and Towards Healing - do not allow for public acknowledgment of wrongdoing, regardless of the circumstances, the report says.
"Only in recent months have senior members of the Catholic Church accepted responsibility for the church's failure to conduct its operations with due regard to the safety of children," the report said.

A Victorian parliamentary report is scathing of the church's leadership prior to the 1990s, saying child abuse was trivialised and their protection of pedophiles meant abuse happened when it could have been avoided.
Archbishop Denis Hart apologised to victims and said previous responses to abuse cases were inexcusable, calling it the worst betrayal of his lifetime in the church.
"I fully acknowledge that leaders in the church made mistakes - these are indefensible," he told reporters.

The reforms follow Wednesday's tabling in State Parliament of a historic report on child abuse, which revealed police were investigating 135 new cases.
Tears flowed as victims stood in the rain to lend their voices in support of the report.
The report slammed leaders of churches and non-government organisations that failed vulnerable children during decades of "betrayal beyond comprehension".

The parliamentary inquiry into child abuse took Cardinal Pell to task in its report over his attempt to separate the church as a whole from the actions of senior religious figures it said had "minimalised and trivialised" the issue.
In a swipe at Cardinal Pell's evidence, its report said that following repeated questioning he agreed some bishops and religious superiors had covered up the issue.
"That is quite different from the whole church ... the whole church is not guilty of that," he told the inquiry.

The prime minister has gone in to bat for his friend, the leader of the Catholic church in Australia, George Pell, a man who was “not perfect” but was nonetheless “a fine human being, a great churchman”.
Tony Abbott was asked to comment on a report that followed an inquiry in Victoria, which was highly critical of Pell, his attitudes to the problems evidenced in comments before the inquiry and the institutional failures of the Catholic church in stopping child abuse.
The report, tabled on Wednesday in the Victorian parliament, recommended a broad range of actions to strengthen protections for victims, as well as additional child protection measures.
The prime minister is close to Pell. Abbott said on Thursday his understanding was that Pell was the first “senior cleric who took this issue seriously”.
“Is he perfect? No,” Abbott told 3AW on Thursday morning . “He is in my judgment a fine human being, a great churchman.

A Victorian parliamentary report recommending the Catholic Church be immediately made liable for child sex abuse has been welcomed as a "dream come true" by a victims group.
Nicky Davis of the Survivors Network for those Abused by Priests (SNAP) said she never thought the issue would be taken seriously or that anything meaningful would be done.
"We're thrilled," she told AAP on Thursday.
"They've got to the bottom of the issue and they haven't held back from taking on what needs to be done."
She described the 15 major recommendations made in the report as "comprehensive", "innovative" and "groundbreaking".
Aside from compensating victims and making those who had long avoided responsibility accountable, implementing laws and standards suggested by the committee would encourage more people to report abuse, Ms Davis said.

FOR decades, allegations of sexual abuse by clergy in Australia were handled in a piecemeal way.
Churches and institutions involved seemed able to deflect criticism, and law enforcers and politicians appeared to struggle with the issues.
Victims and their advocates were told matters were being fixed ‘‘in house’’, but somehow they weren’t.
At times it seemed as if some institutions were waging a war of attrition against their accusers, hunkered behind ancient practices that they believed entitled them to hide dreadful crimes.
Some shifted paedophiles from place to place, ducking and weaving and berating from the pulpit any who dared call their bluff.
And then, suddenly, the dam broke. The defences of church administrators fell away, exposed as the shams they always were.

A national public inquiry will return to Perth for the seventh time next month to hear about child sex abuse in Australian institutions as demand from abuse victims to tell their stories snowballs.
The Royal Commission into Institutional Responses to Child Sexual Abuse held private hearings in Perth last week and plans to return early next year.
Justice Paul McClellan, commission chairman, has revealed the massive scale of the abuse allegations being reported to the inquiry a year after it was set up by the Federal Government.
It comes as Victoria's child abuse parliamentary inquiry, which has heard from 450 victims, tabled its report yesterday and called for legal changes, including making it a crime to conceal or fail to report child abuse offences.

PRIME Minister Tony Abbott says Cardinal George Pell does bear some responsibility for the errors of the Catholic Church, but in the same breath defended the senior Catholic's response to child sex abuse.
A landmark Victorian report savaged the church's handling of abuse allegations and said Cardinal Pell had shown a reluctance to acknowledge and accept responsibility for its institutional failures.
Mr Abbott, who has not read the report, said the Catholic Church was not the only institution that didn't handle the issue well and Cardinal Pell had been the first senior cleric to act on allegations.
"I understand that these things probably did happen but I suspect it wasn't just the church that didn't handle these things well," Mr Abbott told Fairfax Radio.

After years of pressure to investigate child abuse, the Royal Commission into Institutional Responses to Child Sexual Abuse is finally underway; thus begins the long process of healing for many victims. The Commissioners have been appointed for three years with their goal being to “expose the response of the institution in which the abuse occurred and identify the lessons which can be learned from that response in an endeavour to ensure that abuse does not happen again in any institution” as told by the Chair of the Commission, the Hon. Justice Peter McClellan, in his opening address.
Two days ago the Victorian Parliament released an inquiry, into the handling of child abuse by religious and other organisations, entitled ‘Betrayal of Trust’. The inquiry's key recommendations include:
. MANDATORY reporting of child sex abuse;
. EXCLUDING organisations such as the Catholic Church from any civil action statute of limitations;
. HAVING alternative avenues of justice for individuals who don't wish to take legal action;
. GREATER monitoring of organisations and enhancement of prevention systems.
The inquiry states that government groups, including the Salvation Army and the Catholic Church, have previously failed to adequately deal with systematic child abuse and that it was "beyond dispute that some trusted organisations made a deliberate choice not to follow processes for reporting and responding to allegations of criminal child abuse". It went on to say that "There has been been a substantial body of credible evidence presented to the inquiry and ultimately concessions made by senior representatives of religious bodies, including the Catholic Church, that they had taken steps with the direct objective of concealing wrongdoing."

Religions 'punished' Vic abuse victims

Pedophile clerics abused children, thinking their crimes would not be revealed, a Victorian parliamentary report says.
Citing a Ballarat school at which four pedophile staff were employed in the 1970s, the report says pedophiles often relied on the protection of their religion.
"Offenders who were members of religious organisations were confident that they could abuse their victims and that their activities would not be revealed," the report, tabled in parliament on Wednesday, says.
"Victims have explained that upon reporting criminal child abuse to other members of the religious organisation, no action was taken or that they were physically punished."
The committee says it is concerned the Christian Brothers cannot explain the "startling" situation in which four staff at St Alipius primary school, including Brother Robert Best and Brother Edward Dowlan, were later convicted of sexual offences.

Emily, how will the Royal Commission - a national inquiry - handle this state-based report?
EMILY BOURKE: Eleanor, it's expected that this will feed into the Royal Commission.
This report out of Victoria is just the latest in many state-based inquiries concerned with sexual abuse of children.
In fact The Head of the Royal Commission, Justice Peter McClellan, said this week that over the past 30 years there have been at least 80 state or territory based inquiries that have looked at issues directly relevant to the Commission's work.

EMILY BOURKE: Eighty. That's right. 80. Now, all of these previous Australian reports will be gathered up and the Royal Commission will try to identify the good and the bad amongst the recommendations and how effective they've been.

 

Survivors 'euphoric' about report, but concerned about future

Some later said they felt a sense of euphoria about the report, but they also had trepidation about the future. They also said they wanted the government to amend laws, as recommended by the report, as quickly as possible.

ELEANOR HALL: As the report was handed down in the Victorian Parliament this morning, the public gallery was packed with victims of child sexual abuse and their families, many of whom gave evidence at the inquiry.
Our reporter Alison Caldwell spoke to some of them afterwards.
ALISON CALDWELL: Anthony Foster's daughters, Emma and Katie, were repeatedly raped by their parish priest, Father Kevin O'Donnell, at their primary school in Melbourne's south east, from 1987 until 1992.
The Catholic Church had received numerous complaints about O'Donnell's behaviour dating back to the 1940s, but no action was ever taken.
Emma Foster eventually committed suicide. Her sister Katie was seriously disabled when she was hit by a car after binge drinking and now requires 24 hour care.
Anthony Foster says he and his wife Chrissie feel a sense of euphoria today, but also trepidation about what lies ahead.

 

Police probing 135 new sex abuse claims

More than 100 new allegations of sexual abuse have been referred to Victorian police as a result of the state's parliamentary inquiry into child abuse.
The final report of the inquiry says that as of November 6, 135 matters had been referred to the Sano task force, established by police to follow up specific allegations of child abuse raised during the inquiry.
The report says more referrals are expected as a review of submissions made to the inquiry continued.
'As could be expected, the establishment of the inquiry and the task force ... encouraged more victims to report abuse to the police,' the report says.
Task force members attended all hearings, liaised with witnesses, gave assistance when required and in some cases the committee arranged for police to seek further information or clarification.

Victims of church abuse hail 'watershed' parliamentary report

A victim of church-related sexual abuse has hailed the tabling of the Victorian Parliament's inquiry into the handling of child abuse by religious and other organisations as a "watershed" moment.
The report outlines 15 recommendations to end abuse, including the creation of new criminal offences for concealing abuse and endangerment.
The report also calls for the creation of an independent tribunal to hear abuse complaints.
Premier Denis Napthine has pledged to immediately start drafting legislation in response to the inquiry's recommendations.
"We will act and act immediately to protect children in Victoria," he said.
Abuse victims who were in the public gallery stood and hugged each other after the report was tabled.
A former school teacher, who lost her job after pursuing a sex abuse case, called it a watershed moment, while another victim said the tabling of the report is immensely important.

THE nation's first major inquiry into religious child sex abuse has recommended a sweeping legislative overhaul to curb future criminality.
The Victorian Parliament inquiry also has slammed the behaviour of the Catholic Church for failure to deal with the decades long problem.
The inquiry has called for the lifting of the statute of limitations on offences to assist victims to pursue justice.
It calls for the introduction of a criminal offence relating to child endangerment and backs a criminal offence of grooming.
The report calls for a law to be introduced calling for a new crime of failing to report a serious indictable offence.
As revealed in The Australian, the report backs an independent body to administer a scheme for dealing with victim claims.

Church mistakes in child sex abuse response indefensible, says archbishop

MELBOURNE Archbishop Denis Hart says senior figures in the Catholic Church made indefensible mistakes in response to sexual abuse claims.
Archbishop Hart said the church acknowledged the failings of the past, as highlighted in a Victorian parliamentary report handed down on Wednesday.
"The committee's report is rightly called Betrayal of Trust," he told reporters in Melbourne.
"It is the worst betrayal of trust in my lifetime.
"I fully acknowledge that leaders in the church made mistakes - these are indefensible."
Archbishop Hart said the church had made significant progress since 1996, when it set up the national Towards Healing protocol and the Melbourne Response to handle abuse complaints.

Victims vindicated as church sex abuse inquiry delivers

It began slowly, amid some well-merited cynicism, but on Wednesday the Victorian inquiry into how the churches handled child sexual abuse delivered – and brilliantly.
Many of the victims who followed the inquiry religiously throughout its dozens of public sessions were almost euphoric after the report, Betrayal of Trust, was tabled in parliament and committee members rose to excoriate the concealers and enablers, and to recommend far-reaching reforms.
It was not just the recommendations, it was the tone. The inquiry had heard the victims – and believed them. It gave the vital verdict: vindication.
The inquiry heard from the church hierarchy too, in particular the Catholic Church – and took a far more sceptical view. The language with which they described the church made that clear, along with their rejection of the church claim that the problem was purely historical, as Archbishops Denis Hart and George Pell had suggested in evidence.

VICTORIAN Premier Denis Napthine has condemned the culture of the Catholic Church in The Victorian Parliamentary inquiry into religious child sex abuse.
Dr Napthine said the Catholic Church had failed in its duty to protect the welfare of young children who had suffered in the hands of people they had every right to trust.
"The leaders of the Catholic Church should hang their heads in shame," he said.
Dr Napthine criticised the Catholic Church for decades of concealing abuse and not taking action against the perpetrators responsible.
"The culture seemed to be putting the interests of the church and its priests ahead of the interests of children and victims, and that is totally and utterly wrong,' he said.

Twelve months ago, I wrote an article encouraging inquiries into child sex abuse to treat the church like a corrupt police force. Today, the first of the nation’s inquiries to child sex abuse, run by the Victorian government’s Family and Community Development Committee, released its recommendations, and they have done just that.
This inquiry was established prior to the national Royal Commission into Institutional Responses to Child Sexual Abuse. As such, it focuses on child sex abuse in Victorian non-government organisations. Above all else, the findings and recommendations of the inquiry suggest a government-initiated response to child sex abuse in any part of Australia is long overdue.
As the committee acknowledges, the extent of abuse at the hand of non-government actors (especially in religious organisations) is difficult to measure. However, it reasonably estimates that:
…there have been several thousand victims criminally abused in non-government organisations in Victoria alone.
The nature of the organisations investigated by the inquiry prevents the true extent of the crime from being known. For example, the inquiry found that victims were often deterred or actively discouraged from making allegations of abuse against members of the Catholic Church because of the esteem held by the church and its employees within the community.

Vic govt to act swiftly on abuse report

The Victorian government says it will not wait to act on a child sex abuse report that is scathing of the Catholic Church and recommends widespread legislative reform.
The government has six months to consider the recommendations of the inquiry into child sex abuse which include a call for concealing child abuse offences to be made a crime.
But Premier Denis Napthine said the government would introduce changes to the law in parliament early next year.
"The government will not wait to act on this report," Dr Napthine said.

The inquiry committee's report recommends that people in positions of authority should be criminally responsible for placing children at risk of harm by other individuals.
Tabled in the Victorian parliament, the report comes after months of committee hearings, during which victims and Victoria Police alleged the Catholic Church had concealed child sexual abuse by clergy members.
The report states that it's only in recent months that senior members of the Catholic Church have accepted responsibility for the church's failure to pay due regard to the safety of children.
It's also recommended that an independent statutory body be established to monitor and oversee the handling of sexual abuse allegations.

 

Compo needed for abused: church body

A national compensation scheme is needed immediately for victims of sexual abuse, a Catholic Church body says.
Francis Sullivan, the chief executive of the Truth Justice and Healing Council, which co-ordinates the church's response to the royal commission into child sex abuse, has called on the federal attorney-general to establish the scheme now rather than wait for the commission's findings to be released.
"We think the attorney-general should meet as soon as possible with the state and territories to establish a national scheme for compensation," Mr Sullivan said.
"People should not have to wait around for the end of the royal commission for other states and territories to address these matters."

AT last, the silent victims of sexual abuse of church clergy and other institutions have been given a unified voice.
The emotional tabling of a parliamentary inquiry into the enduring scandal is a major step forward in preventing and detecting future abuse, identifying risks and, hopefully, in healing.
For decades, lone victims have fought church hierarchy and a fraught legal system for true justice — recognition of the depth of damage caused by paedophile priests let loose on those they were obliged to protect.
“Let the little children come to me, and do not hinder them, for the kingdom of God belongs to such as these.” Such were the words of Jesus, in Mark 10:14.
It is a shameful hypocrisy the Catholic and some other church organisations not only allowed this biblical tenet to be systemically and horribly breached, but then worked to cover up abuse and deny victims access to justice or, in some cases, even recognition.

SYDNEY, Australia – An Australian state inquiry into the handling of child sex cases by the Catholic Church on Wednesday, November 13, said religious leaders trivialized the problem and recommended concealment of abuse should be a crime.
Its report tabled in the Victorian parliament follows a long-running probe and concluded that "we can reasonably estimate that there have been several thousand victims criminally abused in non-government organizations in Victoria alone".
The most senior Catholic in Victoria, Melbourne Archbishop Denis Hart, previously admitted to the hearing that the Church had been too slow to act on pedophile priests, but insisted things had changed.

A court has heard how one of Australia's most prominent Catholic archbishops, Most Reverend Sir Frank Little (of Melbourne), covered up the crimes of a priest (Father Russell Vears). A parent notified Archbishop Little about the crimes, but the church authorities managed to conceal the crimes from the police until one of the victims contacted the police three decades years later, in 2011.
Sir Frank Little was the archbishop of Melbourne (one of the largest Catholic dioceses in Australia) from 1974 to 1996 (when he was succeeded by Archbishop George Pell).
Father Russell Robert Vears (ordained in 1975) was protected by the Melbourne diocese until the 1980s. He later ceased working in parishes and changed his surname to Walker. However, although he no longer has a parish now, Vears/Walker still has not been officially stripped of his priesthood.

The report recommends:
MAKING it compulsory for church authorities to report church-related crimes to the police;
MAKING it a criminal offence if a person in authority conceals any church sex-crimes;
A CHILD endangerment offence - making it a criminal offence for people in authority to knowingly put a child at risk, or fail to remove them from risk;

THE Napthine government will criminalise the grooming of child-sex victims and the concealing of abuse by officials after the first wide inquiry into the issue savaged the Catholic Church over systemic failures.
Victorian Premier Denis Napthine also promised yesterday to exclude abuse from statute of limitations provisions to ensure victims have enough time to initiate civil legal action.
The Victorian parliament's inquiry into the handling of abuse by religious and other non-government entities made a series of other recommendations yesterday, including the setting up of an independent, alternative avenue for justice for victims.
This would involve the government reviewing the functions of the Victims of Crime Assistance Tribunal to consider its capacity to administer a specific scheme for victims of criminal abuse.
The committee backed a new offence of child endangerment for anyone who relocates an offender -- such as happened with some Catholic clergy -- and offences for failing to report child abuse. This would fall under the government's pledge to legislate against those who conceal sex-abuse crimes.

ENDEMIC criminality and cover-ups warrant strong responses. To that end, the recommendations of the Victorian inquiry into child sex abuse by religious and other organisations should be considered on a national basis by the royal commission into child abuse and by political leaders. The recommendations include lifting the statute of limitations to assist victims, making it an offence to conceal abuse, a statutory body to monitor and audit compliance on child protection requirements, and an independent body to handle victims' claims.
After years of frustration, the Victorian inquiry provided victims with much-needed comfort by hearing and understanding their painful experiences at the hands of clerics and others in positions of trust, especially in the Catholic and Anglican churches and Salvation Army. As one victim said: "Any abuse is dreadful ... but when it happens within the context of the Christian community, it damages your soul ... it attacks your meaning of life."
The behaviour of past church leaders was unconscionable. In 1993, for example, former archbishop Frank Little wrote a letter lauding the services of retired priest Desmond Gannon, when he knew the priest had admitted abusing five or six boys. The worst damage occurred in the decades up to the 1980s, when church responses were condemned as "seriously inadequate and sometimes non-existent". It was for that reason, Cardinal George Pell told the inquiry, he established the Melbourne Response in 1996. It was overseen by independent QC Peter O'Callaghan, an appointment welcomed by police. The inquiry was also scathing about the failure of church leaders in not reporting abuse to police. At that time, however, many victims refused to go to the police.

Victims of child sexual assault across the country have reason to celebrate today.

Not only is it one year since the historic announcement of the national Royal Commission into this issue, but the Victorian Parliamentary Inquiry hands down its report today, and we can finally see a glimmer of hope for justice, better child protection, and an end to our suffering.

The report itself will be available online shortly, but even from the details already available in the media release, and from the speeches to the Victorian Parliament, it is clear we have been listened to and we have been heard.

Equally importantly, the campaign of excuses, misinformation, minimisation and distraction by religious officials has not convinced anyone. For far too long victims have had a second, and at least equally painful, cause of suffering from not only the deliberate neglect of our rights and need for healing by these organisations, but also from the reassuring lies told to present an appearance that nothing is wrong and there is no need for outside action.

We call on all political parties in Victoria to express support for the law reforms proposed by the Committee, which are an absolute minimum requirement if justice is to be done and children are to be protected.

Victorian Government moves swiftly to implement recommendations of abuse inquiry

Victorian Premier Denis Napthine says the Government will immediately begin drafting legislation in response to the Victorian Parliament's inquiry into the handling of child abuse by religious and other organisations.
The report calls for a new law to ensure anyone failing to report serious child abuse or concealing it is guilty of an offence.
The report also recommends the creation of a criminal offence of "grooming" children and a new criminal offence of "endangerment" where figures of authority within institutions can be sanctioned for not taking enough precautions.
The report calls upon the Victorian Government to work with Canberra to require religious and other non-government organisations to incorporate legal structures - something resisted by the Catholic Church.
The Federal Government has six months to respond but Dr Napthine says the Victorian Government will not be waiting.

"I feel very encouraged. The Victorian parliament and the committee have validated all the stories," she said.
"They've recognised the extreme, heinous crimes that were committed against Victorian children in orphanages and children's homes run by the churches and charities, and they've acknowledged that these organisations need to contribute to repairing people's lives.
"The only thing that's missing is the state-run orphanages . . . sadly this inquiry didn't cover those institutions, but at least the royal commission (into child sexual abuse) will cover those."

The report’s criticism of the Catholic church is unsparing. Its recommendations are radical. If adopted they would strip the Catholic church of its virtual immunity in the courts and compel religious leaders of all faiths to report child abuse to the police.

Victims will have a much better chance of claiming compensation for historic child abuse from religious and other organisations if the state inquiry's recommendations are implemented, lawyers say.
After an 18-month inquiry, the parliamentary committee investigating the matter recommended law reforms to remove major barriers that typically prevent victims from successfully suing the Catholic Church and other religious bodies. These include:
* Dismantling the "Ellis defence", which prevents unincorporated religious organisations from being sued.

* Excluding child abuse from the statute of limitations, which bars lawsuits after a certain period.
* Creating an independent "alternative justice avenue" for criminal child-abuse victims.
Lawyer Angela Sdrinis said that as a package, the reforms were "the victims' wish list".

Striking down the silence of sex abuse

The Victorian joint parliamentary committee's report into child sex abuse marks a watershed moment for our community. With an unwavering eye on the rights and needs of victims, the committee has peeled away layers of secrecy imposed by perpetrators of sexual abuse and by the non-government organisations which, for decades, did nothing about it. The committee members should be congratulated. Their report is deeply respectful, insightful and measured while traversing awful and confronting evidence of abuse.
This report should change us and the way our community lives. If, as we urge, the government adopts the proposed reforms, protective measures would be strengthened and victims' avenues for redress improved. For example, anyone who conceals abuse or fails to report it would be criminally liable; an officer of an organisation who puts a child at risk or fails to take reasonable steps to protect a child, knowing there is risk, may be held criminally liable for endangering the child's welfare. There is also a proposal to review the Wrongs Act to make organisations directly liable for criminal acts of abuse by employees.
These are important proposals because they go beyond staff selection procedures (such as compulsory checks on employees who will work with children) and impose an enduring duty on organisations to stay alert to the potential for abuse.
The inquiry has offered a glimpse into the unfathomable hurt wrought on several thousands of people in this state whose lives were damaged by sexual abuse. It has also highlighted the utter disregard some organisations demonstrated for those same victims' rights, in particular the shameful conduct of the Catholic Church. That organisations as rich and powerful as the church ignored victims' complaints, deliberately obfuscated or denied the wrongdoing of criminals in their ranks, almost defies belief today. That the church spends millions of dollars trying to beat down victims' damages claims is simply reprehensible.

Chrissie and Anthony Foster showed the inquiry's committee photographs of their daughter Emma's arms, bloodied by a suicide attempt after she was repeatedly abused by a Catholic priest.
In a matter of hours, they calmly detailed the pain that had helped define their family's lives. Their daughters, Emma and Katie, had been repeatedly raped by Father Kevin O'Donnell. Emma later committed suicide and Katie was left in a wheelchair after an accident.
But when the committee tabled its report, with recommendations to prevent similar crimes against children, there were no words left for the couple.
They went to embrace the MPs Georgie Crozier and David O'Brien as they entered a room filled with victims and victims' advocates. Mrs Foster said the committee had been compassionate to victims, believed their stories and acted.

65 Australians arrested as Canadian police smash 'horrific' child sex abuse ring

Sixty-five Australians are among more than 300 people arrested after Canadian authorities smashed what they say is one of the worst child sex abuse rings they have seen.
Canadian police say their investigation into a multi-million-dollar child sex abuse video website has led to the arrests of nearly 350 people internationally, including teachers, police officers, doctors and priests.
A total of 386 victims of the ring were rescued from harm worldwide, including six in Australia - five in Western Australia, and one in the ACT.
"It is alleged that officers located hundreds of thousands of images detailing horrific acts against young children, some of the worst that they have ever viewed," Toronto police spokeswoman Joanna Beaven-Desjardins said.
Arrests began in August during the Australian-based component of the operation, known as Operation Thunderer, with those charged facing a combined 399 charges of child exploitation offences.
The Australian suspects in the operation are aged between 25 and 72 and have been charged with a range of offences including accessing, possessing, producing and distributing online child exploitation material.
They include a Catholic priest, a former priest and two teachers, all from New South Wales. But Queensland is the state with the largest number of suspects, with 33 people facing charges.

The recent public scrutiny of institutionalised child sexual abuse, he said, would at least give them a degree of normality.

The customers logged in from around the world: Germany. Spain. Mexico. Australia. Hundreds from Canada and the United States. They came from all walks of life; they worked as schoolteachers and newspaper editors, as police officers and doctors.
What they had in common, police allege, was that they paid a Toronto man to provide them with explicit “naturist” videos of children — and, as a result, they are now caught up in what is believed to be the smashing of the largest, most extensive commercial child pornography ring ever uncovered in Canada.
Among law enforcement, the investigation is known as Project Spade.
For nearly a year, a team of Star reporters was granted exclusive behind-the-scenes access to the child exploitation unit of the Toronto Police Service as they brought their three-year investigation to a conclusion.
At the centre of the ring, police allege, is Brian Way: A 42-year-old with a thin goatee and carefully groomed hair, he faces 24 charges of making, possessing, distributing, exporting and selling the explicit images of boys — who range in age from toddlers to teens — in videos that investigators say were edited, packaged and sold from his west-end Toronto warehouse.
They have also laid a charge of instructing a criminal organization, the first time this has been done in relation to a child pornography investigation. It is a charge more usually associated with gangs or organized crime.
“This case has really challenged people to reconsider what nudism and child modelling are,” said Toronto police Detective-Constable Lisa Belanger, who led the investigation. “It’s caused countries around the world to look at this material and ask whether it’s OK for doctors, teachers, daycare providers and hockey coaches to be buying this kind of material. Countries from South Africa to Australia, Isle of Man to Hong Kong and Spain have all said it’s not OK. I think it’s going to have ripple effects everywhere.”

At the centre of the inquiry was a Toronto-based firm that allegedly sold DVDs and streamed videos of naked children.
Azov Films marketed the footage as "naturist" and claimed it was legal in Canada and the US.
The films were distributed in 94 countries, police said.

A Canadian company raked in $4-million from the sale of images of nude Eastern European boys, Toronto police said on Thursday, revealing details of a major international child-pornography investigation that rescued hundreds of victims.
‪The company, Toronto-based Azov Films, sold mail-order DVDs and streamed online videos of naked boys from Germany, Romania and Ukraine, which it marketed as naturist movies and claimed were legal in Canada and the United States.
After three years of investigation, 348 suspects were arrested in dozens of countries around the world, from Australia to Sweden to Mexico.
Sources say the investigation identified 10 to 15 children in Ukraine and Eastern Europe, who modelled for photographers connected with Azov.
‪In addition, police said, as Azov clients were identified around the world, police found other children who were within reach to those customers and were either physically abused or recorded in illicit videos.
At least 386 minors were removed from harm’s way, said Inspector Joanna Beaven-Desjardins, commander of the Toronto police sex crimes unit.

A sweeping child pornography investigation has led to the rescue of 386 children around the world and the arrest of 348 people, Canadian police said Thursday.
Toronto police describe the Project Spade operation as one of the largest child porn busts they've ever seen.
"It is alleged that officers seized hundreds of thousands of videos detailing horrific sexual acts against very young children, some of the worst that they have ever viewed," Inspector Joanna Beaven-Desjardins said.
Police said 108 people were arrested in Canada and 76 in the U.S. Others were arrested in other countries. School teachers, doctors and actors were among those arrested.
Police said the children were "rescued from child exploitation" but did not give more details.
Beaven-Desjardins said the investigation began with a Toronto man accused of running a company since 2005 that distributed child pornography videos.

Father Stephen Shield’s victim, who had hopes of joining the priesthood, said he felt like his soul had been “ripped out” after the sex attacks by the Catholic priest.
Father Shield, who trained in Rome, had denied sexually assaulting the man in the presbytery at English Martyrs Church, Garstang Road, Preston, on two occasions after first meeting him at Castlerigg Manor in Cumbria – where he also abused him.
But today, a jury at Preston Crown Court found him guilty of three charges of indecent assault after a trial.
The offences were committed between 1985 and 1992 when the victim, who cannot be named for legal reasons, was aged 18 and 24.
Shield, 53, of Balmoral Road, Lancaster, became Canon at Lancaster Cathedral before he was arrested and charged with three counts of indecent assault.

Police had a serious reason for being in the Chatham, Ont., home where Ronald Inghelbrecht lived with his mother: officers in Toronto suspected he was a customer of a website that sold child pornography, and the Ontario Provincial Police were there to look for evidence.
“I would describe his room as being adolescent — like he decorated it when he was 12, or 14, and he never changed it,” said OPP Detective David Beckon.
Police seized three computers and thousands of images and movies — and just one video was what the officers in Toronto were looking for. It, they say, tied Inghelbrecht to a website they were investigating as part of Project Spade. He was charged with possession of child pornography and accessing child pornography, and the Chatham-Kent police put out a news release on Dec. 5, 2011.

By all accounts, he was a popular parish priest, a church youth leader and an active Scout organizer.
So when Daniel Moreau, 56, was arrested at his living quarters at a local church last March, there was shock and dismay in the town of Sorel-Tracy, about 100 kilometres northeast of Montreal.
Moreau was charged with seven counts of child pornography, part of a nationwide sweep resulting from Project Spade.
“We understand the distress that such an event can cause within the entire community,” diocese officials said in a statement, and announced Moreau had been relieved of his duties.
Most details of the case are under a publication ban, but defence lawyer Gilles B. Thibault told the Star his client was accused of possessing “an important quantity” of child pornography.
“It is not an isolated act, not a single photo or video — it is more than that,” he said.
Thibault confirmed his client was active in the Scouts in various places around Quebec for a “number of years.”
But, he said, “to date they have not found any victim in the Scout movement.”
Moreau’s case is before the courts.

Why did Bishop George Pell accompany Father Gerald Francis Ridsdale to court on 27 May 1993 when Ridsdale was jailed for child-sex crimes? And why did no bishop, or even a priest, accompany the victims?

Father Ridsdale (with his features obscured by dark glasses and a cap) walked to the Melbourne Magistrates Court with his support person, Bishop Pell (wearing clerical garb).

That evening, Channel Nine's news bulletin showed footage of Father Ridsdale and Bishop Pell arriving at the court. This bulletin was viewed throughout the state of Victoria, including by many church-abuse victims. Viewers noticed that a bishop was accompanying the criminal priest, rather than accompanying the victims.

This publicity alerted other Ridsdale victims, many of whom later rang the newly-established Broken Rites telephone hotline. Broken Rites told these callers the phone number of the Victoria Police child-abuse unit, where they could report Ridsdale's crimes.

As police interviewed more of his victims, Ridsdale was brought back to court in 1994 and 2006 to be given additional time behind bars.

The Australian Royal Commission into Institutional Responses to Child Sexual Abuse will resume hearings tomorrow. It will be the third “case study”, and will focus on Allan Kitchingman (see previous posting) against the background of events at the North Coast Children’s Home (see previous posting).

The commission officials need to heed the comments of victims and their supporters, following the release of the Victorian Parliamentary enquiry, which was released last week (see previous posting). While the officials admit to a steep learning curve in their own interactions with victims, the process of understanding, and appropriate responses for their future investigations, will be enhanced if they take serious note of those victim comments made last week.

Space does not permit a full listing of comments, but more will be covered in other postings where possible. Here are some of the comments on the Victorian report.

Anthony and Chrissie Foster’s daughters, Emma and Katie, were repeatedly raped by their parish priest, Father Kevin O’Donnell, at their primary school in Melbourne’s south-east, from 1987 until 1992.The Catholic Church had received numerous complaints about O’Donnell’s crimes dating back to the 1940s, but no action was ever taken. Emma Foster suicided and her sister Katie was seriously disabled when she was hit by a car, and now requires 24-hour care.

Mr. Foster commented that “There’s mixed feelings, of course, it brings back some sadness with our children. But we feel that this report has the basis for everything that we want. We need to make sure that the Church and other organisations can’t just draw a line today and say ‘we’re forgetting about everything behind and we’re on with the future and yes we’ll toe the line now’. There are some big organisations out there that are going to be trying to protect their wealth, because this has always been about the wealth and reputation of organisations like the Salvation Army, the Catholic Church.”

FATHER Gerald Ridsdale will be remembered as Victoria’s worst sex abuser. His victims number hundreds when the families of those he molested are also counted.
Today, the Herald Sun reveals that his years of paederasty began long before he was ordained as a priest.
He slept with two boys aged 10 and 12 six years before he was ordained. The mother of the boys said Ridsdale was supposed to sleep on a mattress she had made up for him, but she found him in the boys’ bunk bed the following morning.
The Catholic Church knew that Ridsdale had started abusing young children and kept moving him from parish to parish to cover up his crimes. ONE of Australia's worst paedophiles was sent by the Catholic Church to the US for "counselling", rather than reported to police.
Despite knowing in 1975 that priest Gerald Ridsdale had begun abusing children, the church moved him from parish to parish: at least seven in 11 years.
The Catholic Church paid $70,000 for Ridsdale, now 79, to attend a monastery in Jemez Springs, New Mexico.
Another priest and a brother were sent to the same United States monastery.
Fr Paul David Ryan, who served jail in 2006 for molesting two boys in western Victoria, was also sent to the US for counselling. A 1992 attempt to send him to Jemez Springs was rejected.
According to its website, the Servants of the Paraclete offer help to priests and brothers "facing particular challenges in their vocations and lives".

MELBOURNE, Nov 28 – An American Catholic Brother charged with child sex abuse has had some of his bail conditions suspended over Christmas so he can take a beach holiday.
Bernard Joseph Hartman is facing 14 charges of indecently assaulting two boys and two girls aged between six and 16 at St Paul’s College in Altona between 1976 and 1982.
The 73-year-old appeared in the Melbourne Magistrates Court on Thursday where his lawyer requested a change to bail terms requiring he report to a police station every three days so Hartman could go to Apollo Bay with his colleagues.
Hartman is in Australia on a criminal justice visa after he returned from the US to face the abuse accusations.
He had been working in the Archdiocese of Cincinnati in Ohio on clerical duties so he wouldn’t have direct contact with children or teens. Last year a woman made accusations against Hartman during the Victorian parliamentary inquiry into child sex abuse.

What Is The Next Hearing About? (Or: Towards Reeling)

The next hearings of the Australian Royal Commission into Institutional Responses to Child Sexual Abuse will begin on 9th December, in Sydney. More than a year after the announcement of the Royal Commission by former Prime Minister, Julia Gillard, it will finally touch on the Catholic Church.
The recent Victorian Parliamentary enquiry analyzed the system set up by Catholic cardinal, George Pell, to deal with victims of paedophile priests in Melbourne (see previous postings). As Pell was, at the time, Archbishop of Melbourne, he called it the “Melbourne Response”. The Victorian enquiry revealed it as being anti-victim, pro-church and an affront to the dignity of victims.
When Pell went on to be a Cardinal, he set up a national version of the “Melbourne Response”, termed “Towards Healing”, which was no better in terms of outcomes for victims. The main thing about Pell’s programs is that, because it was impossible to sue the Catholic Church, victims were bullied into accepting low compensation and forfeiting their rights against the church.
Both processes were billed by Pell as being “independent”, but because they were funded by the church, operated only for the church. From the Royal Commission’s point of view, the Towards Healing process represents the problems which can arise when there is not a truly independent process. It could lead to such a body in the future, which will finally give victims the help they need and deserve.

In late 2008 a Newcastle woman wrote to a senior Australian Catholic clergyman and sought a meeting. She wanted a personal apology from him. In 1995 the clergyman, who can't be named for legal reasons, had a role in the attempted defrocking of notorious paedophile priest Denis McAlinden. The woman, who attended the NSW Special Commission of Inquiry in Newcastle this year, was eight when McAlinden first sexually abused her during confession.
The senior clergyman replied on November 20, 2008. His heart was ''full of compassion'' for her and she was ''constantly'' in his prayers, he wrote. Learning her story was ''one of the saddest experiences of my life''. He had offered a Mass for her where he ''asked the Lord to give you a deep sense of peace and healing''. But there would be no meeting or apology.
In a separate letter to the Maitland-Newcastle diocese the senior clergyman made that abundantly clear. He had not been impressed by the ''totally inappropriate … hostile and obscene language'' she had used in some emails to him. ''Her anger does not excuse or justify the use of such language in formal communications,'' he wrote. ''Her issues should be directed to Maitland-Newcastle diocese and not to me. I do not propose to meet with her.''
History shows he should have. The woman kept complaining to the Maitland-Newcastle diocese. She wanted her apology from the clergyman. An increasingly frustrated diocese tried a compromise. It couldn't get her an apology, but at least could give her some documents from McAlinden's expansive file.

Former Vic priest admits to child abuse

A FORMER Victorian priest and principal has admitted to sexually assaulting 14 schoolboys, many of whom were sleeping when they were attacked.
Frank Gerard Klep, 70, confessed to sexually assaulting the boys at Salesian College Rupertswood in Sunbury during the 1970s and '80s.
He was the school's principal when he preyed on several of his victims.
Klep, of Burwood, pleaded guilty to 12 counts of indecent assault, plus one count each of rape and attempted buggery, in the Melbourne Magistrates Court on Monday.
It is the third time Klep has either pleaded guilty to or been convicted of abusing schoolboys.

THE national inquiry into how institutions handled allegations of sex abuse against children has referred 54 matters to authorities, including police.
The royal commission, which has been holding public hearings since September, will open a two-week inquiry in Sydney next Monday into the Catholic Church's Towards Healing process adopted by the church to respond internally to sex-abuse allegations.
This will focus on the experiences of four people who came through that system.
They are Queensland residents who were abused by priests and brothers of the Archdiocese of Brisbane, the Catholic diocese of Lismore and Marist Brothers.
The Royal Commission into Institutional Responses to Child Sexual Abuse has so far received 8500 phone calls, 3000 emails and 170,000 visits to their website.
In a statement on Monday it said it has also held more that 917 private sessions. These are continuing across the country.

Dominican Republic: Prosecutors Find Archbishop Sexually Abused Minors

Prosecutors in the Dominican Republic say that that the former apostolic nuncio to that country, Archbishop Jozef Wesolowski, is guilty of molesting at least five boys.
Wesolowski was relieved of his duties and recalled to Rome in August, after Church leaders in the Dominican Republic informed Pope Francis that they had uncovered evidence of sexual abuse by the papal representative. The Vatican turned over the evidence to the Dominican government, and has pledged to cooperate with prosecutors there and indeed, Dominican authorities report that the Vatican and church officials were fully cooperative in their investigation.
The Dominican prosecutors, in turn, report that they have sent the final results of their investigation to the Vatican, including testimony from five young men who say they were molested, and from a deacon who admitted to having relations with the former nuncio. The also say that the archbishop bought and used cocaine.
They will now have to determine if they will charge Wesolowski with child sexual abuse and other crimes.

A Vatican spokesman has said that the it is willing to hand over Wesolowski to civil authorities in the Dominican Republic if requested to do so. However, Wesolowski’s whereabouts have been unknown since the Vatican removed him as apostolic nuncio Aug. 21 after the allegations against him came to light.
