SNAP Update, Australian Royal Commission into Institutional Responses to Child Sexual Abuse is Off to an Impressive Start
A half a billion dollars. That’s how much Australian government officials will spend.
Five years (through 2017). That’s how long they’ll work.
Toward what end? Investigating, exposing – and hopefully preventing – future child sex crimes and cover ups in institutions.
A number of governmental bodies across the globe have done probes somewhat like this one. (Most notable, perhaps, is the work of the United Nations Committee on the Rights of the Child, which found that the Vatican “still places children in many countries at high risk of sexual abuse, as dozens of child sexual offenders are reported to be still in contact with children” and has “policies and practices which have led to the continuation of the abuse by and the impunity of the perpetrators.”)
So what makes this Australian initiative, Royal Commission into Institutional Responses to Child Sexual Abuse, significant and different?
Well, look at the results so far:
–In part, because of pressure generated by the Commission, one Catholic bishop (Bishop Max Davis) has been arrested on charges that he molested a child 45 years ago, before he was even ordained.
–Another Catholic bishop (Bishop Philip Wilson) has been arrested on charges of failing to report child sex crimes by a colleague in the 1970s.
–The Commission has overruled or overridden a number of objections and “privileges” claimed by church officials in the hopes of continuing to keep their secrets secret.
–It is publishing some of the documentation it gets or finds online (though much more remains to be revealed).

Guam - Just when everything started to quiet down regarding allegations made against Archbishop Anthony Apuron of sexual abuse, the topic was once again brought up in the form of a letter.
John Toves, the man who brazenly accused the Archbishop of molesting his cousin back in the 1980s, sent PNC a copy of a letter he received from a law firm. It was signed by Attorney Michelle Neal, retained by Archbishop Apuron, ordering Toves to immediately “cease and desist from making any further defamatory comments or publications against Archbishop Apuron’s reputation and character.”
The letter further states “Your comments and published statements that Archbishop Apuron has engaged in unlawful conduct are patently false, and you have made these comments and published these statements with full knowledge of their falsity.”
However, Toves tells PNC that he’s not backing down and that he maintains his assertions.

MINNEAPOLIS (AP) — Former Twin Cities Archbishop John Nienstedt says he remains "dumbfounded" by allegations of personal misconduct that emerged last year during an internal church investigation.
In written responses, Nienstedt tells the Star Tribune (http://strib.mn/1MiDTyn ) it "pains" him that his reputation has been "put into question by allegations that are entirely false and based wholly on rumor, hearsay, or innuendo."
The Archdiocese of St. Paul and Minneapolis commissioned the investigation. The Star Tribune reports the probe looked into claims that Nienstedt had engaged in behavior that was inappropriate for a priest.
Nienstedt resigned last month after prosecutors filed charges against the archdiocese for failing to protect children from a priest later convicted of molesting two boys.

There is a longer story today in the Minneapolis Tribune about what is the latest in the Nienstedt Case. Looking at it, there clearly is a lot of issues up in the air. What struck me was the end of the article:
What the archdiocese decides to do with the investigation is being monitored by Twin Cities Catholics as well as national Catholic authorities, who say the St. Paul situation is extremely rare.
Facing scores of priest abuse claims, bankruptcy, civil and criminal charges — and the Nienstedt investigation controversy — the archdiocese is in uncharted terrain.
“I rarely say anything is unique in the Catholic Church, but this is a pretty unique situation,” said the Rev. Thomas Reese, senior analyst for National Catholic Reporter.
I got to ask: What is unique?
There are scores of abuse cases across the world. Thanks to the Child Victims Act survivors in Minnesota can do something about them.
The Archdiocese of St. Paul and Minneapolis is one of a number of diocese that have or are using the bankruptcy courts to limit their liability.
Civil claims have for the most part been the only way that survivors have been able to force the Church to do anything.

It’s time for Pope Francis to confess.
His Holiness has said he wants to bring a new era of openness and light to the Roman Catholic Church.
Good for him.
He can start by at last throwing open the Vatican’s secret records about its shady dealings with Hitler, Mussolini and their allies before, during and after World War II.
What did the Vatican know about the Holocaust and other atrocities taking place? How much did it cover up? And, most of all, how much did it profit from them?
Those issues have been given new life by the publication of Gerald Posner’s new book, “God’s Bankers: A History of Money and Power at the Vatican,” which details for the first time all that we do know about the financial shenanigans in the Holy See from that time. But it is tantalizing how much remains buried in the Vatican’s so-called “Secret Archive,” hidden from prying eyes.
These are not private or confidential Roman Catholic Church matters that have no business being aired in public. These relate directly to the church’s conduct during and after the war — as a moral authority in the world, a sovereign state, an investor and as an offshore bank.
Here are the questions that Posner’s book raises and which the pope should answer if he seriously wants to be considered “the People’s Pope.”

“A measure calling for the statue of Father Junipero Serra in the U.S. Capitol to be replaced with one of NASA astronaut Sally Ride, the first American woman in space, was shelved in the Legislature on July 2. [Ride] would be the first woman to represent California in the collection and the first known gay person.” State legislatures have the authority to decide which two statues will represent their state at the U.S. Capitol.
The measure to replace Serra’s statue had already passed the California Senate in April. The Assembly vote was postponed because of the pope’s visit to the U.S. “Our concerns are mostly due to the timing of this legislative debate,” Sandra Palacios, associate director of governmental affairs at the California Catholic Conference, said at an Assembly committee hearing this week.” The U.S. bishops’ paid lobbyists in every state are called “Catholic Conferences.”
Pope Francis called Serra “one of the founding fathers of the United States, a saintly example of the Church’s universality, and special patron of the Hispanic people of the country.” The pope will canonize Serra in September in Washington D.C. The 18th century Spanish Franciscan friar founded the first nine of 21 Spanish missions in California. In a rare display of criticism for this pope, Native Americans and others protested honoring a man who participated in the brutalization of indigenous people. “By 1818 the percentage of Indians who died in the missions reached 86 percent. Over 81,000 Indian ‘converts’ eventually managed to successfully flee the missions.”
The postponement followed “a heavy campaign to save the statue. A Spanish-language website, ‘Salvemos a Serra’, or ‘Let’s Save Serra’, called on Californians to write their legislators in opposition to the resolution. … ‘Salvemos a Serra’ had also asked supporters of Blessed Serra to sign English- and Spanish-language petitions on the website CitizenGo.org. The petitions were posted by Alejandro Bermudez, executive director of Catholic News Agency. More than 47,000 did so.”
Within five days, the Catholic Church “notched [another] prominent win at the California statehouse.” The July 7 decision by a legislative committee to shelve a bill allowing terminally ill patients to legally end their lives “followed weeks of lobbying by competing interest groups over whether to make California the next state to allow physicians to legally prescribe fatal medication, following Oregon, Washington, Montana and Vermont.” “A new poll released by Compassion and Choices, the chief right-to-die advocacy group, suggests that 69 percent of Californians would vote for the bill if put in front of them.”

Catholic Archbishop Jerome Listecki on Tuesday asked the U.S. Supreme Court to weigh in on a key issue of the Archdiocese of Milwaukee's bankruptcy: whether the First Amendment and a federal law aimed at protecting religious liberty can be used to shield an estimated $70 million held in trust for the care of its cemeteries.
Lawyers for Listecki, who serves as sole trustee of the fund, filed a writ of certiorari asking the high court to review a March ruling by the 7th Circuit Court of Appeals.
In that decision, a three-judge panel ruled that neither the First Amendment nor the 1993 Religious Freedom Restoration Act could be used to keep the funds out of the bankruptcy estate, where they would be used in part to fund a settlement with sex abuse victims.
The writ filed Tuesday argues that the 7th Circuit ruling is at odds with decisions in at least three other federal courts around the country.
Timothy Nixon, the attorney who represents the trust, said a Supreme Court review is needed to resolve those so-called circuit splits and to restore protections intended by the framers of the Constitution and by Congress.
"The 7th Circuit decision encroaches on religious freedom and curtails the protections in the First Amendment," Nixon said in a statement provided to the Journal Sentinel. "Our request is that the Supreme Court agree to review this case so that the substantial protections that are being threatened can be protected."
Marci Hamilton, the First Amendment scholar representing the creditors committee, called their arguments "slim pickings for a certiorari brief," and she said it was unlikely the Supreme Court would take the case so soon after last year's Hobby Lobby decision, which also turned on the Religious Freedom Restoration Act.

MILWAUKEE — The Archdiocese of Milwaukee asked the U.S. Supreme Court on Tuesday to weigh in on whether an estimated $70 million held in trust for the care of its cemeteries is off-limits in the archdiocese's bankruptcy case.
Archbishop Jerome Listecki, who serves as sole trustee of the fund, asked the court to review a March ruling by the 7th U.S. Circuit Court of Appeals in Chicago. The appeals court said the federal Religious Freedom Restoration Act, which protects religious organizations from government interference, doesn't protect the money because creditors seeking a share of the fund aren't the government.
But the archdiocese, which filed for Chapter 11 bankruptcy protection in 2011 to address its sex abuse lawsuit liabilities, argues the ruling is at odds with decisions in at least three other federal courts, the Milwaukee Journal Sentinel (http://bit.ly/1KLZj6H ) reported.
Attorney Timothy Nixon, who represents the trust, said a Supreme Court review is needed to resolve those so-called circuit splits, and to restore religious protections.

MILWAUKEE — In March, an appeals court ruled a $55 million cemetery trust fund is fair game in the Archdiocese of Milwaukee’s bankruptcy case, and now, the Archdiocese of Milwaukee’s “Cemetery Perpetual Care Trust” has filed a petition with the U.S. Supreme Court — asking that they review the appeals court decision relating to the Religious Freedom Restoration Act.
The 7th U.S. Circuit Court of Appeals in Chicago in May that the fund created by New York Cardinal Timothy Dolan when he was archbishop of Milwaukee is not covered by the federal law that protects religious organizations from government interference.
Attorneys for clergy sexual abuse victims say Dolan created the fund to hide money from their clients. The archdiocese filed for bankruptcy in 2011.
Hundreds of victims have since filed claims against the archdiocese.
Timothy Nixon, an attorney representing the Archdiocese of Milwaukee Cemetery Perpetual Care Trust issued the following statement:
“There are compelling reasons for the U.S. Supreme Court to take up this critical case. The Seventh Circuit decision encroaches on religious freedom and curtails the protections in the First Amendment for the free expression of religion. The Seventh Circuit decision also is directly at odds with previous decisions rendered by at least three other Federal appeals courts in different parts of the country. Indeed, the Seventh Circuit expressly acknowledged in its ruling that its decision creates a split with another Federal Court which reached precisely an opposite conclusion. Further, the Seventh Circuit also accepted that the decision places a significant burden on the free expression of religion.
The Supreme Court’s intervention is urgently needed to protect the religious freedoms the Seventh Circuit decision threatens and to restore the free exercise of religion protections the decision rolls back.
At the same time, the country now has different federal courts offering conflicting opinions on these important Constitutional questions. Only the U.S. Supreme Court can clear up a deepening split on this important First Amendment issue and the free exercise of religious beliefs. ...
SNAP, the Survivors Network for Those Abused by Priests has issued this statement:
“Making good on their verbal threat in open court to “spend down” the remaining money left in their estate to prevent 575 victims of rape, sexual assault and abuse by clergy of the Archdiocese of Milwaukee from receiving restitution, lawyers for Milwaukee Archbishop Jerome Listecki have filed an appeal to the US Supreme Court to overturn a Federal 7th Circuit’s decisive ruling that a fraudulent “Cemetery Trust” created by former Archbishop Timothy Dolan, now Cardinal of New York, was not “protected” by federal religious laws or the first amendment and can be used to compensate survivors.
A few weeks ago the archdiocese had already started carrying out its threat by randomly deposing and, of course, re-traumatizing victims, putting survivors through hours of questioning by church lawyers fishing for reasons to file yet more pointless briefs and run up expensive bills. So far, lawyers’ fees and court costs are soaring near $20 million dollars while Listecki has begrudgingly offered $4 million dollars, total, for all rape victims, less than $7,000 dollars per survivor.
In today’s filing, Listecki again legally howls the discredited excuses of “religious freedom” and “first amendment rights”. Clearly these rights are not enshrined in our constitution for bishops, or anyone else, to cover up sex crimes, as if child rape is no one’s business but their own. What matters is not winning the brief (they won’t). What matters is that it will be expensive, create more delays, and pile up legal fees so there is no money left for survivors. You might as well move the Sunday collection plate over to the lawyers’ offices or, perhaps, the country club. The later location might be easier since, as Listecki wrote in a recent column in the Catholic paper, he will be getting in as much golf in as he can this summer. In the meantime, hundreds of victims are languishing through years of bankruptcy without help, much less justice.

A 64-year-old man in eastern France is suing the Vatican, claiming that abuse by a Catholic priest when he was a child turned him into a paedophile.
The man alleges that his boarding school chaplain began abusing him when he was 12, with the sexual assaults continuing for several years.
Recently, the victim was himself convicted of sexually assaulting a 15-year-old girl. He claims that the abuse he suffered caused him to become a paedophile.
He is demanding that the 82-year-old priest who abused him, who cannot be jailed due to the statute of limitations despite confessing to the crime, be punished for his deeds.
The priest, a former chaplain in Bourg-en-Bresse, Ain, was ordered to pay €1 in damages to his victim.

New York, was not “protected” by federal religious laws or the first amendment
and can be used to compensate survivors.

SNAP Update, Australian Royal Commission into Institutional Responses to Child Sexual Abuse is Off to an Impressive Start
A half a billion dollars. That’s how much Australian government officials will spend.
Five years (through 2017). That’s how long they’ll work.
Toward what end? Investigating, exposing – and hopefully preventing – future child sex crimes and cover ups in institutions.
A number of governmental bodies across the globe have done probes somewhat like this one. (Most notable, perhaps, is the work of the United Nations Committee on the Rights of the Child, which found that the Vatican “still places children in many countries at high risk of sexual abuse, as dozens of child sexual offenders are reported to be still in contact with children” and has “policies and practices which have led to the continuation of the abuse by and the impunity of the perpetrators.”)
So what makes this Australian initiative, Royal Commission into Institutional Responses to Child Sexual Abuse, significant and different?
Well, look at the results so far:
–In part, because of pressure generated by the Commission, one Catholic bishop (Bishop Max Davis) has been arrested on charges that he molested a child 45 years ago, before he was even ordained.
–Another Catholic bishop (Bishop Philip Wilson) has been arrested on charges of failing to report child sex crimes by a colleague in the 1970s.
–The Commission has overruled or overridden a number of objections and “privileges” claimed by church officials in the hopes of continuing to keep their secrets secret.
–It is publishing some of the documentation it gets or finds online (though much more remains to be revealed).

attorneys representing the sisters contended that the archdiocese never
sought to established legal control over the order's nonprofit
institute until June, when it installed officers to oversee the institute.
That move, however, was illegal and a “hostile
takeover” by the bishop of the order of nuns, the attorneys wrote.
The newly
appointed officers have no standing under state law to claim legal
authority over the institute and its assets, the attorneys argued.
The
sisters say they were first informed in September 2014 that the archbishop
planned on selling the property to a woman called Katherine Hudson. The nuns
later learned that Hudson was better known as the pop sensation Katy Perry.
After
learning more about the singer and her “public image,” the sisters
objected to selling Perry the property “for what should be obvious reasons
coming from Catholic nuns,” the attorneys wrote.
They
decided to sell to Hollister, a transaction they said would yield more
money and help provide for the care of the sisters in their retirement.

Last month, prosecutors dropped child sex abuse charges against a twice-accused archdiocesan priest with close ties to St. Louis’ top Catholic official. They said, however, that they hope to re-file the case.
In an unprecedented move, the
priest, Fr. Xiu Hui “Joseph” Jiang, is suing the alleged victim’s parents,
SNAP, two police officers and the city of St. Louis claiming he’s the victim of
a conspiracy to slander him and violate his religious freedom because he’s
Chinese and Catholic.
Today, attorneys for SNAP are
disclosing the first formal response to what they call Fr. Jiang’s “bizarre”
suit. In it, they charge that Archbishop Robert Carlson is behind Fr. Jiang’s
lawsuit, which is the first time in Missouri history (as best SNAP can tell)
that a Catholic official sued a victim’s parents. (A similar suit filed by a
California priest against SNAP resulted in an award of $120,000 for SNAP and
against the cleric.)
SNAP also charges that Fr. Jiang’s
legal move is a “SLAPP,” a Strategic Lawsuit Against Public Participation,
designed to scare and discourage victims, witnesses and whistleblowers into
staying silent.
Even though a civil child sex
abuse case against the priest is pending, church staff have hinted that the
suspended cleric may be put back to work in a parish. SNAP opposes that
potential move and wants church staff to take the priest’s passport to prevent
him from fleeing the US.
Despite an official national
church policy mandating “openness” in pedophile priest cases, Archbishop
Carlson refuses to reveal where Fr. Jiang is living, why he had a bedroom in
Carlson’s home and why Fr. Jiang followed Carlson from city to city (a highly
unusual arrangement in the Catholic church). Carlson also refuses to address an
allegation that Fr. Jiang admitted to a Lincoln County girl’s parents that he’d
molested their daughter and that Carlson tried to get the parents to return a
$20,000 check that the priest reportedly left on their car windshield. SNAP
wants Carlson to honor his pledges to be “transparent” and publicly disclose
this information.
In June 2012, Fr. Jiang was
arrested in for repeatedly molesting the Lincoln County girl numerous times
(mostly in her home). He was charged with alleged child sex crimes and “victim
tampering.” In November 2013, those charges were dismissed. In April 2014, he
was arrested on charges of repeatedly molesting a St. Louis city boy between
2011-2012 (at a Catholic school). According to the suit, Carlson was
“supervising Fr. Jiang very closely,” “knew that (he) was a danger to children”
and abused the girl while “living in the archbishop’s home.”

John Toves has previously accused Archbishop Anthony Apuron of molesting his cousin back in the 1980s.
Guam - Just when everything started to quiet down regarding allegations made against Archbishop Anthony Apuron of sexual abuse, the topic was once again brought up in the form of a letter.
John Toves, the man who brazenly accused the Archbishop of molesting his cousin back in the 1980s, sent PNC a copy of a letter he received from a law firm. It was signed by Attorney Michelle Neal, retained by Archbishop Apuron, ordering Toves to immediately “cease and desist from making any further defamatory comments or publications against Archbishop Apuron’s reputation and character.”
The letter further states “Your comments and published statements that Archbishop Apuron has engaged in unlawful conduct are patently false, and you have made these comments and published these statements with full knowledge of their falsity.”
However, Toves tells PNC that he’s not backing down and that he maintains his assertions.

Ex-Twin Cities archbishop denies
allegations in affidavits

MINNEAPOLIS (AP) — Former Twin Cities Archbishop John Nienstedt says he remains "dumbfounded" by allegations of personal misconduct that emerged last year during an internal church investigation.
In written responses, Nienstedt tells the Star Tribune (http://strib.mn/1MiDTyn ) it "pains" him that his reputation has been "put into question by allegations that are entirely false and based wholly on rumor, hearsay, or innuendo."
The Archdiocese of St. Paul and Minneapolis commissioned the investigation. The Star Tribune reports the probe looked into claims that Nienstedt had engaged in behavior that was inappropriate for a priest.
Nienstedt resigned last month after prosecutors filed charges against the archdiocese for failing to protect children from a priest later convicted of molesting two boys.

There is a longer story today in the Minneapolis Tribune about what is the latest in the Nienstedt Case. Looking at it, there clearly is a lot of issues up in the air. What struck me was the end of the article:
What the archdiocese decides to do with the investigation is being monitored by Twin Cities Catholics as well as national Catholic authorities, who say the St. Paul situation is extremely rare.
Facing scores of priest abuse claims, bankruptcy, civil and criminal charges — and the Nienstedt investigation controversy — the archdiocese is in uncharted terrain.
“I rarely say anything is unique in the Catholic Church, but this is a pretty unique situation,” said the Rev. Thomas Reese, senior analyst for National Catholic Reporter.
I got to ask: What is unique?
There are scores of abuse cases across the world. Thanks to the Child Victims Act survivors in Minnesota can do something about them.
The Archdiocese of St. Paul and Minneapolis is one of a number of diocese that have or are using the bankruptcy courts to limit their liability.
Civil claims have for the most part been the only way that survivors have been able to force the Church to do anything.

It’s time for Pope Francis to confess.
His Holiness has said he wants to bring a new era of openness and light to the Roman Catholic Church.
Good for him.
He can start by at last throwing open the Vatican’s secret records about its shady dealings with Hitler, Mussolini and their allies before, during and after World War II.
What did the Vatican know about the Holocaust and other atrocities taking place? How much did it cover up? And, most of all, how much did it profit from them?
Those issues have been given new life by the publication of Gerald Posner’s new book, “God’s Bankers: A History of Money and Power at the Vatican,” which details for the first time all that we do know about the financial shenanigans in the Holy See from that time. But it is tantalizing how much remains buried in the Vatican’s so-called “Secret Archive,” hidden from prying eyes.
These are not private or confidential Roman Catholic Church matters that have no business being aired in public. These relate directly to the church’s conduct during and after the war — as a moral authority in the world, a sovereign state, an investor and as an offshore bank.
Here are the questions that Posner’s book raises and which the pope should answer if he seriously wants to be considered “the People’s Pope.”

“A measure calling for the statue of Father Junipero Serra in the U.S. Capitol to be replaced with one of NASA astronaut Sally Ride, the first American woman in space, was shelved in the Legislature on July 2. [Ride] would be the first woman to represent California in the collection and the first known gay person.” State legislatures have the authority to decide which two statues will represent their state at the U.S. Capitol.
The measure to replace Serra’s statue had already passed the California Senate in April. The Assembly vote was postponed because of the pope’s visit to the U.S. “Our concerns are mostly due to the timing of this legislative debate,” Sandra Palacios, associate director of governmental affairs at the California Catholic Conference, said at an Assembly committee hearing this week.” The U.S. bishops’ paid lobbyists in every state are called “Catholic Conferences.”
Pope Francis called Serra “one of the founding fathers of the United States, a saintly example of the Church’s universality, and special patron of the Hispanic people of the country.” The pope will canonize Serra in September in Washington D.C. The 18th century Spanish Franciscan friar founded the first nine of 21 Spanish missions in California. In a rare display of criticism for this pope, Native Americans and others protested honoring a man who participated in the brutalization of indigenous people. “By 1818 the percentage of Indians who died in the missions reached 86 percent. Over 81,000 Indian ‘converts’ eventually managed to successfully flee the missions.”
The postponement followed “a heavy campaign to save the statue. A Spanish-language website, ‘Salvemos a Serra’, or ‘Let’s Save Serra’, called on Californians to write their legislators in opposition to the resolution. … ‘Salvemos a Serra’ had also asked supporters of Blessed Serra to sign English- and Spanish-language petitions on the website CitizenGo.org. The petitions were posted by Alejandro Bermudez, executive director of Catholic News Agency. More than 47,000 did so.”
Within five days, the Catholic Church “notched [another] prominent win at the California statehouse.” The July 7 decision by a legislative committee to shelve a bill allowing terminally ill patients to legally end their lives “followed weeks of lobbying by competing interest groups over whether to make California the next state to allow physicians to legally prescribe fatal medication, following Oregon, Washington, Montana and Vermont.” “A new poll released by Compassion and Choices, the chief right-to-die advocacy group, suggests that 69 percent of Californians would vote for the bill if put in front of them.”

Making good on their verbal threat in open court to
“spend down” the remaining money left in their estate to prevent 575 victims of
rape, sexual assault and abuse by clergy of the Archdiocese of Milwaukee from
receiving restitution, lawyers for
Milwaukee Archbishop Jerome Listecki have filed an appeal to the U.S.
Supreme Court. They
seek to overturn a U.S. 7th Circuit decisive ruling that a fraudulent “cemetery
trust” created by former Archbishop Timothy Dolan, now cardinal of New York,
was not “protected” by federal religious laws or the First Amendment and can be
used to compensate survivors.
A few
weeks ago, the archdiocese started carrying out its threat by randomly deposing
and, of course, re-traumatizing victims, putting survivors through hours of
questioning by church lawyers fishing for reasons to file yet more pointless
briefs and run up expensive bills. So far, lawyers’ fees and court
costs are soaring near $20 million dollars while Listecki has begrudgingly
offered $4 million, total, for all rape victims, less than $7,000 per survivor.
In the
latest filing, Listecki again legally howls the discredited excuses of
“religious freedom” and “First Amendment rights.” Clearly these rights are not
enshrined in our Constitution for bishops, or anyone else, to cover up sex
crimes, as if child rape is no one’s business but their own.

— Dozens of parishes in the Twin Cities want the Archdiocese of St. Paul and
Minneapolis to pay their costs for settling clergy abuse claims.
About 120
parishes want the archdiocese to reimburse them for paying too much into church
insurance plans. They also want compensation for costs to resolve sex abuse
claims against priests the archdiocese assigned to parishes.
Creditors
are required to file their claims against the archdiocese by Aug. 3 in the
bankruptcy case. Minnesota Public Radio News (http://bit.ly/1gDlfUR ) reports
the parish filings have not place a monetary value on claims. More than 160
people alleging sex abuse by clergy members have filed claims against the
archdiocese.

cover their costs in settling clergy sex abuse claims.
Some 120
parishes are filing creditor claims against the archdiocese.
The
parishes want the archdiocese to reimburse the over-payments they made to church
insurance plans. They also are seeking compensation for costs related to
resolving sex-abuse claims against clergy the archdiocese assigned to parishes.
All
creditors are required to file claims by Aug. 3 in the bankruptcy proceedings
to protect their interests, said attorney Mary Jo Jensen-Carter, who represents
the parishes.
"To
the extent that the parishes have been subjected to clergy-abuse, claims ...
we're also seeking indemnification and contributions from the archdiocese for
the damage the parishes have suffered, or may suffer," Jensen-Carter said.

Catholic Archbishop Jerome Listecki on Tuesday asked the U.S. Supreme Court to weigh in on a key issue of the Archdiocese of Milwaukee's bankruptcy: whether the First Amendment and a federal law aimed at protecting religious liberty can be used to shield an estimated $70 million held in trust for the care of its cemeteries.
Lawyers for Listecki, who serves as sole trustee of the fund, filed a writ of certiorari asking the high court to review a March ruling by the 7th Circuit Court of Appeals.
In that decision, a three-judge panel ruled that neither the First Amendment nor the 1993 Religious Freedom Restoration Act could be used to keep the funds out of the bankruptcy estate, where they would be used in part to fund a settlement with sex abuse victims.
The writ filed Tuesday argues that the 7th Circuit ruling is at odds with decisions in at least three other federal courts around the country.
Timothy Nixon, the attorney who represents the trust, said a Supreme Court review is needed to resolve those so-called circuit splits and to restore protections intended by the framers of the Constitution and by Congress.
"The 7th Circuit decision encroaches on religious freedom and curtails the protections in the First Amendment," Nixon said in a statement provided to the Journal Sentinel. "Our request is that the Supreme Court agree to review this case so that the substantial protections that are being threatened can be protected."
Marci Hamilton, the First Amendment scholar representing the creditors committee, called their arguments "slim pickings for a certiorari brief," and she said it was unlikely the Supreme Court would take the case so soon after last year's Hobby Lobby decision, which also turned on the Religious Freedom Restoration Act.

MILWAUKEE — The Archdiocese of Milwaukee asked the U.S. Supreme Court on Tuesday to weigh in on whether an estimated $70 million held in trust for the care of its cemeteries is off-limits in the archdiocese's bankruptcy case.
Archbishop Jerome Listecki, who serves as sole trustee of the fund, asked the court to review a March ruling by the 7th U.S. Circuit Court of Appeals in Chicago. The appeals court said the federal Religious Freedom Restoration Act, which protects religious organizations from government interference, doesn't protect the money because creditors seeking a share of the fund aren't the government.
But the archdiocese, which filed for Chapter 11 bankruptcy protection in 2011 to address its sex abuse lawsuit liabilities, argues the ruling is at odds with decisions in at least three other federal courts, the Milwaukee Journal Sentinel (http://bit.ly/1KLZj6H ) reported.
Attorney Timothy Nixon, who represents the trust, said a Supreme Court review is needed to resolve those so-called circuit splits, and to restore religious protections.

MILWAUKEE — In March, an appeals court ruled a $55 million cemetery trust fund is fair game in the Archdiocese of Milwaukee’s bankruptcy case, and now, the Archdiocese of Milwaukee’s “Cemetery Perpetual Care Trust” has filed a petition with the U.S. Supreme Court — asking that they review the appeals court decision relating to the Religious Freedom Restoration Act.
The 7th U.S. Circuit Court of Appeals in Chicago in May that the fund created by New York Cardinal Timothy Dolan when he was archbishop of Milwaukee is not covered by the federal law that protects religious organizations from government interference.
Attorneys for clergy sexual abuse victims say Dolan created the fund to hide money from their clients. The archdiocese filed for bankruptcy in 2011.
Hundreds of victims have since filed claims against the archdiocese.
Timothy Nixon, an attorney representing the Archdiocese of Milwaukee Cemetery Perpetual Care Trust issued the following statement:
“There are compelling reasons for the U.S. Supreme Court to take up this critical case. The Seventh Circuit decision encroaches on religious freedom and curtails the protections in the First Amendment for the free expression of religion. The Seventh Circuit decision also is directly at odds with previous decisions rendered by at least three other Federal appeals courts in different parts of the country. Indeed, the Seventh Circuit expressly acknowledged in its ruling that its decision creates a split with another Federal Court which reached precisely an opposite conclusion. Further, the Seventh Circuit also accepted that the decision places a significant burden on the free expression of religion.
The Supreme Court’s intervention is urgently needed to protect the religious freedoms the Seventh Circuit decision threatens and to restore the free exercise of religion protections the decision rolls back.
At the same time, the country now has different federal courts offering conflicting opinions on these important Constitutional questions. Only the U.S. Supreme Court can clear up a deepening split on this important First Amendment issue and the free exercise of religious beliefs. ...

The later location might be easier since, as Listecki wrote in a recent column in the Catholic paper, he will be getting in as much golf in as he can this summer. In the meantime, hundreds of victims are languishing through years of bankruptcy without help, much less justice.

France: Man sues Vatican
claiming priest abuse 'made him into paedophile'

A 64-year-old man in eastern France is suing the Vatican, claiming that abuse by a Catholic priest when he was a child turned him into a paedophile.
The man alleges that his boarding school chaplain began abusing him when he was 12, with the sexual assaults continuing for several years.
Recently, the victim was himself convicted of sexually assaulting a 15-year-old girl. He claims that the abuse he suffered caused him to become a paedophile.
He is demanding that the 82-year-old priest who abused him, who cannot be jailed due to the statute of limitations despite confessing to the crime, be punished for his deeds.
The priest, a former chaplain in Bourg-en-Bresse, Ain, was ordered to pay €1 in damages to his victim.

ever more distant from each other: the Francis of the media and the real one.
The first
is exceedingly well-known and has been making the news since his first
appearance on the loggia of the basilica of Saint Peter’s.
It is the
narrative of the pope who revolutionizes the Church, who lays down the keys of
binding and loosing, who does not condemn but only forgives, or rather who does
not even judge any more, who washes the feet of the female Muslim inmate and
the transexual, who abandons the palace to plunge into the peripheries, who
opens the workshop on everything, on the divorced and remarried as on the
Vatican’s finances, who closes the checkpoints of dogma and throws open the
doors of mercy. A pope who is a friend of the world, who is already being
praised for his upcoming encyclical on “sustainable development” even before
seeing what will be written there.
In effect
there is a great deal, in the words and actions of Jorge Mario Bergoglio, that
lends itself to this narrative.
The
Francis of the media is also to some extent a creation of his own, and
brilliantly so, in the span of one morning miraculously overturning the image of the Catholic Church from
opulent and decadent to “poor and for the poor.”

US Wars in Afghanistan, Iraq to Cost $6 trillion

The decade-long American wars in Afghanistan and Iraq would end up costing as much as $6 trillion, the equivalent of $75,000 for every American household, calculates the prestigious Harvard University’s Kennedy School of Government.
Remember, when President George Bush’s National Economic Council Director, Lawrence Lindsey, had told the country’s largest newspaper “The Wall Street Journal” that the war would cost between $100 billion and $200 billion, he had found himself under intense fire from his colleagues in the administration who claimed that this was a gross overestimation.
Consequently, Lawrence Lindsey was forced to resign. It is also imperative to recall that the Bush administration had claimed at the very outset that the Iraq war would finance itself out of Iraqi oil revenues, but Washington DC had instead ended up borrowing some $2 trillion to finance the two wars, the bulk of it from foreign lenders.
According to the Harvard University’s Kennedy School of Government 2013 report, this accounted for roughly 20 per cent of the total amount added to the US national debt between 2001 and 2012.
According to the report, the US “has already paid $260 billion in interest on the war debt,” and future interest payments would amount to trillions of dollars. This Harvard University report has also been carried on its website by the Centre for Research on Globalisation, which is a widely-quoted Montreal-based independent research and media organisation.
In its report under review, the 377-year old Harvard University has viewed that these afore-mentioned wars had not only left the United States heavily indebted, but would also have a profound impact on the federal government’s fiscal and budgetary crises over a protracted period.
The report has attributed the largest share of the trillions of dollars in continuing costs to care and compensation for hundreds of thousands of troops left physically and psychologically damaged by the two wars being discussed here.
The report states: “The Iraq and Afghanistan conflicts, taken together, will be the most expensive wars in US history—totaling somewhere between $4 trillion and $6 trillion. This includes long-term medical care and disability compensation for service members, veterans and families, military replenishment and social and economic costs. The largest portion of that bill is yet to be paid.”
It asserts: “Another major share of the long-term costs of the wars comes from paying off trillions of dollars in debt incurred as the US government failed to include their cost in annual budgets and simultaneously implemented sweeping tax cuts for the rich. In addition, huge expenditures are being made to replace military equipment used in the two wars. The report also cites improvements in military pay and benefits made in 2004 to counter declining recruitment rates as casualties rose in the Iraq war.”
The authors of this report have warned that the legacy of decisions taken during the Iraq and Afghanistan wars would dominate future federal budgets for decades to come.
According to the Harvard University report, some 1.56 million US troops—56 per cent of all Afghanistan and Iraq veterans—were receiving medical treatment at Veterans Administration facilities and would be granted benefits for the rest of their lives.
It reveals:
“One out of every two veterans from Iraq and Afghanistan has already applied for permanent disability benefits. The official figure of 50,000 American troops “wounded in action” vastly underestimates the real human costs of the two US wars. One-third of returning veterans are being diagnosed with mental health issues—suffering from anxiety, depression, and/or post-traumatic stress disorder (PTSD).”
The report notes that in addition, over a quarter of a million troops have suffered traumatic brain injuries (TBI), which, in many cases, were combined with PTSD, posing greater problems in treatment and recovery.
“Constituting a particularly grim facet of this mental health crisis is the doubling of the suicide rate for US Army personnel, with many who attempted suicide suffering serious injuries,” opine the report authors.
It maintains:
“Overall, the Veterans Administration’s budget has more than doubled over the past decade, from $61.4 billion in 2001 to $140.3 billion in 2013. As a share of the total US budget it has grown from 2.5 percent to 3.5 percent over the same period. Soaring medical costs for veterans is attributable to several factors. Among them is that, thanks to advancements in medical technology and rapid treatment, soldiers in Iraq and Afghanistan have survived wounds that would have cost their lives in earlier conflicts.”
The Harvard University’s Kennedy School of Government report has estimated: “While the US government has already spent $134 billion on medical care and disability benefits for Iraq and Afghanistan veterans, this figure will climb by an additional $836 billion over the coming decades.”
It notes that the largest expenditures on health care for World War II veterans took place in the 1980s, roughly four decades after the war, and that spending on medical care and disability payments for Vietnam War veterans was still on the rise.
Here follows the description:
“The most common medical problems suffered by troops returning from the two wars include: diseases of the musculoskeletal system (principally joint and back disorders); mental health disorders; central nervous system and endocrine system disorders; as well as respiratory, digestive, skin and hearing disorders. Overall, some 29 per cent of these troops have been diagnosed with PTSD.”
The report goes on to argue:
“Among the most severely wounded are 6,476 soldiers and Marines who have suffered “severe penetrating brain injury,” and another 1,715 who have had one or more limbs amputated. Over 30,000 veterans are listed as suffering 100 percent service-related disabilities, while another 145,000 are listed as 70 to 90 percent disabled.”
It reads:
“The worst of these casualties have taken place under the Obama administration as a result of the so-called surge that the Democratic president ordered in Afghanistan.”
It mentions that the Walter Reed Medical Centre, US Army’s flagship hospital at Washington DC, was treating hundreds of recent amputees and severe casualties, adding that this facility had received 100 amputees for treatment during 2010; 170 amputees in 2011; and 107 amputees in 2012.
The report has also stated that the US Marines have suffered an especially high toll.
The report points out:
“Massive direct spending on the two imperialist interventions continues. With over 60,000 US troops remain in Afghanistan, it is estimated that the cost of deploying one American soldier for one year in this war amounts to $1 million. These troops continue suffering casualties—including in so-called “green on blue” attacks by Afghan security forces on their ostensible allies. As they are brought home, they will further drive up the costs of medical care and disability compensation. The US is maintaining a vast diplomatic presence in Iraq, including at least 10,000 private contractors providing support in security, IT, logistics, engineering and other occupations; as well as logistics support and payments for leased facilities in Kuwait.”
In its conclusion, the report not only seeks to dispel illusions that ending full-scale wars in Iraq and Afghanistan would produce any kind of “peace dividend” that could help ameliorate conditions of poverty, unemployment and declining living standards for working people in the US itself, but makes it clear that the legacy of decisions made during the Iraq and Afghanistan conflicts would impose significant long-term costs on the federal government for many years to come.

Prominent academic and author Dr Michel Chossudovsky warned that the so-called war on terrorism is a front to propagate America’s global hegemony and create a New World Order.
Dr Chossudovsky said terrorism is made in the US and that terrorists are not the product of the Muslim world.
According to him, the US global war on terrorism was used to enact anti-terrorism laws that demonised Muslims in the Western world and created Islamophobia.
