Dominican Republic judge denies a warrant to arrest ex- Vatican envoy

Santo Domingo.- A judge in the Dominican Republic on Monday refused to issue a warrant to arrest former Vatican envoy Józef Wesolowski, charged with sexually abusing minors.

National District instruction judge Román Berroa ruled that since the country forms part of the Vienna Convention, a diplomat cannot be prosecuted outside the State which he represents.

The judge also notified the decision to National District prosecutor Yeni Berenice Reynoso, who heads the effort to extradite the former bishop, the highest ranking official of the Catholic Church to face such indictment.

In her request, Reynoso said the Vatican’s former representative should face charges in the country of allegedly paying boys to perform sexual acts

In that regard Justice minister Francisco Domínguez has stated that the Vienna Convention precludes Wesolowski’s extradition to the Dominican Republic.

After being dismissed from the clerical state, according to a verdict by the Congregation for the Doctrine of the Faith, the former nuncio in Santo Domingo Jozef Wesolowski, who is accused of enticing young boys on the beach and paying them for sexual favours, is not granted diplomatic immunity any longer and will thus be prosecutable in other countries. Other than in Santo Domingo, the former prelate is under investigation in Poland, his home country. The Director of the Holy See Press Office, Father Federico Lombardi, announced this while answering the questions of the press following an article in the New York Times that brought the issue back into the spotlight, criticising the Vatican for his management of the incident.

Wesolowski, who was recalled to Rome immediately after being accused, was reduced to the lay state in few months, which is the highest possible punishment for a priest in Canon law. Now, says Lombardi, the former archbishop “has recently appealed, within the prescribed limit of two months, the most serious canonical sentence of a return to the lay state”. It appears that the appeal will be judged within October. As soon as the canonical sentence becomes definitive, the punitive procedure of the Vatican’s civil judiciary departments will begin: if he is found guilty by them as well, he might go to prison.

Lombardi explained that “Wesolowski has ceased functioning as a diplomat of the Holy See and has therefore lost his related diplomatic immunity”. The spokesman for the Vatican highlights that the Authorities of the Holy See “moved without delay and correctly in light of the fact that former nuncio Wesolowski held the position of a diplomatic representative of the Holy See.” Lombardi continues “This action relates to his recall to Rome and in the treatment of the case in relation to Authorities of the Dominican Republic. Far from any intention of a cover-up, this action demonstrates the full and direct undertaking of the Holy See’s responsibility even in such a serious and delicate case, about which Pope Francis is duly and carefully informed and one which the Pope wishes to address justly and rigorously”

La orden de captura internacional y arresto en contra del exnuncio apostólico Józef Wesolowski, quien está acusado de obligar a menores a ejercer favores sexuales por paga, fue rechazada por el juez coordinador de los Juzgados de la Instrucción del Distrito Nacional.

El magistrado Román Berroa Hiciano adoptó la decisión por considerar que no procede, porque el país es signatario de la Convención de Viena, la cual descarta que un diplomático pueda ser enjuiciado fuera del Estado que representa.

Asimismo, el juez notificó sobre la decisión a la fiscal del Distrito Nacional, Yeni Berenice Reynoso, quien con su pedimento buscaba allanar el camino para solicitar la extradición del exdecano del cuerpo diplomático acreditado en el país.

A judge on Monday declined to order a Catholic archbishop to be extradited from the Vatican to the Caribbean to face child sex charges.

We're deeply disappointed. And we're worried that the cleric may disappear before prosecutors and police in Italy, Poland and the Dominican Republic can apprehend him.

He's Archbishop Józef Wesolowski (though he was recently defrocked). In September 2013, he was exposed as credibly accused child molester, but only after Vatican officials had quietly whisked him to Rome.

We don't understand this ruling, nor the delays by law enforcement officials in three nations to pursue this dangerous cleric. We hope this ruling will be quickly overturned or that secular authorities in other countries will arrest him.

We hope Vatican officials do all they can to help police and prosecutors pursue Wesolowski and we hope that every single person who saw, suspected or suffered his crimes will find the courage to come forward, report to police, and start healing.

Lombardi: Former Nuncio Wesolowski does not have diplomatic immunity

(Vatican Radio) The Director of the Holy See Press Office, Father Federico Lombardi, SJ, on Monday confirmed that former Apostolic Nuncio Josef Wesolowski has appealed his “most serious canonical sentence” of being returned to the lay state, in a canonical trial related to the sexual abuse of minors.

“The appeal will be judged without delay over the course of the coming weeks, most likely in October 2014,” Father Lombardi said.

The former Nuncio was recalled from the Dominican Republic after the allegations were made, and was tried earlier this year on canonical charges. Once the appeals process is complete in the canonical trial, Wesolowski can face criminal charges in the Vatican City court system.

“It is important to note that former nuncio Wesolowski has ceased functioning as a diplomat of the Holy See and has therefore lost his related diplomatic immunity, and has been previously stated, the punitive procedure of the Vatican’s civil judiciary departments will continue as soon as the canonical sentence becomes definitive,” Father Lombardi said.

“Regarding stories that have appeared over the past few days in various media, it is important to note that the Authorities of the Holy See, from the very first moments that this case was made known to them, moved without delay and correctly in light of the fact that former nuncio Wesolowski held the position of a diplomatic representative of the Holy See,” he continued.

Vatican: Ex-nuncio may be extradited over child abuse claims

The Vatican has revoked the diplomatic immunity of a former Polish archbishop who is accused of sexually abusing children while serving as papal nuncio in the Dominican Republic.

“We must finally state that since former nuncio Wesolowski has ended all diplomatic activity and its related immunity, he might also be subjected to judicial procedures from the courts that could have specific jurisdiction over him,” Vatican spokesman Reverend Federico Lombardi outlined in a statement.

Reverend Lombardi stressed that Pope Francis has been “duly and carefully informed” about the case and that “the Pope wishes to address [the matter] justly and rigorously.”

The Dominican Republic's attorney general Francisco Dominguez Brito has commented that the Vatican's announcement represents a “just and positive” turning point.

Prokuratura w Santo Domingo złożyła już w sądzie dokumentację z zarzutami stawianymi arcybiskupowi Wesołowskiemu.

Decyzja o postępowaniu w sprawie czynów popełnionych w czasie pełnienia przez niego misji to rezultat informacji, jakie napłynęły w poniedziałek z Watykanu, który ogłosił, że były nuncjusz nie ma już immunitetu dyplomatycznego i może zostać osądzony przez inne wymiary sprawiedliwości.

The Dominican Republic has begun criminal proceedings against the former archbishop. We are glad the prosecutor’s office in Santo Domingo has moved quickly to begin criminal proceedings and we hope Josef Wesolowski is apprehended and made to face justice immediately.

We urge law enforcement officials in the Dominican Republic to reach out to anyone else who might be suffering in silence and self blame because of the deplorable actions of Wesolowski. And we urge Vatican officials to do everything in their power to apprehend him before he flees.

We hope anyone who saw, suspects, or suffered child sex crimes will come forward, speak up, report to law enforcement, and start healing.

Why Is Pope Francis Protecting a High-Ranking Pedophile?

The latest pedophile scandal involving the Roman Catholic Church raises a distressingly familiar question: is the Church fighting to end sexual abuse by its priests, or still trying to avoid responsibility? Even worse, from the Church’s perspective, the current outrage calls into question the personal ethics of Pope Francis, whose popularity with rank-and-file Catholics and with the faith community generally is in the same league with that of John XXIII or John-Paul II.

Pope Francis is popular for the excellent reason that “humble” and “frugal” have not been common words to describe those who have occupied the throne of St. Peter, and this Pope has made very public efforts to emulate the life of a carpenter’s son rather than a life of royal privilege. Still, the Pope has personal representatives and many of them are accustomed to royal privileges.

The Papal Nuncio to the Dominican Republic, Jozef Wesolowski, came to the attention of prosecutors when Nuria Piera, General Director of Cadena de Noticias (CDN), a television station owned by the principal newspaper in Santo Domingo, El Caribe, sent a camera crew to chase down rumors that the nuncio had been luring boys to the beach house (a perk of his office) to engage in sex for money. According to The New York Times, Wesolowski caught the reporters following him and quit cruising for boys on the beach. Instead, he sent a Church deacon, Francisco Reyes, to pander for His Excellency.

(A Papal Nuncio does not represent the city-state of Vatican City. He [always “he”] represents the Holy See, and its personification, the Pope. Each nuncio is personally selected by the Pope and, in Catholic countries, the nuncio is senior in diplomatic protocol to secular ambassadors. Even in non-Catholic countries, the nuncio has all the privileges and immunities of other ambassadors because the Holy See is a signatory to the Vienna Convention on Diplomatic Relations.)

Reverend Mr. Reyes got arrested for solicitation of a minor on June 24, 2013. When nobody from the Church appeared promptly to bail him out, he squealed and named names of alleged child molesters in a letter written on July 2 to, among others, Cardinal Nicolas de Jesus López Rodriguez, who flew to the Vatican and presented the evidence directly to Pope Francis.

The Pope then quietly recalled his nuncio on August 21 without informing Dominican authorities of either the allegations or the recall, spiriting His Excellency Jozef Wesolowski out of the Dominican Republic just ahead of an investigation of numerous counts of child sexual abuse, which began in early September when CDN ran Ms. Piera’s reports. Only then, did the Church announce that Pope Francis had recalled his nuncio. The Vatican then invoked diplomatic immunity to keep the nuncio from being tried for his crimes in the Dominican Republic. After The New York Times reported the story in August of this year, the Vatican reversed course and stripped Wesolowski’s diplomatic immunity, but hedged the decision in a way that sends mixed messages.

Why The Times Identified and Photographed Teenagers in a Sex Abuse Article

Several readers wrote to me concerned about a Times article earlier this week that told the stories of some Dominican teenagers who described sexual abuse by a former priest and Vatican official. They told me they were surprised and dismayed to see the young people identified by name with their photographs used in an accompanying gallery.

One reader, Julio César Diaz, who said he read the article with particular interest because he is Dominican, said in an email:

I can’t help but feel a little sickened by the fact that several child sexual abuse victims are named in the article. Their photographs also appear in the gallery accompanying the article. I don’t think it’s ethical to do this. I think sexual abuse victims’ identities should be protected, especially if the victims are still children, as is the case of Darwin Quervedo, who is 14 right now, according to the article, or Francis Aquino Aneury, who is 17. Or do these protections apply only if the victims are Americans?

And Dan Hortsch of Portland, a former ombudsman for The Oregonian, wrote, in part:

Were the boys named as victims in the story given the opportunity to not have their names reported and their faces photographed for use with the story? Presumably they knew that they were being photographed, but did The New York Times explain that they could remain anonymous? If not, the matter is definitely disturbing.

Presumably, too, that is the practice with other victims of sexual abuse unless the victims approve use of their names and photos. And then the articles normally would explain that they were willing to be named and photographed.

I understand the need for credible sources, but these victims of sexual abuse are no different from anyone in this country. The fact that one boy, 14, is described as speaking “haltingly, with eyes downcast” about his experience makes clear the embarrassment.

These readers raise important concerns. I asked the article’s author, Laurie Goodstein, who covers religion for The Times, to explain how the teenagers were approached on this subject.

She responded:

The teenagers identified in the story as abuse victims not only gave us permission for us to use their names and take their photographs, but wanted their stories to be told. There is no double standard here. I have found that some victims of sexual abuse feel that by going public, they may help prevent other people from being victimized by their abusers, and in this they find some purpose in their suffering. In the case of these specific children, they wanted to give their testimony to someone because they had not been interviewed by the authorities. We interviewed them on multiple occasions, made it clear that their names and pictures would be published in a newspaper and on the Internet, and they were sure that they wanted to proceed.

After Vatican removes immunity, Dominican court opens abuse case against ex-diplomat

SANTO DOMINGO, Dominican Republic — A court in the Dominican Republic has taken the first steps toward possible sexual abuse charges against a former Vatican ambassador to the Caribbean country.

An investigative magistrate is examining allegations against Josef Wesolowski to determine if there is sufficient evidence to warrant criminal charges, the Santo Dominican prosecutor's office announced late Tuesday.

The announcement came a day after the Vatican said its former ambassador had lost his diplomatic immunity.

The Vatican recalled Wesolowski in August 2013 after allegations emerged he had sexually molested boys there.

Dominican officials say his presence is not required in the country for authorities to review an investigation of the allegations and decide whether formal charges are warranted.

The court says it will begin interviewing alleged victims on Sept. 2.

Dominican authorities have said their country's investigation uncovered allegations that Wesolowski had paid at least six minors to watch them masturbate and had recorded it with his mobile phone, but prosecutors did not file charges because the nuncio had diplomatic immunity.

The case was highly sensitive, given that the Polish-born Wesolowski was an ambassador of the Holy See — not just one of the world's 440,000 priests — and had been ordained both a priest and a bishop by St. John Paul II.

VATICAN CITY (RNS) Poland’s ambassador to the Holy See has forcefully condemned the alleged sexual abuse of children by a Polish-born former archbishop and Vatican diplomat, and said Warsaw is considering a fresh request to extradite Jozef Wesolowski to face trial in his homeland.

Ambassador Piotr Nowina-Konopka said Wednesday (Aug. 27) the Polish government was reviewing its options after the Vatican announced this week that the former papal envoy to the Dominican Republic had been defrocked and no longer had diplomatic immunity.

“We are currently analyzing the situation regarding immunity,” the ambassador told Religion News Service in remarks that were unusually frank for a diplomat, and especially one from a country that is as strongly Catholic as Poland.

“Without doubt Poland considers the acts that the archbishop is alleged to have carried out as particularly repugnant and Pope Francis’ firm approach to that type of crime has won great respect and full support in Poland,” Nowina-Konopka said.

Wesolowski, the 66-year-old former papal envoy to the Dominican Republic, was quietly recalled from Santo Domingo last August after rumors emerged that he had sexually molested young boys there. But he is also wanted on sex abuse charges in Poland, though details of the charges were not known.

Santo Domingo.- Justice minister Francisco Dominguez Brito issued a statement saying it was just and positive for the Vatican to remove Josef Wesolowski’s immunity and that the Dominican Republic would consider seeking the former archbishop’s extradition so he could stand trial in the country.

Wesolowski, former Vatican envoy to the Dominican Republic, had been indicted on sexual abuse of boys and thus defrocked. Since the Holy See doesn't extradite its own citizens, the Vatican had previously insisted that the former papal diplomat enjoyed diplomatic immunity.

A former papal diplomat, who was defrocked over allegations that he sexually abused young boys, has lost his diplomatic immunity and could therefore face trial in the Dominican Republic, according to the Vatican.

Authorities in the Dominican Republic, where Jozef Wesolowski served as nuncio, or ambassador, said an investigation uncovered allegations that Wesolowski had paid young boys to perform sexual acts. However, prosecutors did not file charges because as nuncio, Wesolowski had diplomatic immunity.

The Vatican has previously insisted in its handling of the delicate case of Josef Wesolowski that he enjoyed diplomatic immunity and that the Holy See doesn't extradite its own citizens.

But Vatican spokesman Father Federico Lombardi said in a statement on Monday that the 66-year-old former archbishop no longer had immunity and might "be subjected to judicial procedures from the courts that could have specific jurisdiction over him".

VATICAN CITY (RNS) Josef Wesolowski, the ex-Vatican envoy stripped of diplomatic immunity after claims he sexually abused young boys in the Dominican Republic, may face a criminal trial in the Caribbean country.

Francisco Dominguez Brito, the Dominican Republic’s attorney general, issued a statement saying it was “just and positive” for the Vatican to remove Wesolowski’s immunity and that the country would consider seeking the former archbishop’s extradition so he could stand trial there.

“At this time extradition is an option. However, first we must look at the details of the Vatican’s decision,” the prosecutor said. “It is clear that since this man no longer has immunity, this can help us on the question of extradition so that he can come here and face justice.”

His comments were published on a Dominican news website and confirmed by an official at the Dominican Embassy in Rome on Tuesday (Aug. 26).

Will the Vatican extradite Josef Wesolowski?

Did you read Laurie Goodstein's disturbing story about the former papal nuncio to the Dominican Republic, Josef Wesolowski? Do. Wesolowski was recalled to the Vatican after it was alleged that he had sexually abused minors (Goodstein spoke with several of his accusers). He was laicized, and could face a criminal trial at the Vatican (Pope Francis updated Vatican criminal law last summer). Obviously that isn't terribly comforting to some Dominicans who would rather see him tried in the country where he committed his alleged crimes. If Pope Francis is serious about reforming the church's response to clerical sexual abuse, why did he allow Wesolowski to escape local justice?

According to a Vatican statement released this afternoon, the former nuncio may face extradition after all--because, now that he's been laicized, he no longer enjoys diplomatic immunity.

Former nuncio Josef Wesolowski has recently appealed, within the prescribed limit of two months, the most serious canonical sentence of a return to the lay state that has been imposed upon him. The appeal will be judged without delay over the course of the coming weeks, most likely in October 2014.   It is important to note that former nuncio Wesolowski has ceased functioning as a diplomat of the Holy See and has therefore lost his related diplomatic immunity, and has been previously stated, the punitive procedure of the Vatican’s civil judiciary departments will continue as soon as the canonical sentence becomes definitive.  

The statement continues, suggesting that Wesolowski was returned to Rome so that he could be swiftly returned to the lay state and relieved of his diplomatic duties, which means that he could be tried by another country.

Regarding stories that have appeared over the past few days in various media, it is important to note that the Authorities of the Holy See, from the very first moments that this case was made known to them, moved without delay and correctly in light of the fact that former nuncio Wesolowski held the position of a diplomatic representative of the Holy See. This action relates to his recall to Rome and in the treatment of the case in relation to Authorities of the Dominican Republic.   Far from any intention of a cover-up, this action demonstrates the full and direct undertaking of the Holy See’s responsibility even in such a serious and delicate case, about which Pope Francis is duly and carefully informed and one which the Pope wishes to address justly and rigorously.

Zum Ablauf der zweimonatigen Berufungsfrist hat der ehemalige polnische Erzbischof und Kuriendiplomat Josef Wesolowski Berufung gegen das Urteil der Glaubenskongregation gegen ihn eingelegt. Das sagte Vatikansprecher Pater Federico Lombardi an diesem Montag gegenüber Journalisten. In erster Instanz war er am 27. Juni dieses Jahres aus dem Klerikerstand entlassen worden. Die Vorwürfe lauteten auf sexuellen Missbrauch Minderjähriger während seiner Zeit als Nuntius in der Dominikanischen Republik. Das Urteil der Glaubenskongregation stellt die kirchenrechtliche Behandlung des Falles dar, strafrechtlich muss sich Wesolowski noch vor den zuständigen Gerichten des Vatikans verantworten. Der ehemalige Bischof ist Staatsbürger des Vatikan.

Die Verhandlung in zweiter Instanz werde sehr bald aufgenommen, so Lombardi, wahrscheinlich noch im Oktober dieses Jahres. VATICAN CITY — The Vatican said Monday that its former ambassador to the Dominican Republic, accused of sexually abusing young boys in the Caribbean country, had lost his diplomatic immunity and could be tried by Dominican or other courts.

The Vatican has previously insisted in its handling of the delicate case of Josef Wesolowski that he enjoyed diplomatic immunity and that the Holy See doesn’t extradite its own citizens.

But in a statement Monday, the Vatican spokesman the Rev. Federico Lombardi, said Wesolowski had ceased all diplomatic activity for the Holy See, lost his related immunity and therefore “might also be subjected to judicial procedures from the courts that could have specific jurisdiction over him.”

The Vatican recalled Wesolowski a year ago after allegations emerged in the Dominican Republic that he had sexually molested young boys there.

Dominican authorities have said their country’s investigation uncovered allegations that Wesolowski had paid at least six minors to watch them masturbate and had recorded it with his mobile phone, but prosecutors did not file charges because the nuncio had diplomatic immunity.

The Vatican has denied covering-up for a former papal ambassador accused of sexually abusing boys and suggested he might have to stand trial on the charges in the Dominican Republic.

Jesuit Father Federico Lombardi, the Vatican spokesman, released a statement on August 25 in response to journalists’ questions about former Archbishop Jozef Wesolowski, a Pole who served as nuncio to the Dominican Republic until August 2013.

According to an August 23 article in the New York Times, the Vatican “secretly recalled (Wesolowski) to Rome last year before he could be investigated, and then invoked diplomatic immunity for Mr. Wesolowski so that he could not face trial in the Dominican Republic.”

Father Lombardi responded that the Vatican, by recalling the diplomat from his post last summer “moved without delay and correctly in light of the fact that former nuncio Wesolowski held the position of a diplomatic representative of the Holy See.”

A former Polish archbishop and diplomat has appealed against his defrocking after a Vatican tribunal convicted him of pedophilia. Jozef Wesolowski faces further criminal proceedings in Vatican City and possibly beyond.

The Vatican announced Monday the former archbishop 66-year-old Jozef Wesolowski, who had served as the Vatican's diplomat for the Dominican Republic and former Holy See ambassador, had appealed against his defrocking.

In June, he was reduced to the status of a layman after being stripped of his diplomatic title and defrocked after being found guilty of child sex abuse and deemed unfit to be a priest by a Vatican tribunal. He was the most senior Vatican figure to be punished for such a crime. His was the harshest penalty the Vatican tribunal could rule against a cleric under canon law.

He now faces a separate criminal trial in Vatican City state courts - the first of its kind there - for sexual abuse and could face up to 12 years in prison. As he no longer has diplomatic immunity, Wesolowski could also face charges in the Dominican Republic, where there is a criminal investigation against him on allegations he paid boys for sexual acts, or in his native country of Poland.

The Vatican’s former ambassador to the Dominican Republic, who has been accused of paying underage boys there to engage in sexual acts, has lost his diplomatic immunity and could ultimately face prosecution in criminal courts outside of the Vatican, a spokesman for the Roman Catholic Church announced on Monday.

The former ambassador, Archbishop Jozef Wesolowski, has already been defrocked by the Vatican, the harshest penalty under the church’s canon law short of excommunication. Beyond that, the Vatican has also said that it intends to try Mr. Wesolowski on criminal charges — the first time it will hold a criminal trial for sexual abuse.

But the Vatican has also caused an uproar in the Dominican Republic because it abruptly recalled Mr. Wesolowski last year before he could face a criminal inquiry and possible prosecution there. Acting against its own guidelines for handling abuse cases, the church failed to inform the local authorities of the evidence against him, secretly recalled him to Rome, and then invoked diplomatic immunity.

The Vatican has said in the past that because Mr. Wesolowski was a member of its diplomatic corps and a citizen of the Holy See, the case would be handled in Rome.

The announcement on Monday came a day after a New York Times article detailed the allegations against Mr. Wesolowski and the Vatican’s handling of the case. In the Vatican’s statement on Monday, the church said that it took the proper steps to make sure that the allegations against Mr. Wesolowski were dealt with seriously.

This was his first visit to Puerto Rico, but the Polish-born cleric will return for the Congress on the Family, which will be held in Mayagüez on the third week of April. He was pleased with the affection he has been given in both Puerto Rico and the Dominican Republic and pointed out that redoubling the Catholic Church's efforts to strengthen family unity is among his plans.

Court assigns public defender in former Vatican envoy pedophilia case

Santo Domingo.- Public defender Rodolfo Valentin on Tuesday said the National District 7th Instruction Court held a hearing Tuesday to review evidence submitted in the pedophilia case against former Vatican envoy Joseph Wesolowski.

He said Ole Miranda, 18, who was one of Wesolowski’s alleged victims, would’ve been interviewed, but failed to appear.

Valentine said the depositions started at the request of the National District Office of the Prosecutor, which is gathering evidence to send to Poland and seek the former diplomat’s extradition.

He revealed that he was appointed public defender in the case at the Court’s request, but "from the standpoint of respect for constitutional guarantees and due process, it cannot empower a public defender when they don’t even know the defendant."

The world may be about to witness a first: the Vatican putting on trial one of its own officials for sexual abuse. On Monday a Vatican spokesman said church authorities are in the midst of figuring out what the procedure would even look like.

“This is history in the making and we must wait to see how this will develop,” said the Rev. Thomas Rosica, an English-language spokesman for the Vatican.

The case of Josef which as a city-state has its own judicial systemi exploded earlier this summer when the Congregation for the Doctrine of the Faith — the Vatican’s doctrine-enforcing arm — found the former ambassador to the Dominican Republic had sexually abused boys there and laicized, or defrocked, him. That was the first time someone officially representing the pope had been punished for sexual abuse. The Polish priest is appealing that decision.

On the criminal front, media reported that Dominican authorities never charged Wesolowski because he had diplomatic immunity. But that question reemerged this past weekend when the New York Times quoted legal experts in the Dominican Republic questioning why Wesolowski would not be forced to face his accusers locally. Wesolowski was recalled to Rome in the summer of 2013 before local officials could investigate there. Some advocates for clergy sex abuse survivors said the case is a test for Pope Francis’s claim of zero-tolerance and that Wesolowski should be imprisoned.

The case of a former Vatican envoy in the Dominican Republic, who has been laicized for molesting young boys, could test the Vatican’s determination to prosecute abusive clerics, a New York Times article suggests.

In a detailed report on the case of former Archbishop Jozef Wesolowski, the former apostolic nuncio to the Dominican Republic, the New York Times observes that the Vatican did not inform civil authorities of evidence that the nuncio had engaged in sexual abuse of children.

The Times story reports that Wesolowski routinely preyed on young boys, until investigative reporters in the Dominican Republic uncovered evidence of his misconduct. When the Vatican learned of that evidence, in August 2013, the nuncio was quickly recalled to Rome.

In June of this year, the Congregation for the Doctrine of Faith found Wesolowski guilty of sexual abuse, and the archbishop was laicized. He remains in Rome, pending an appeal of that canonical sentence, and could also face criminal charges before a Vatican tribunal.

(Reuters) - A Polish archbishop accused of child sex abuse in the Dominican Republic has appealed against a Roman Catholic tribunal's decision to defrock him, the Vatican said on Monday.

Jozef Wesolowski, who had served as a Vatican nuncio or ambassador to the Caribbean nation, was sentenced in late June to be expelled from the priesthood, an extremely rare step against such a senior church official.

"Former nuncio Josef Wesolowski has recently appealed, within the prescribed limit of two months, against the most serious canonical sentence, that of a return to the lay state, which has been imposed upon him," Vatican spokesman Father Federico Lombardi said in a statement.

The appeal will be judged "without delay" over the coming weeks, most likely in October 2014, Lombardi said. He said that Wesolowski, who was recalled last August to the Vatican, had lost diplomatic immunity when he stopped functioning as a diplomat of the Holy See.

The case was highly sensitive, given that the Polish-born Wesolowski was an ambassador of the Holy See — not just one of the world's 440,000 priests — and had been ordained both a priest and a bishop by St. John Paul II.

This summer, a Vatican tribunal found him guilty under canon law of abusing young boys and defrocked him, the harshest sentence under church law and the first time such a high-ranking Vatican official had been sanctioned for sex abuse. Wesolwski recently appealed that sentence and a final decision is expected in October, Lombardi said.

After that appeal is heard, the Vatican's criminal courts will take up the case and jail time is possible if he is found guilty.

As a papal diplomat and citizen of the Vatican City State, Wesolowski faces criminal charges by the tribunal of the Vatican City, which recently updated its laws to specifically criminalize sex abuse of children. It is not clear, however, if the new 2013 law can be applied retroactively.

Santo Domingo.- The charges for child sexual abuse, hanging over the Vatican’s ex-ambassador to the Dominican Republic, Jozef Wesolowski, have fueled the debate about the diplomatic immunity the Pope's former envoy enjoys, which prevents him from being tried outside the Vatican.

In its Sunday edition the U.S. newspaper The New York Times published an article that highlights how Wesolowski walked in the area of the monument to the 16th-century Spanish friar Antonio de Montesinos, on the Malecon of Santo Domingo, in search of minors to commit sexual acts.

According to the article, the boys say he gave them money to perform sexual acts. They called him “the Italian” because he spoke Spanish with an Italian accent.

“He definitely seduced me with money,” Francis Aquino Aneury told The New York Times. He was 14 when the man he met shining shoes began offering him increasingly larger sums for sexual acts. “I felt very bad. I knew it wasn’t the right thing to do, but I needed the money.”

The Vatican secreted Wesolowski out of the country in August last year amid rumors he sexually abused boys in the Dominican Republic.

Catholic Church officials in Rome and the Dominican Republic must take action to protect kids now from former Archbishop Josef Wesolowski.

We call on Vatican officials to either put Wesolowski in a Vatican jail or turn him over to secular authorities immediately.

We call on Dominican Catholic officials to actively seek out others who were hurt by Wesolowski and help secular prosecutors convict Deacon Francisco Javier Occi Reyes, who procured boys for the then-archbishop, by making announcements about both clerics in parishes, urging those who saw, suspected or suffered their crimes to come forward, get help and call police.

We call on Dominican Catholics and citizens to stop donating to their dioceses until this happens.

Finally, we call on every person with knowledge of or suspicions about crimes by Wesolowski or Reyes to find the strength to report to law enforcement. Secular authorities, not church authorities, can best safeguard kids from those who commit, enable or conceal heinous crimes against children.

We applaud the courage of the Dominican boys who were sexually violated by this now-defrocked Polish archbishop who Vatican officials continue to protect from prosecution. For their healing, and for the safety of other children, Wesolowski must be put behind bars immediately.

The Vatican moved its top diplomat out of the Dominican Republic because of sex-abuse complaints, failed to tell criminal authorities and then harbored him in Rome as his list of accusers grew.

The case, reported Sunday by The New York Times, underscores findings from our landmark 2004-2005 investigation into the Catholic Church’s global transfers of predator priests.

In “Runaway Priests: Hiding in Plaint Sight,” we found several accused clergy who fled to Rome with their superiors’ help. At least two were fugitives from criminal charges.

Another priest we featured was also a diplomat, an American who had been the Vatican’s No. 2 official in India. A top aide to Pope John Paul II was warned in the 1990s that the priest had abused an Ohio girl. But the priest remained on duty until around the time of our inquiries in 2003.

Pope Francis has vowed greater accountability in addressing the Catholic Church’s sex-abuse crisis since taking over. Earlier this year, he begged victims for forgiveness.

Yet Pope Francis was alerted to the Dominican Republic diplomat’s misconduct before the secret transfer last August, authorities told The Times. The allegations should have been reported to police, according to Vatican rules.

Puerto Rico Catholic Priest pleads guilty to child exploitation

SAN JUAN, Puerto Rico (CMC) – The United States Immigration and Customs Enforcement (ICE) agency says a suspended Catholic priest has pleaded guilty to child exploitation charges for taking a minor on a cruise with the intent to engage in criminal sexual conduct.

Israel Berrios-Berrios who pleaded guilty in court on Thursday was arrested on May 13 at his residence in Naranjito, Puerto Rico, following an indictment that charged him with transporting a minor with the intent to engage in sexual activity.

Prosecutors charged that Berrios-Berrios transported a 15-year-old male minor to Miami, Florida, where they took a four-day cruise to the Bahamas.

“While on the cruise, Berrios-Berrios engaged in lewd acts with the minor,” prosecutors claimed.

Im Schatten der ältesten katholischen Kathedrale Amerikas betrieb er jahrelang sexuellen Missbrauch. Gemeinsam mit dem polnischen Pater Wojciech Gil soll er sich mit jungen Messdienern in seinem Haus am Strand vergnügt haben. Zwei weitere Geistliche aus seiner Botschaft stehen unter Verdacht, Frauen und Kinder zum Sex gezwungen haben. Ein dominikanischer TV-Sender soll Wesolowski dabei gefilmt haben, wie er ein Kinderbordell in Santo Domingo betrat.

Inzwischen ist der 66-jährige Wesolowski Amt, Würde und auch den Stand des Geistlichen los. Papst Franziskus rief ihn schon 2013 von seinem Posten als Botschafter des Heiligen Stuhls ab. Im Juni wurde er offiziell aus dem Priesterstand entlassen. Der Vatikan hat zudem angekündigt, ihm wegen der "weltlichen" Verbrechen, die er begangen hat, den Prozess zu machen.

SANTO DOMINGO, Dominican Republic — He was a familiar figure to the skinny shoeshine boys who work along the oceanfront promenade here. Wearing black track pants and a baseball cap pulled low over his balding head, they say, he would stroll along in the late afternoon and bring one of them down to the rocky shoreline or to a deserted monument for a local Catholic hero.

The boys say he gave them money to perform sexual acts. They called him “the Italian” because he spoke Spanish with an Italian accent.

It was only after he was spirited out of the country, the boys say, his picture splashed all over the local news media, that they learned his real identity: Archbishop Jozef Wesolowski, the Vatican’s ambassador to the Dominican Republic.

“He definitely seduced me with money,” said Francis Aquino Aneury, who says he was 14 when the man he met shining shoes began offering him increasingly larger sums for sexual acts. “I felt very bad. I knew it wasn’t the right thing to do, but I needed the money.”

The case is the first time that a top Vatican ambassador, or nuncio — who serves as a personal envoy of the pope — has been accused of sexual abuse of minors. It has sent shock waves through the Vatican and two predominantly Catholic countries that have only begun to grapple with clergy sexual abuse: the Dominican Republic and Poland, where Mr. Wesolowski was ordained by the Polish prelate who later became Pope John Paul II.

It has also created a test for Pope Francis, who has called child sexual abuse “such an ugly crime” and pledged to move the Roman Catholic Church into an era of “zero tolerance.” For priests and bishops who have violated children, he told reporters in May, “There are no privileges.”

Mr. Wesolowski has already faced the harshest penalty possible under the church’s canon law, short of excommunication: on June 27, he was defrocked by the Vatican, reducing him to the status of a layman. The Vatican, which as a city-state has its own judicial system, has also said it intends to try Mr. Wesolowski on criminal charges — the first time the Vatican has held a criminal trial for sexual abuse.

But far from settling the matter, the Vatican has stirred an outcry because it helped Mr. Wesolowski avoid criminal prosecution and a possible jail sentence in the Dominican Republic. Acting against its own guidelines for handling abuse cases, the church failed to inform the local authorities of the evidence against him, secretly recalled him to Rome last year before he could be investigated, and then invoked diplomatic immunity for Mr. Wesolowski so that he could not face trial in the Dominican Republic.

The Vatican’s handling of the case shows both the changes the church has made in dealing with sexual abuse, and what many critics call its failures. When it comes to removing pedophiles from the priesthood, the Vatican is moving more assertively and swiftly than before. But as Mr. Wesolowski’s case suggests, the church continues to be reluctant to report people suspected of abuse to the local authorities and allow them to face justice in secular courts.

The Vatican says that because Mr. Wesolowski was a member of its diplomatic corps and a citizen of the Holy See, the case would be handled in Rome. But even many faithful Catholics in this nation, home to the oldest Catholic cathedral in the Americas, say they are unsettled that a Vatican official could have been using children for sex, yet was not arrested and tried in their own country.

“From the pure standpoint of justice, he should be tried in the country where the acts took place because the conditions for trying him will not be the same elsewhere,” said Antonio Medina Calcaño, dean of the faculty of law and political science of the Autonomous University of Santo Domingo. “But all we can do is hope that the courts in the Vatican will treat this with the severity that it really deserves.”

The Vatican spokesman, the Rev. Federico Lombardi, did not say when the Wesolowski trial will start, who is representing the former nuncio, or whether he is at liberty while he awaits trial. Under Vatican law, sexual abuse charges can bring a maximum of 12 years in prison and a fine of nearly $200,000.

A Dominican bishop, Victor Masalles, visiting Rome in late June, said in a Twitter message that he was surprised to see Mr. Wesolowski “strolling the Via della Scrofa,” in the city’s picturesque ancient center. He added, “The silence of the Church has hurt the people of God.”

A Man Known as ‘The Italian’

The waterfront promenade in the Dominican capital is dominated by a 50-foot monument to the 16th-century Spanish friar Antonio de Montesinos, dressed in robes and preaching the fiery sermon that made him famous: denouncing the slavery and abuse of the indigenous people by their Spanish colonists.

It was at the heel of this colossus, on the deserted upper plaza in the shadow of the friar’s robes, Mr. Aquino said, that he was often molested by the man he knew as “the Italian.” The man always chose a bench that would allow him to see the rare visitor coming up the staircase, and would watch the boy masturbate, would touch him or would touch himself, said Mr. Aquino, now 17. Other times, they went to the rocky beach below the statue.

Mr. Aquino, whose family is originally from Haiti, left school in the eighth grade, earning $1.50 on a typical weekday by shining shoes. But he said that the man gave him more than $10 the first time they met, in 2010, to shine his shoes and to swim naked in the ocean while Mr. Wesolowski watched.

The man returned often over the next six weeks, Mr. Aquino said. But gradually the man wanted more, giving him from about $25 to as much as $135, as well as sneakers and a watch, for sexual acts. They met on and off over three years, Mr. Aquino said, but the man revealed little more than his first name, which he gave as “Josie.”

There is a mix of shame and anger among the shoeshine boys who say they knew the man. Darwin Quervedo, who is 14, said haltingly, with eyes downcast, that when he was 11, the man gave him more than $25 to watch him masturbate down by the beach. He said he felt scared, and never did it again.

When he learned much later of the man’s identity, Darwin said he thought to himself, “What kind of a man who is a priest does things like this?”

The promenade is a popular stretch for tourists and joggers. But it is also frequented by those seeking children and young men for sex. With all this activity, Mr. Wesolowski, in his track suit and running shoes, did not at first attract inordinate attention. He also chose his victims carefully, the shoe shiners said.

“He wasn’t interested in me,” said Robin Quello Cintrón, 23. “He said I was too old, that he liked the younger ones.”

“I warned the younger kids, ‘Don’t go with him,’ ” said Mr. Cintrón, adding, “But the money tempted them.”

Curbing child sexual exploitation is a pressing issue in the Dominican Republic and many countries, and the Catholic Church is among the many religious institutions that have taken up the cause.

In March, Pope Francis signed onto a campaign with other global religious leaders to fight all forms of human slavery, including child prostitution. This month, he sent a message for the opening of a refuge in Argentina for young victims of sexual exploitation.

Still, two United Nations panels in Geneva examining the church’s record on child sexual abuse questioned the Vatican this year about its handling of the Wesolowski case.

Mr. Wesolowski, 66, was ordained at 23 in Krakow by Archbishop Karol Józef Wojtyla, who later became Pope John Paul II. In 1999, he was appointed papal nuncio to Bolivia, and in 2002, he was reassigned to Kazakhstan, Tajikistan, Kyrgyzstan and Uzbekistan.

In 2008, he was sent to the Dominican Republic. Mr. Wesolowski served as a ceremonial dean of the international diplomatic corps here, convening an annual party in honor of the country’s president. The posting came with a stately residence and access to a beach house.

On the waterfront, Mr. Wesolowski attempted to disguise his rank, the boys say. He drove a small gray-green Suzuki sport utility vehicle with rosary beads hanging from the rearview mirror, they recalled, and parked it near the monument in the colonial zone, where several streets are named for archbishops.

One day last year, Nuria Piera, a prominent television journalist, received a tip that the papal nuncio drank beer many afternoons at a waterfront restaurant, then went off with young boys.

Ms. Piera sent a video crew to surreptitiously film the nuncio, she said in an interview at CDN, where she is general director. The crew shot some video of Mr. Wesolowski drinking alone and walking the promenade, Ms. Piera said, but he noticed their presence (though not the camera), walked over, smacked his hand against their car and asked why they were following him.

After that, Ms. Piera said, he disappeared from the waterfront. Her tipster never saw him there again.

“I suspected that there may have been a leak from our own office,” Ms. Piera said.

Mr. Wesolowski began sending a young Dominican church deacon to procure children for him, law enforcement authorities in the Dominican Republic say.

The deacon, Francisco Javier Occi Reyes, was arrested by the police on June 24, 2013, accused of solicitation of minors and taken to jail. But no one came to bail him out, and the deacon sent an anguished letter dated July 2 to Mr. Wesolowski, to be delivered to him by hand at his office.

“We have offended God” and the church, the letter said, by sexually abusing children and adolescents “for crumbs of money.” The deacon wrote that he had agreed to find child victims for the nuncio so that “your sexual appetite can be satiated,” but that he was now asking God for forgiveness.

“Hopefully you will consider asking for God to help you to walk away from this evil disease of continuing to sexually abuse innocent children,” the letter said, according to a copy obtained by The New York Times from a Dominican Justice Ministry official.

The deacon sent copies of the letter to Cardinal Nicolas de Jesus López Rodriguez, the head of the church in the Dominican Republic, and to a Dominican bishop, Gregorio Nicanor Peña Rodríguez. The cardinal then carried the evidence to the Vatican, where he met directly with Pope Francis, according to interviews with the Dominican authorities. On Aug. 21 last year, Mr. Wesolowski was secretly recalled to Rome.

Six days later, the cardinal called the papal nuncio “a great friend and promoter of peace.”

Neither the cardinal, nor other church officials, reported the allegations to the local authorities, Dominican officials say. Vatican guidelines say that criminal sexual abuse accusations should be reported in countries where reporting is required.

The country’s attorney general, Francisco Domínguez Brito, and the district attorney of Santo Domingo, Yeni Berenice Reynoso Gómez, both said in interviews that they first learned about the allegations against Mr. Wesolowski from Ms. Piera’s television reports, which were broadcast in early September and included a child asserting that he had been abused.

Soon after, church officials here told local news media that Mr. Wesolowski had been recalled because of the allegations against him, prompting Cardinal Rodriguez to confirm that he had gone to the Vatican to address the matter. He and other church officials denied requests for an interview.

‘The Most Terrible Case’

The district attorney, Ms. Reynoso, said her investigators had identified four children aged 12 to 17 with whom the nuncio had sexual contact, but that there were likely others.

The 17-year-old had epilepsy, and the nuncio gave him medicine for his condition in exchange for sexual acts, starting from when the boy was 13, the district attorney said. She said she had “no doubt” about the credibility of the youths’ testimony, because it was corroborated by other evidence.

“This is the most terrible case that I have ever seen,” said Ms. Reynoso. “He was abusing kids who were living in extreme poverty, in exchange for pills for a boy’s illness. It’s very perverse.”

The Vatican sent someone to the Dominican Republic last October to look into the case, but they made no contact with the district attorney or anyone in her office, Ms. Reynoso said. She forwarded her report to the country’s attorney general, who forwarded it to the Vatican.

Ms. Reynoso said the case should have been prosecuted in the Dominican Republic. “These children who were abused, and their families, and the Dominican society, have a legitimate right to see Jozef Wesolowski judged by a jury — not as a diplomat, but for what he really is,” she said. “A child abuser.”

Mr. Brito, the attorney general, said he trusted that the Vatican would apply the “appropriate discipline.” He said he did not seek to have Mr. Wesolowski extradited because he has diplomatic immunity, and “the law would not allow it.”

According to experts in international law, the Vatican could have waived diplomatic immunity. In Santo Domingo, there have been small protests and petitions signed by more than a thousand people calling on the Vatican to extradite Mr. Wesolowski to the Dominican Republic. Advocates have accused the government of acquiescing to the church. “We think there has been a lot of impunity in this case, and no transparency,” said Sergia Galván, executive director of the Women and Health Collective, which represents abuse victims. “If he’s no longer a diplomat, if he was stripped of that title, he no longer has immunity.”

The case has reverberated in Poland, where prosecutors have sought to extradite Mr. Wesolowski, who holds both Vatican and Polish citizenship. Poland has indicted another Polish priest, the Rev. Wojciech Gil, who fled the Dominican Republic last year amid allegations that he abused altar boys in his rural parish. Prosecutors in the Dominican Republic say that Father Gil and Mr. Wesolowski spent time with young boys at the nuncio’s beach house.

There are indications from Rome that the pope himself is concerned about the Wesolowski case. A Dominican bishop, Fausto Ramón Mejía, said in an interview that when he was part of a delegation visiting the Vatican late last year, Pope Francis’ smile vanished on hearing what country he was from.

“He became very serious,” said Bishop Mejía. “He stopped and he said to me, very sincerely, ‘I feel as though my heart was crossed by a dagger from what took place in the Dominican Republic.’ ”

The case has shaken this stalwart Catholic nation, but the church has said little. In one group photograph released by the Dominican bishops, Mr. Wesolowski’s face appeared to have been removed from the picture.

“The people used to say, ‘I want my child to go to a Catholic church,’ ” said the Rev. Rogelio Cruz, a Catholic priest here. “Now they say, ‘No child of mine is ever going to a Catholic church.’ ”

SANTO DOMINGO, Dominican Republic - A court in the Dominican Republic has taken the first steps toward possible sexual abuse charges against a former Vatican ambassador to the Caribbean country.

The announcement came a day after the Vatican said its former ambassador had lost his diplomatic immunity.

The Vatican recalled Wesolowski in August 2013 after allegations emerged he had sexually molested boys there.

Dominican officials say his presence is not required in the country for authorities to review an investigation of the allegations and decide whether formal charges are warranted.

After Joseph Ratzinger publicly announced his plans to retire, quite a few people who are aware of this website or the @Fire_the_PopeTwitter account remarked how I got my wish or, jokingly, how my website may have led to the first resignation of a pope in 600 years.

Yes, I’ve had Ratzinger’s picture prominently displayed on this site and, given his long record both as the pope and as the one person responsible for handling all sex-crime cases in the Church, I strongly believed him to be incompetent at best.

However, FireThePope doesn’t just mean fire Joseph Ratzinger. FireThePope isn’t a cause to bring down one man. FireThePope is an effort to expose the entire Roman Catholic Church, as is, as fraudulent and there is no better way to do that than to start at the top.

Not your Father’s church.

The Roman Catholic Church sets itself apart from all other religions, including Christian denominations, by claiming its head, the pope, is the successor of Peter and that Jesus anointed Peter to be the head of his church. The Church points to Matthew 16:13-20 to support this claim. Catholics conclude the Roman Catholic Church is the “one true church” of Jesus Christ and all other Protestant or non-Roman orthodox churches are inferior to it.

Roman Catholics call their church “the bride of Christ” and “Holy Mother Church”. These nicknames market the idea that Roman Catholicism dates back to the days of Jesus Christ and it – or “She”, as they say – is the very foundation of Christianity and all other religions are mere offshoots or sequels to Roman Catholicism.

Ultimately, Roman Catholicism rests solely on the supremacy of Peter and the apostles. Without the supremacy of Peter, there would be no pope. Without the supremacy of the apostles, there would be no priesthood as the Roman Church defines it. Without the superhuman powers of Catholic priests, bye-bye sacraments, indulgences, and the entire institution.

Today, let’s focus on the papacy. Following are ten reasons why there should never be another pope and, if there is, he should be completely ignored by the Catholic laity, the media, politicians, and the public at large.

Because the Vatican bases its very existence on a scene from the New Testament, it must also accept other verses of the NT in order to be consistent. Either the NT should be accepted as true, non-fictional accounts or not. Either those accounts must be taken literally or not. But, one cannot say this is a source of truth, inspired by the Holy Spirit and then pick and choose which passages the Church wants to follow or not.

1. The church of Jesus Christ in the bible was not a physical empire. Matthew 24:1-2 - ”Jesus left the temple precincts then, and his disciples came up and pointed out to him the buildings of the temple area. His comment was: ‘Do you see all these buildings? 2. The church of Jesus Christ was not built upon one man. The idea that the church of Jesus was built upon one man is preposterous. Yet, that is what the Roman Church claims. Its only foundation is the notion that Peter was chosen by Jesus to be the first pope and that all popes are Peter’s successors, chosen by the Holy Spirit and infallible in all of their declarations. Roman Catholicism teaches that the pope, acting on behalf of the Church (notice the capital C indicating the Corporation) has the power and a duty to act as a mediator between the Creator and his creatures. It has been a long-held tradition that the Vatican, the Magisterium, and the clergy would interpret the bible for the laity. However, 1 Corinthians 3:11 reads, “For other foundation no one can lay, but that which has been laid, which is Jesus Christ”. According to scripture, Jesus, not Peter, is the foundation of the Christian church. Jesus is also the sole mediator, so says 1 Timothy 2:5: ”And the truth is this: ‘God is one. One also is the mediator between God and men, the man Christ Jesus, and who gave himself ransom for all.” According to the New Testament where Catholics turn to justify the existence of their Church, there is only one mediator between God and the people and that is Jesus Christ, not Peter and not Joseph Ratzinger.

3. The church of Jesus Christ in the bible did not have a pope.The word pope is not in the bible, where the Roman Church points to as justification for itself. The early church described in the New Testament speaks of bishops who were overseers or local supervisors of the effort to spread Christianity. They were not rulers over the people. No one bishop had authority over any other. No one bishop was the head of the effort. There was a bishop in many major cities, including one in Rome. It so happened that certain Roman emperors (namely Constantine and Charlemagne) elevated the position and authority of the bishop of Rome, specifically, because they had the power to do so and because it was convenient as Rome was the seat of power. Emperors appointed bishops and abbots and usually appointed members of aristocratic families. The idea of a pope – one bishop over all others – was a corrupt power grab by murderous dictators and had nothing to do with Jesus Christ or anything in the bible.

4. The Peter of the throne was not the apostle but an impostor. Remember, the apostle Peter originally went by the name of Simon. Then, he was referred to as Simon Peter. Jesus named him Peter at the rock because the name Peter – or Petros (Greek) means rock. This Peter was from Cyprus, according to the bible. They both had the same name, they both died in the same year – 67 A.D., and they both had spent time in Rome. The proof that the Simon of Samaria, not Cyprus, sat on the throne in Rome is the documentation that Magnus stayed in Rome for many years at a time while the apostle came and went quite often.

5. The apostle Peter never considered himself God or Jesus Christ. Again, the idea of the papacy rests on the supremacy of Peter. The Roman Church claims the pope is “Christ’s (sole) representative on earth”. The Peter whom the popes are supposed to have succeeded was married with at least one child – a daughter. He never sat on a throne and he never claimed to have magic powers or to be infallible. He never claimed to be better or more important than the other apostles or early leaders of the Christian church. He never dressed in fancy clothes, he never wore a ring to be kissed, and he never insisted on the red carpet treatment. Acts 10:25-27: “As Peter entered, Cornelius went to meet him, dropped to his knees before him and bowed low. Peter said, ‘Get up! I am only a man myself.’” When Nero sentenced Peter to death by crucifixion, Peter insisted on hanging on the cross upside down because he was unworthy to die as Jesus died. Peter the apostle, claimed by the Church as the first pope was never a pope and his philosophy and practices, according to the New Testament, were a far contrast to those of the papacy no matter who is holding the title.

6. The Roman Catholic Church was not established until the 4th Century. Roman Catholics claim Peter of the bible was the first pope and that there is an unbroken line of popes stretching from biblical times to present-day. This claim is nothing but a re-writing of history. The Church needs that lineage in order to justify itself and the papacy yet it does not have the facts on its side so they have to create a new reality. What the Church

has done is go back and list anyone who was a bishop of Rome as a pope. The actual papacy didn’t begin until the Roman Catholic Church began and that wasn’t until the 4th Century with Pope Constantine I – the emperor – who ruled from the “chair of St. Peter” from 306-337. Constantine came to the rescue of Christians who were being persecuted by Emperor Diocletian. It’s not that he was overcome by compassion but realized he could take political advantage from the growing number of Christians. This ties the pagan Roman Empire to the Catholic Church whose members also worship objects and offer material sacrifices.

7. The papacy was on life support as recently as 1870. In the mid-19th Century, there was an effort to unify Italy which was split in two by the Papal States governed by the pope, then Pope Pius IX (the one who dreamed up Immaculate Conception). Victor Emmanuel II, the new King of Italy, had seized all of the Church-controlled territory except a small segment of Rome. Napoleon, who had previously been an ally of Emmanuel, protected the pope and by having some of his troops stand guard at the Vatican. When the Franco-Prussia War intensified, Napoleon pulled his troops out of Rome, leaving the pope defenseless. The Italian troops moved in and the pope lost all of his temporal (civil) power minus rule over the tiny territory of the Vatican. Emmanuel allowed the pope to keep the Vatican and freed him from Italian rule but the pope was defiant. Pius IX refused to recognize Emmanuel’s new kingdom and he voluntarily kept himself a prisoner of the Vatican. He cried anti-Catholic bias until support and donations poured in for him, including from Catholics in America. The empire of the Roman Church was all but lost in 1870. It took more deception to keep it alive.

8. The papacy was corruptly propped back up by a fascist dictator. In the 1920′s, the Italian government wished to settle its differences with the Church. At the time, the Prime Minister of Italy was Benito Mussolini.

He conspired with the Vatican to shut out populist factions in the country in order to amass more power and control for himself. The Vatican silenced priests who favored a more democratic government. In return, Mussolini gifted the Church by officially recognizing the Vatican as an independent and sovereign city-state. Within the borders of Italy, popes would receive diplomatic immunity and the Church would receive financial reparations for its loss of the Papal States. Also, Roman Catholicism would be the one state religion in Italy. These agreements were called the Lateran Pacts and they are what revived the much weakened papacy. Mussolini would go on to become one of history’s most brutal dictators. Today, Vatican City, the whole 0.2 square miles of it, is recognized by the United Nations as a sovereign city-state of which the pope is head.

9. The pope is an absolute monarch at a time when most educated and reasonable human beings believe in freedom, democracy, and accountability. In 2011, the world witnessed what is now referred to as The Arab Spring. Ordinary people protested – many to their deaths – for freedom, respect, and democratic elections. Many citizens of some nations in the Middle East had been oppressed for generations and they finally decided it was time to take a stand against tyranny. It has been said there is a natural hunger to live freely, no matter what part of the world one lives. The pope is an absolute monarch, only one of a few that still exist and certainly the most powerful. As such, and because he enjoys diplomatic immunity both in Italy and out, he is accountable to no one. The pope is elected but not by the people he represents as in a democracy. He is elected by the same men whom he appointed to the College of Cardinals. Once a pope takes office, he is unaccountable to anyone inside the Church or out. This type of power is contrary to what the New Testament described when Jesus turned tables on the clergy. The pope, like Simon Magnus, claims to be God. Only someone with a God-complex would claim to be above the law and every other human being.

10. The papacy is not inspired by the Holy Spirit. If anything, it would be inspired by the spirit of Lucifer. As construction workers ready the Vatican chimney for the upcoming puffs of white smoke or black,

rational human beings are expected to believe that the Holy Spirit is guiding the process of the papal conclave. When cardinals vote a certain way, we are told, it was because the Holy Spirit told them to. It’s time for a reality check. Many of the men who will be voting – or running – for the next pope have blood on their hands – blood ofchildren. Yet, we are supposed to believe they have an inside track to the Holy Spirit. From the beginning of the Roman Catholic Church, throughout its history, and including today, Roman Catholicism has been a corrupt empire disguised as a Christian religion. I’ve heard many people credit it merely because “it has been around for 2,000 years”. It hasn’t been around that long and does it matter that it has only survived as long has it has because it has succeeded in fooling gullible people? Does it matter that it has grown as large as it has because many of its converts joined only under the threat of death? Does it matter than the majority of Catholics were entered into the Church before the age of reason? Catholics are quick to remind us of “all the good the Church does”. There isn’t a tyrant in history that couldn’t claim the same. Evil almost always presents itself in disguise – as something good. When deception is the foundation of an institution, no amount of superficial acts that come out of it can make it good. Deeds and institutions can only be good if they are based in truth. Like it or not, the spirit that is guiding the Roman Catholic Church isn’t holy, it is evil. And the only way to kill a serpent is by chopping off its head.

There’s an elephant quietly sitting in the nave that everyone on all sides of the clergy sex abuse crisis have been diligently ignoring, even the victims themselves. No clergy or even would-be reformers have really remarked on it yet, although it should be more obvious with each and every sad story. More importantly, it is a troubling issue that touches on the very heart and soul of Catholicism.

The monstrous truth is simply this: what the clergy sex abuse crisis clearly demonstrates is that the sacramental system has failed.

This is not just a case of hierarchical reneging of responsibility.There’s more to this than some bad apples. This is nothing that a few reforms can fix, some screening of seminarians or more pastoral responses by bishops. It is nothing less than a fundamental challenge to the entire Catholic Church, and it shows that the spiritual principles the whole structure is supposedly based on simply do not work.

Think about it. The offenders here are Roman Catholic priests, highly trained men. But unlike other professionals, these men are supposedly set apart and dedicated to lives of the spirit. They claim to have the power to forgive sins and make God appear.

They not only administer the sacraments to others, but also receive them themselves daily. That means, among other things, frequent confession to other priests. Moreover, many of these men belong to religious orders or are otherwise under close spiritual direction. They are supposed to confide everything to their confessors and superiors and to obey them unquestioningly.

So what went wrong? When an abusive priest goes to confession, does he start, “Bless me, father, for I have sinned: I buggered an altar boy three times this week”? And does the confessor tell him to say 3 Our Fathers and 4 Hail Marys and not to do it again?

According to their own theory, confessors have the power to forgive sins, but also to refuse to do so if sorrow is insufficient. Moreover, they are to appoint penances – if they wish, they can require satisfaction or significant signs of reform from the penitent before absolution. Some sins – such as solicitation for sex in the confessional – are even deemed so serious that only higher prelates, sometimes only the Pope or his appointed delegate can forgive them.

Yet the abusers continue to abuse. So are the sexually active priestslying to their confessors? This would mean that not only do the perpetrating priests remain in a state of mortal sin and are automatically excommunicated, they perform the sacraments in that state which is itself a grave sacrilege.

Or, even worse, are all the abusive priests linked? Do they only go to confession to like-minded perps who will understand? Is there then an organized network of sexually perpetrating priests, all busily enabling each other? This adds collusion and conspiracy to the sinand would indicate that the very structure itself is rotten to the core.

The evidence available suggests that perhaps both scenarios are true to varying degrees in different situations. Either way, however, the result is much the same.

The sacraments are meant to unite believers with Christ. Not just to remove the accumulations of sin like the weekly laundry, but togradually improve the recipient. They are intended to sanctify and uplift the faithful, increase devotion to God, charity to fellow humans, and moral stamina in the face of evil.

If the sacraments actually worked like this, wouldn’t we hear ennobling stories of clerical reform, of some molester inspired to truly repent and devote himself to the cause? But rather, the stories are depressingly the same, of priests caught time and again, transferred, treated, and now finally, laicized often against their will, with no regret or even acknowledgement of their evil.

What this means, each person must decide in their own conscience. But perhaps the fall off in confessions over the years itself tells the story. Why should anyone, lay or not, risk a ritual that seems so impotent in promoting reform and may, instead of granting grace, actually expose them to greater human wickedness?
