Statement by the Taoiseach on the Dáil Motion on the report of the Commission of Investigation into the Catholic Diocese of Cloyne
"The revelations of the Cloyne report have brought the Government, Irish Catholics and the Vatican to an unprecedented juncture.
It's fair to say that after the Ryan and Murphy Reports Ireland is, perhaps, unshockable when it comes to the abuse of children.
But Cloyne has proved to be of a different order.
Because for the first time in Ireland, a report into child sexual-abuse exposes an attempt by the Holy See, to frustrate an Inquiry in a sovereign, democratic republic.as little as three years ago, not three decades ago.
And in doing so, the Cloyne Report excavates the dysfunction, disconnection, elitism....the narcissism that dominate the culture of the Vatican to this day.
The rape and torture of children were downplayed or 'managed' to uphold instead, the primacy of the institution, its power, standing and 'reputation'.
Far from listening to evidence of humiliation and betrayal with St Benedict's 'ear of the heart'......the Vatican's reaction was to parse and analyse it with the gimlet eye of a canon lawyer.
This calculated, withering position being the polar opposite of the radicalism, humility and compassion upon which the Roman Church was founded.
The radicalism, humility and compassion which are the very essence of its foundation and purpose.
The behaviour being a case of Roma locuta est: causa finita est.
Except in this instance, nothing could be further from the truth.
Victims
Cloyne's revelations are heart-breaking. It describes how many victims continued to live in the small towns and parishes in which they were reared and in which they were abused. their abuser often still in the area and still held in high regard by their families and the community.
The abusers continued to officiate at family weddings and funerals. In one case, the abuser even officiated at the victim's own wedding.
There is little I or anyone else in this House can say to comfort that victim or others, however much we want to. But we can and do recognise the bravery of all of the victims who told their stories to the Commission.
While it will take a long time for Cloyne to recover from the horrors uncovered, it could take the victims and their families a lifetime to pick up the pieces of their shattered existence.
Papal Nuncio
A day post-publication, the Tánaiste and Minister for Foreign Affairs and Trade met with the Papal Nuncio to Ireland, Archbishop Giuseppe Leanza.
The Tánaiste left the Archbishop clear on two things: The gravity of the actions and attitude of the Holy See.
And Ireland's complete rejection and abhorrence of same.
The Papal Nuncio undertook to present the Cloyne Report to the Vatican. The Government awaits the considered response of the Holy See.
I believe that the Irish people, including the very many faithful Catholics who - like me - have been shocked and dismayed by the repeated failings of Church authorities to face up to what is required, deserve and require confirmation from the Vatican that they do accept, endorse and require compliance by all Church authorities here with, the obligations to report all cases of suspected abuse, whether current or historical, to the State's authorities in line with the Children First National Guidance which will have the force of law.
Clericalism
Clericalism has rendered some of Ireland's brightest, most privileged and powerful men, either unwilling or unable to address the horrors cited in the Ryan and Murphy Reports.
This Roman Clericalism must be devastating for good priests.... some of them old... others struggling to keep their humanity....even their sanity........as they work so hard.....to be the keepers of the Church's light and goodness within their parishes...... communities... the human heart.
Church & State
But thankfully for them, and for us, this is not Rome.
Nor is it industrial-school or Magdalene Ireland, where the swish of a soutane smothered conscience and humanity and the swing of a thurible ruled the Irish-Catholic world.
This is the 'Republic' of Ireland 2011.
A Republic of laws.....of rights and responsibilities....of proper civic order..... where the delinquency and arrogance of a particular version..... of a particular kind of 'morality'..... will no longer be tolerated or ignored.
As a practising Catholic, I don't say any of this easily. Growing up, many of us in here learned we were part of a pilgrim Church.
Today, that Church needs to be a penitent Church. A church, truly and deeply penitent for the horrors it perpetrated, hid and denied.
In the name of God. But for the good of the institution.
When I say that through our legislation, through our Government's action to put Children First., those who have been abused can take some small comfort in knowing that they belong to a nation, to a democracy where humanity, power, rights, responsibility are enshrined and enacted, always....always.... for their good.
Where the law - their law - as citizens of this country, will always supercede canon laws that have neither legitimacy nor place in the affairs of this country.
State/Society
This report tells us a tale of a frankly brazen disregard for protecting children. If we do not respond swiftly and appropriately as a State, we will have to prepare ourselves for more reports like this.
I agree with Archbishop Martin that the Church needs to publish any other and all other reports like this as soon as possible.
I must note the Commission is very positive about the work of the National Board for Safeguarding Children, established by the Church to oversee the operation by Dioceses and religious orders. The Commission notes that all Church authorities were required to sign a contract with the National Board agreeing to implement the relevant standards and that those refusing to sign would be named in the Board's Annual Report. Progress has been in no small measure to the commitment of Ian Elliott and others.
There is some small comfort to be drawn by the people of Cloyne from the fact that the Commission is complimentary of the efforts made by the Diocese since 2008, in training, in vetting personnel and in the risk management of Priests against whom allegations have been made.
Nevertheless, the behaviour of Bishop Magee and Monsignor O'Callaghan show how fragile even good standards and policies are to the weakness and wilful disregard of those who fail to give the right priority to safeguarding our children.
But if the Vatican needs to get its house in order, so does this State.
The Report of the Commission is rightly critical of the entirely unsatisfactory position which the last Government allowed to persist over many years.
The unseemly bickering between the Minister for Children and the HSE over the statutory powers to deal with extra-familial abuse, the failure to produce legislation to enable the exchange of soft information as promised after the Ferns Enquiry, and the long period of confusion and disjointed responsibility for child protection within the HSE, as reported by the Commission, are simply not acceptable in a society which values children and their safety.
For too long Ireland has neglected its children.
Just last week we saw a case of the torture of children, within the family, come before the courts. Just two days ago, we were repulsed by the case of a Donegal registered sex offender.and school caretaker.
Children and young adults reduced to human wreckage, raising questions and issues of serious import for State agencies.
We are set to embark on a course of action to ensure the State is doing all it can to safeguard our children.
Minister Shatter is bringing forward two pieces of legislation - firstly, to make it an offence to withhold information relating to crimes against children and vulnerable adults; and secondly, at long last, to allow for the exchange of 'soft information' on abusers.
As Taoiseach, I want to do all I can to protect the sacred space of childhood and to restore its innocence.
Especially our young teenagers, whom I believe to be children. Because regardless of our current economic crisis, the children of this country are, and always will be, our most precious possession of all.
Safeguarding their integrity and innocence must be a national priority. This is why I undertook to create a Cabinet ministry for Children and Youth Affairs.
The legislation 'Children First' proposes to give our children maximum protection and security without intruding on the hectic, magical business of being a child.
Conclusion
Cardinal Josef Ratzinger said: 'Standards of conduct appropriate to civil society or the workings of a democracy cannot be purely and simply applied to the Church.'
As the Holy See prepares its considered response to the Cloyne Report, as Taoiseach, I am making it absolutely clear, that when it comes to the protection of the children of this State, the standards of conduct which the Church deems appropriate to itself, cannot and will not, be applied to the workings of democracy and civil society in this republic.
Not purely, or simply or otherwise.

(RTTNews) - Irish Prime Minister Enda Kenny on Wednesday took the Catholic Church to task for trying to cover up cases of sexual abuse of minors by members of the clergy, and warned that relations between the Church and the Irish State would not be the same after the recent revelations.
Kenny made the remarks during a parliamentary debate on a recent report which highlighted the inappropriate response of the Church to complaints of sexual abuse against clerics in the diocese of Cloyne, southern Ireland. The report, which focused on the area around the southern city of Cork, was released last week.
Kenny told the Lower House of the Irish Parliament, or the Dail, that it was for the first time in the history of Ireland that a report into "child sexual abuse exposes an attempt by the Holy See to frustrate an inquiry in a sovereign, democratic republic as little as three years ago, not three decades ago."
Kenny said the Cloyne report highlighted the "dysfunction, disconnection, elitism and narcissism that dominate the culture of the Vatican to this day." He also noted that the Church's failure to take appropriate action on the complaints contradicted the principles of "radicalism, the humility and the compassion that the Church had been founded on."
The report had concluded that response of the Church authorities to abuse complaints made in the diocese of Cloyne between 1996 and 2009 was "inadequate and inappropriate."
The report singled out former Cloyne bishop John Magee for the Church's inadequate response to the abuse complaints, saying Magee had "to a certain extent detached himself from the day to day management of child abuse cases."
Magee had resigned in March 2010 after an independent inquiry commissioned by the Church into allegations of child abuse in the diocese found him and his senior diocesan aides guilty of failing to report the abuse allegations to the police.
His resignation came two years ahead of the normal retirement age for a bishop. He had previously served as personal secretary to three Popes -- Paul VI, John Paul I and John Paul II.
Prior to his quitting, an Irish government-ordered investigation into the alleged cover-up of child-abuse cases in the Dublin archdiocese had alleged that the Catholic Church in Ireland had "obsessively" hidden "widespread" child abuse by several priests from 1975 to 2004.
The damning report submitted in November 2009 by the Dublin archdiocese commission of investigation also criticized the way in which the archdiocese handled priests suspected of involvement in such child abuse cases, adding that it operated on a policy of "don't ask, don't tell" regarding the reported abuse cases.
The developments came amid damages caused to reputation of the Catholic Church in several countries, including Germany, the Netherlands, Austria and the United States, by sexual abuse scandals involving the clergy.
Many of these nations have initiated independent probes into sex-abuse allegations. The scandals have already forced several bishops in many countries to step down. In the wake of the scandals, the Vatican has issued new guidelines to bishops across the world for handling all suspected abuse cases involving members of the clergy, including the reporting of all such cases to the police.

There are two parallel revolutions taking place on either side of the Irish Sea that will radically alter the relationship between government and non-state institutions that exercise major temporal power.
In Britain the ongoing revelations of wrongdoing within the Murdoch empire and the public humiliation of a media baron and his son may result in re-alignment in the relationship between politicians and the press, with the former becoming less supplicant to the latter.
One of the most important by-products of the last few incredible weeks has been the end of fear. Specifically, fear of media tycoons who used to boast that some of their newspapers had "won" elections and had left the prime ministerial ambitions of party leaders in ruins. The humbling of Murdoch Senior and Junior this week marked the end of that fear.
Meanwhile, here in Ireland the political classes have also lost their fear, namely of the once almighty Roman Catholic church. The news reports both in the Republic and the UK were not exaggerating on Wednesday.

An Irish Senator has called on the entire hierarchy of the country’s Catholic Church to resign, as a rift appears between the state and the Vatican over child sex abuse by priests.
The move by Fine Gael Senator Martin Conway follows a report last week that found church authorities in the diocese of Cloyne in County Cork had failed to report many abuse cases.
It said the Vatican had disparaged Irish child protection guidelines in a letter to Irish bishops.
On Wednesday Ireland’s parliament rebuked the Vatican for undermining child protection frameworks.
Prime Minister Enda Kenny launched an attack on the Church that was unprecedented from an Irish Taoiseach.
“The Cloyne report excavates the dysfunction, the disconnection, the elitism that dominate the culture of the Vatican today. The rape and torture of children were downplayed, and managed to uphold instead the primacy of the institution, its power, its standing and its reputation,” he said.

THE image of Ireland, and in particular of our politicians, has taken a battering in the international media over the past 24 months.
Sporting and cultural successes have gone a long way towards improving this image, but our economic and political woes have remained the subject of headlines around the globe.
Talk of bailouts and bankers has dominated the news across the world.
When Enda Kenny stood up in the Dail on Wednesday to deliver a speech on the Cloyne Report, nobody anticipated either its content or the reaction to it -- both in Ireland and internationally.
In less than 48 hours, more than 1,000 articles had been published in over 800 publications in 64 countries around the world, referencing the Taoiseach's speech.
To put these figures in some context, the coverage is more than double that in the wake of Brian Cowen's infamous interview on 'Morning Ireland' last September.
In addition to news agencies such as Reuters and AP -- who by covering the story ensured its global spread -- many international agenda-setting publications wrote about the speech.
These included the BBC, CNN, 'The New York Times', 'San Francisco Chronicle', the 'Financial Times', 'The Wall Street Journal' and 'The Sydney Morning Herald'.
Impact

True, Enda Kenny did not speak with Thomas Davis's voice like thunder. But his words fell like a thunderbolt, followed by a forked lightning of illumination that lit up the Irish historical landscape, past and present, and showed us a far better future.
Like Bach's great Lutheran hymn Wachet Auf! (Sleepers Awake!), Kenny's speech called on the Roman Catholic officer class to wake from their sleep of the spirit. But it went on to warn them that if they cannot reform their religion, they must still live by the laws of the Irish Republic. Accordingly, its implications went far beyond the issue of child abuse which it formally addressed
Kenny's revolutionary speech was not simply a rebuke to the Vatican. It called for reform of the Roman Catholic Church, confirmed that Home Rule did not mean Rome rule, and returned the word "republic" to the Northern Protestants to whom it originally belonged. Like all great speeches it had good authority, slew a sacred cow, and spoke the truths that set us free.
By good authority I mean that only someone like Kenny, himself a practising Roman Catholic, could have taken on his own side and survived. By speaking from inside the fold he gave the rest of the Irish Roman Catholic flock the courage to show the door to the bad shepherds. But he was not the only Catholic layman to give a lead last week...
Kenny's speech also slew a sacred cow, more precisely a Papal bull, more precisely still a Papal bully, namely the Vatican's praetorian guard and its pretension to a global remit. By rejecting that remit in the Irish Republic, Kenny rescued the word "republican" from any taint of Rome, and freed it up for future use by Northern Protestants.
The speech should also encourage southern Protestants to follow Bishop Paul Colton's lead in putting their heads firmly above the parapet of public life. This must go beyond engaging in empty ecumenical gestures. Southern Protestants should seek an accounting for the sectarian actions of southern Catholic nationalism between 1908-1922....
Faced with the Old IRA's sectarian actions in the Bandon Valley, at Coolacrease and at Clifden Orphanage (to name only a few), some academic historians have reacted exactly as Catholic apologists did to the charge of clerical sex abuse. To borrow the words of Kenny's scathing summary, instead of hearing the sufferings of southern Protestants with St Benedict's "ear of the heart' they preferred 'to parse and analyse it with the gimlet eye of a canon lawyer".
Real republicans should be in the front ranks in publicising the sufferings of Irish Protestants in the period 1919-22. Because what happened frightened them into a forced amnesia about the actions of the IRA, and to politically keep their heads down. And that timidity, in turn, confirmed the fears of Northern Protestants that some subjects were taboo in the Irish Republic.
Even as committed an apologist for Irish republicanism as the Portadown Presbyterian George Gilmore found he had a breaking point. In a 1951 essay entitled 'The Republic and the Protestants' published in Sean O Faolain's The Bell, Gilmore listed public incidents which grated on his Protestant sensibilities:
"Presidential pledges of loyalty of 'the Irish people' to the Pope, lord mayoral pledges of the loyalty of the 'people of Dublin' to the Pope, of 'the people of County Dublin' to the Pope. Even the Congress of Trade Unions has pledged the loyalty of 'its' members to the Pope. When is a Portadown man an Irishman?"
Gilmore called on southern Protestants to object to their loyalty being pledged to a foreign power and concluded with these prophetic words: "If the influential leaders of Irish Protestantism did make such a protest, I have no doubt that a formula would readily be found whereby Irish Roman Catholics could emphasise their own religious loyalties consistently with recognition of the fact that something like one quarter of the Irish people have no such loyalty."
An old cliche claims all political careers end in failure. Political failure maybe, but not historical failure. Churchill, Gorbachev and Mandela are proof of that.
So even if Enda Kenny's government finally ends in economic tears, last week's courageous and cathartic speech will ensure him an enduring and honoured place in the history of Ireland.

Taoiseach Enda Kenny today launched an unprecedented attack on the Vatican, accusing Catholic hierarchy of putting the preservation of the church's reputation ahead of child rape victims.
In a damning assessment of Rome's attitude to paedophile priests, Mr Kenny claimed the latest inquiry into clerical abuse cover-ups has exposed a dysfunctional, elite hierarchy determined to frustrate investigations.
The Holy See was also warned that religion does not rule Ireland.
"For the first time in Ireland, a report into child sexual abuse exposes an attempt by the Holy See to frustrate an inquiry in a sovereign, democratic republic as little as three years ago, not three decades ago," he said.
"And in doing so, the Cloyne report excavates the dysfunction, disconnection, elitism, the narcissism that dominate the culture of the Vatican to this day.
"The rape and torture of children were downplayed or 'managed' to uphold instead, the primacy of the institution, its power, standing and 'reputation'."
The Taoiseach's attack, which opened a special Dáil debate, followed the publication last week of the fourth major report in six years into the Church's cover-ups of clerical abuse.
Cloyne Diocese in Co Cork is the latest part of the Church to be exposed with former bishop John Magee - a Vatican aide to three Popes - singled out for misleading investigators and "dangerous" failures on child protection. His resignation was accepted by Pope Benedict last year.
On one occasion he was found to have written two different reports on an abuse allegation - one for Rome and one for diocesan records.
The Taoiseach went on to describe the Vatican of having a "calculated withering position" on clerical abuse, which he said was "the polar opposite of the radicalism, the humility and the compassion upon which the Roman Church was founded".
Mr Kenny said the Vatican's reaction to evidence from victims of abuse was to have it parsed and analysed by a canon lawyer.
"This is not Rome," he said. "Nor is it industrial school or Magdalene Ireland, where the swish of a soutane-smothered conscience and humanity and the swing of a thurible ruled the Irish Catholic world.
"This is the Republic of Ireland 2011.
"A republic of laws, of rights and responsibilities, of proper civic order, where the delinquency and arrogance of a particular version of a particular kind of morality will no longer be tolerated or ignored."
The Taoiseach's condemnation came on the back of the first official comment from a Holy See spokesman to the Cloyne report.
On Vatican radio, Fr Federico Lombardi dismissed criticism and denied that Irish bishops were encouraged or advised to cover up clerical abuse or evade laws designed to protect children.
Fr Lombardi said he was not speaking on behalf of Pope Benedict and claimed the severity of criticisms against the Holy See was curious.
The Cloyne scandal goes as high as the Vatican after the inquiry criticised a 1997 letter from the Papal Nuncio, Rome's ambassador to Ireland, to Irish bishops.
The Cloyne report described the response to the clerics' plans to improve child protection policy as "entirely unhelpful".
"There is no reason to interpret that letter as being intended to cover up cases of abuse," Fr Lombardi said.
"Moreover, there is absolutely nothing in the letter that is an invitation to disregard the laws of the country."
The Government is awaiting an official response to the Cloyne scandal from the current Papal Nuncio, Archbishop Giuseppe Leanza.
The Catholic Church has been left reeling from four reports into clerical child abuse in the last six years - the Dublin Archdiocese and the Ryan inquiry into industrial schools and homes in 2009, the Ferns Diocese in 2005 and just last week, Cloyne, which relates to abuse complaints and investigations as recent as 2008.
Archbishop of Dublin Diarmuid Martin has called for internal reports on all Irish dioceses by the Church's own watchdog, the National Board for the Safeguarding of Children in the Catholic Church, to be published as soon as possible. Mr Kenny backed his call.
Mr Kenny said clericalism had rendered some of Ireland's brightest and most privileged and powerful men either unwilling or unable to address the horrors in the Ryan and Murphy reports. He said this Roman clericalism must be devastating for "good priests".
The Government has committed to tough new child protection in the wake of Cloyne, including making it an offence to withhold information about crimes against children and introduce new vetting to allow "soft information" transfers.
Mr Kenny said: "As the Holy See prepares its considered response to the Cloyne report, as Taoiseach I am making it absolutely clear that when it comes to the protection of the children of this state, the standards of conduct which the church deems appropriate to itself cannot and will not be applied to the workings of democracy and civil society in this republic."

Statement by the Taoiseach on the Dáil Motion on the report of the Commission of Investigation into the Catholic Diocese of Cloyne
"The revelations of the Cloyne report have brought the Government, Irish Catholics and the Vatican to an unprecedented juncture.
It's fair to say that after the Ryan and Murphy Reports Ireland is, perhaps, unshockable when it comes to the abuse of children.
But Cloyne has proved to be of a different order.
Because for the first time in Ireland, a report into child sexual-abuse exposes an attempt by the Holy See, to frustrate an Inquiry in a sovereign, democratic republic.as little as three years ago, not three decades ago.
And in doing so, the Cloyne Report excavates the dysfunction, disconnection, elitism....the narcissism that dominate the culture of the Vatican to this day.
The rape and torture of children were downplayed or 'managed' to uphold instead, the primacy of the institution, its power, standing and 'reputation'.
Far from listening to evidence of humiliation and betrayal with St Benedict's 'ear of the heart'......the Vatican's reaction was to parse and analyse it with the gimlet eye of a canon lawyer.
This calculated, withering position being the polar opposite of the radicalism, humility and compassion upon which the Roman Church was founded.
The radicalism, humility and compassion which are the very essence of its foundation and purpose.
The behaviour being a case of Roma locuta est: causa finita est.
Except in this instance, nothing could be further from the truth.
Victims
Cloyne's revelations are heart-breaking. It describes how many victims continued to live in the small towns and parishes in which they were reared and in which they were abused. their abuser often still in the area and still held in high regard by their families and the community.
The abusers continued to officiate at family weddings and funerals. In one case, the abuser even officiated at the victim's own wedding.
There is little I or anyone else in this House can say to comfort that victim or others, however much we want to. But we can and do recognise the bravery of all of the victims who told their stories to the Commission.
While it will take a long time for Cloyne to recover from the horrors uncovered, it could take the victims and their families a lifetime to pick up the pieces of their shattered existence.
Papal Nuncio
A day post-publication, the Tánaiste and Minister for Foreign Affairs and Trade met with the Papal Nuncio to Ireland, Archbishop Giuseppe Leanza.
The Tánaiste left the Archbishop clear on two things: The gravity of the actions and attitude of the Holy See.
And Ireland's complete rejection and abhorrence of same.
The Papal Nuncio undertook to present the Cloyne Report to the Vatican. The Government awaits the considered response of the Holy See.
I believe that the Irish people, including the very many faithful Catholics who - like me - have been shocked and dismayed by the repeated failings of Church authorities to face up to what is required, deserve and require confirmation from the Vatican that they do accept, endorse and require compliance by all Church authorities here with, the obligations to report all cases of suspected abuse, whether current or historical, to the State's authorities in line with the Children First National Guidance which will have the force of law.
Clericalism
Clericalism has rendered some of Ireland's brightest, most privileged and powerful men, either unwilling or unable to address the horrors cited in the Ryan and Murphy Reports.
This Roman Clericalism must be devastating for good priests.... some of them old... others struggling to keep their humanity....even their sanity........as they work so hard.....to be the keepers of the Church's light and goodness within their parishes...... communities... the human heart.
Church & State
But thankfully for them, and for us, this is not Rome.
Nor is it industrial-school or Magdalene Ireland, where the swish of a soutane smothered conscience and humanity and the swing of a thurible ruled the Irish-Catholic world.
This is the 'Republic' of Ireland 2011.
A Republic of laws.....of rights and responsibilities....of proper civic order..... where the delinquency and arrogance of a particular version..... of a particular kind of 'morality'..... will no longer be tolerated or ignored.
As a practising Catholic, I don't say any of this easily. Growing up, many of us in here learned we were part of a pilgrim Church.
Today, that Church needs to be a penitent Church. A church, truly and deeply penitent for the horrors it perpetrated, hid and denied.
In the name of God. But for the good of the institution.
When I say that through our legislation, through our Government's action to put Children First., those who have been abused can take some small comfort in knowing that they belong to a nation, to a democracy where humanity, power, rights, responsibility are enshrined and enacted, always....always.... for their good.
Where the law - their law - as citizens of this country, will always supercede canon laws that have neither legitimacy nor place in the affairs of this country.
State/Society
This report tells us a tale of a frankly brazen disregard for protecting children. If we do not respond swiftly and appropriately as a State, we will have to prepare ourselves for more reports like this.
I agree with Archbishop Martin that the Church needs to publish any other and all other reports like this as soon as possible.
I must note the Commission is very positive about the work of the National Board for Safeguarding Children, established by the Church to oversee the operation by Dioceses and religious orders. The Commission notes that all Church authorities were required to sign a contract with the National Board agreeing to implement the relevant standards and that those refusing to sign would be named in the Board's Annual Report. Progress has been in no small measure to the commitment of Ian Elliott and others.
There is some small comfort to be drawn by the people of Cloyne from the fact that the Commission is complimentary of the efforts made by the Diocese since 2008, in training, in vetting personnel and in the risk management of Priests against whom allegations have been made.
Nevertheless, the behaviour of Bishop Magee and Monsignor O'Callaghan show how fragile even good standards and policies are to the weakness and wilful disregard of those who fail to give the right priority to safeguarding our children.
But if the Vatican needs to get its house in order, so does this State.
The Report of the Commission is rightly critical of the entirely unsatisfactory position which the last Government allowed to persist over many years.
The unseemly bickering between the Minister for Children and the HSE over the statutory powers to deal with extra-familial abuse, the failure to produce legislation to enable the exchange of soft information as promised after the Ferns Enquiry, and the long period of confusion and disjointed responsibility for child protection within the HSE, as reported by the Commission, are simply not acceptable in a society which values children and their safety.
For too long Ireland has neglected its children.
Just last week we saw a case of the torture of children, within the family, come before the courts. Just two days ago, we were repulsed by the case of a Donegal registered sex offender.and school caretaker.
Children and young adults reduced to human wreckage, raising questions and issues of serious import for State agencies.
We are set to embark on a course of action to ensure the State is doing all it can to safeguard our children.
Minister Shatter is bringing forward two pieces of legislation - firstly, to make it an offence to withhold information relating to crimes against children and vulnerable adults; and secondly, at long last, to allow for the exchange of 'soft information' on abusers.
As Taoiseach, I want to do all I can to protect the sacred space of childhood and to restore its innocence.
Especially our young teenagers, whom I believe to be children. Because regardless of our current economic crisis, the children of this country are, and always will be, our most precious possession of all.
Safeguarding their integrity and innocence must be a national priority. This is why I undertook to create a Cabinet ministry for Children and Youth Affairs.
The legislation 'Children First' proposes to give our children maximum protection and security without intruding on the hectic, magical business of being a child.
Conclusion
Cardinal Josef Ratzinger said: 'Standards of conduct appropriate to civil society or the workings of a democracy cannot be purely and simply applied to the Church.'
As the Holy See prepares its considered response to the Cloyne Report, as Taoiseach, I am making it absolutely clear, that when it comes to the protection of the children of this State, the standards of conduct which the Church deems appropriate to itself, cannot and will not, be applied to the workings of democracy and civil society in this republic.

(RTTNews) - Irish Prime Minister Enda Kenny on Wednesday took the Catholic Church to task for trying to cover up cases of sexual abuse of minors by members of the clergy, and warned that relations between the Church and the Irish State would not be the same after the recent revelations.
Kenny made the remarks during a parliamentary debate on a recent report which highlighted the inappropriate response of the Church to complaints of sexual abuse against clerics in the diocese of Cloyne, southern Ireland. The report, which focused on the area around the southern city of Cork, was released last week.
Kenny told the Lower House of the Irish Parliament, or the Dail, that it was for the first time in the history of Ireland that a report into "child sexual abuse exposes an attempt by the Holy See to frustrate an inquiry in a sovereign, democratic republic as little as three years ago, not three decades ago."
Kenny said the Cloyne report highlighted the "dysfunction, disconnection, elitism and narcissism that dominate the culture of the Vatican to this day." He also noted that the Church's failure to take appropriate action on the complaints contradicted the principles of "radicalism, the humility and the compassion that the Church had been founded on."
The report had concluded that response of the Church authorities to abuse complaints made in the diocese of Cloyne between 1996 and 2009 was "inadequate and inappropriate."
The report singled out former Cloyne bishop John Magee for the Church's inadequate response to the abuse complaints, saying Magee had "to a certain extent detached himself from the day to day management of child abuse cases."
Magee had resigned in March 2010 after an independent inquiry commissioned by the Church into allegations of child abuse in the diocese found him and his senior diocesan aides guilty of failing to report the abuse allegations to the police.
His resignation came two years ahead of the normal retirement age for a bishop. He had previously served as personal secretary to three Popes -- Paul VI, John Paul I and John Paul II.
Prior to his quitting, an Irish government-ordered investigation into the alleged cover-up of child-abuse cases in the Dublin archdiocese had alleged that the Catholic Church in Ireland had "obsessively" hidden "widespread" child abuse by several priests from 1975 to 2004.
The damning report submitted in November 2009 by the Dublin archdiocese commission of investigation also criticized the way in which the archdiocese handled priests suspected of involvement in such child abuse cases, adding that it operated on a policy of "don't ask, don't tell" regarding the reported abuse cases.
The developments came amid damages caused to reputation of the Catholic Church in several countries, including Germany, the Netherlands, Austria and the United States, by sexual abuse scandals involving the clergy.
Many of these nations have initiated independent probes into sex-abuse allegations. The scandals have already forced several bishops in many countries to step down. In the wake of the scandals, the Vatican has issued new guidelines to bishops across the world for handling all suspected abuse cases involving members of the clergy, including the reporting of all such cases to the police.

There are two parallel revolutions taking place on either side of the Irish Sea that will radically alter the relationship between government and non-state institutions that exercise major temporal power.
In Britain the ongoing revelations of wrongdoing within the Murdoch empire and the public humiliation of a media baron and his son may result in re-alignment in the relationship between politicians and the press, with the former becoming less supplicant to the latter.
One of the most important by-products of the last few incredible weeks has been the end of fear. Specifically, fear of media tycoons who used to boast that some of their newspapers had "won" elections and had left the prime ministerial ambitions of party leaders in ruins. The humbling of Murdoch Senior and Junior this week marked the end of that fear.
Meanwhile, here in Ireland the political classes have also lost their fear, namely of the once almighty Roman Catholic church. The news reports both in the Republic and the UK were not exaggerating on Wednesday.

An Irish Senator has called on the entire hierarchy of the country’s Catholic Church to resign, as a rift appears between the state and the Vatican over child sex abuse by priests.
The move by Fine Gael Senator Martin Conway follows a report last week that found church authorities in the diocese of Cloyne in County Cork had failed to report many abuse cases.
It said the Vatican had disparaged Irish child protection guidelines in a letter to Irish bishops.
On Wednesday Ireland’s parliament rebuked the Vatican for undermining child protection frameworks.
Prime Minister Enda Kenny launched an attack on the Church that was unprecedented from an Irish Taoiseach.
“The Cloyne report excavates the dysfunction, the disconnection, the elitism that dominate the culture of the Vatican today. The rape and torture of children were downplayed, and managed to uphold instead the primacy of the institution, its power, its standing and its reputation,” he said.

THE image of Ireland, and in particular of our politicians, has taken a battering in the international media over the past 24 months.
Sporting and cultural successes have gone a long way towards improving this image, but our economic and political woes have remained the subject of headlines around the globe.
Talk of bailouts and bankers has dominated the news across the world.
When Enda Kenny stood up in the Dail on Wednesday to deliver a speech on the Cloyne Report, nobody anticipated either its content or the reaction to it -- both in Ireland and internationally.
In less than 48 hours, more than 1,000 articles had been published in over 800 publications in 64 countries around the world, referencing the Taoiseach's speech.
To put these figures in some context, the coverage is more than double that in the wake of Brian Cowen's infamous interview on 'Morning Ireland' last September.
In addition to news agencies such as Reuters and AP -- who by covering the story ensured its global spread -- many international agenda-setting publications wrote about the speech.
These included the BBC, CNN, 'The New York Times', 'San Francisco Chronicle', the 'Financial Times', 'The Wall Street Journal' and 'The Sydney Morning Herald'.
Impact

True, Enda Kenny did not speak with Thomas Davis's voice like thunder. But his words fell like a thunderbolt, followed by a forked lightning of illumination that lit up the Irish historical landscape, past and present, and showed us a far better future.
Like Bach's great Lutheran hymn Wachet Auf! (Sleepers Awake!), Kenny's speech called on the Roman Catholic officer class to wake from their sleep of the spirit. But it went on to warn them that if they cannot reform their religion, they must still live by the laws of the Irish Republic. Accordingly, its implications went far beyond the issue of child abuse which it formally addressed
Kenny's revolutionary speech was not simply a rebuke to the Vatican. It called for reform of the Roman Catholic Church, confirmed that Home Rule did not mean Rome rule, and returned the word "republic" to the Northern Protestants to whom it originally belonged. Like all great speeches it had good authority, slew a sacred cow, and spoke the truths that set us free.
By good authority I mean that only someone like Kenny, himself a practising Roman Catholic, could have taken on his own side and survived. By speaking from inside the fold he gave the rest of the Irish Roman Catholic flock the courage to show the door to the bad shepherds. But he was not the only Catholic layman to give a lead last week...
Kenny's speech also slew a sacred cow, more precisely a Papal bull, more precisely still a Papal bully, namely the Vatican's praetorian guard and its pretension to a global remit. By rejecting that remit in the Irish Republic, Kenny rescued the word "republican" from any taint of Rome, and freed it up for future use by Northern Protestants.
The speech should also encourage southern Protestants to follow Bishop Paul Colton's lead in putting their heads firmly above the parapet of public life. This must go beyond engaging in empty ecumenical gestures. Southern Protestants should seek an accounting for the sectarian actions of southern Catholic nationalism between 1908-1922....
Faced with the Old IRA's sectarian actions in the Bandon Valley, at Coolacrease and at Clifden Orphanage (to name only a few), some academic historians have reacted exactly as Catholic apologists did to the charge of clerical sex abuse. To borrow the words of Kenny's scathing summary, instead of hearing the sufferings of southern Protestants with St Benedict's "ear of the heart' they preferred 'to parse and analyse it with the gimlet eye of a canon lawyer".
Real republicans should be in the front ranks in publicising the sufferings of Irish Protestants in the period 1919-22. Because what happened frightened them into a forced amnesia about the actions of the IRA, and to politically keep their heads down. And that timidity, in turn, confirmed the fears of Northern Protestants that some subjects were taboo in the Irish Republic.
Even as committed an apologist for Irish republicanism as the Portadown Presbyterian George Gilmore found he had a breaking point. In a 1951 essay entitled 'The Republic and the Protestants' published in Sean O Faolain's The Bell, Gilmore listed public incidents which grated on his Protestant sensibilities:
"Presidential pledges of loyalty of 'the Irish people' to the Pope, lord mayoral pledges of the loyalty of the 'people of Dublin' to the Pope, of 'the people of County Dublin' to the Pope. Even the Congress of Trade Unions has pledged the loyalty of 'its' members to the Pope. When is a Portadown man an Irishman?"
Gilmore called on southern Protestants to object to their loyalty being pledged to a foreign power and concluded with these prophetic words: "If the influential leaders of Irish Protestantism did make such a protest, I have no doubt that a formula would readily be found whereby Irish Roman Catholics could emphasise their own religious loyalties consistently with recognition of the fact that something like one quarter of the Irish people have no such loyalty."
An old cliche claims all political careers end in failure. Political failure maybe, but not historical failure. Churchill, Gorbachev and Mandela are proof of that.
So even if Enda Kenny's government finally ends in economic tears, last week's courageous and cathartic speech will ensure him an enduring and honoured place in the history of Ireland.

Taoiseach Enda Kenny today launched an unprecedented attack on the Vatican, accusing Catholic hierarchy of putting the preservation of the church's reputation ahead of child rape victims.
In a damning assessment of Rome's attitude to paedophile priests, Mr Kenny claimed the latest inquiry into clerical abuse cover-ups has exposed a dysfunctional, elite hierarchy determined to frustrate investigations.
The Holy See was also warned that religion does not rule Ireland.
"For the first time in Ireland, a report into child sexual abuse exposes an attempt by the Holy See to frustrate an inquiry in a sovereign, democratic republic as little as three years ago, not three decades ago," he said.
"And in doing so, the Cloyne report excavates the dysfunction, disconnection, elitism, the narcissism that dominate the culture of the Vatican to this day.
"The rape and torture of children were downplayed or 'managed' to uphold instead, the primacy of the institution, its power, standing and 'reputation'."
The Taoiseach's attack, which opened a special Dáil debate, followed the publication last week of the fourth major report in six years into the Church's cover-ups of clerical abuse.
Cloyne Diocese in Co Cork is the latest part of the Church to be exposed with former bishop John Magee - a Vatican aide to three Popes - singled out for misleading investigators and "dangerous" failures on child protection. His resignation was accepted by Pope Benedict last year.
On one occasion he was found to have written two different reports on an abuse allegation - one for Rome and one for diocesan records.
The Taoiseach went on to describe the Vatican of having a "calculated withering position" on clerical abuse, which he said was "the polar opposite of the radicalism, the humility and the compassion upon which the Roman Church was founded".
Mr Kenny said the Vatican's reaction to evidence from victims of abuse was to have it parsed and analysed by a canon lawyer.
"This is not Rome," he said. "Nor is it industrial school or Magdalene Ireland, where the swish of a soutane-smothered conscience and humanity and the swing of a thurible ruled the Irish Catholic world.
"This is the Republic of Ireland 2011.

The Taoiseach's condemnation came on the back of the first official comment from a Holy See spokesman to the Cloyne report.
On Vatican radio, Fr Federico Lombardi dismissed criticism and denied that Irish bishops were encouraged or advised to cover up clerical abuse or evade laws designed to protect children.
Fr Lombardi said he was not speaking on behalf of Pope Benedict and claimed the severity of criticisms against the Holy See was curious.
The Cloyne scandal goes as high as the Vatican after the inquiry criticised a 1997 letter from the Papal Nuncio, Rome's ambassador to Ireland, to Irish bishops.
The Cloyne report described the response to the clerics' plans to improve child protection policy as "entirely unhelpful".
"There is no reason to interpret that letter as being intended to cover up cases of abuse," Fr Lombardi said.
"Moreover, there is absolutely nothing in the letter that is an invitation to disregard the laws of the country."
The Government is awaiting an official response to the Cloyne scandal from the current Papal Nuncio, Archbishop Giuseppe Leanza.

Levels of religious knowledge throughout Ireland are decreasing significantly, and in Northern Ireland are even lower than in the Republic according to a new poll.
The poll, believed to be the first ever conducted on the subject in Northern Ireland, is the follow-up to a religious knowledge poll conducted in the Republic of Ireland on behalf of The Iona Institute and the Evangelical Alliance Ireland (EAI) which was released in April.
This found low levels of basic religious knowledge in the population, especially among young people.
The latest poll allows a comparison between levels of religious knowledge in the North and South, and between Northern Catholics and Northern Protestants. Those organising the poll conclude that, contrary to popular belief, Northern Ireland is less religious than the South.
It was already known that church attendance figures in the North were lower than in the South.
The poll found that levels of religious knowledge among Northern and Southern Catholics were roughly the same. However, in general, levels of religious knowledge among Northern Protestants were lower than among Northern Catholics.
The one question where protestants were more likely to know the answer was when asked what the first book of the Bible was. 68% of Protestants knew it was Genesis, compared to only 54% of Catholic.
However only 42% of respondents in the North knew there were four Gospels. 39% of Catholics knew the first of the 10 Commandments, compared to 26% of Protestants.
Unsurprisingly, the poll also found a marked difference between the levels of knowledge found among younger and older age groups. This means religious knowledge is in decline. Just 21% of NI respondents aged 16-24 could say there are four Gospels.
Responding to the opinion poll, Mr Stephen Cave of Evangelical Alliance (Northern Ireland), said: "The results of this poll throw serious doubt on the claim that we are a 'Christian country'. Overall the figures are not good but the drop in knowledge, almost halved within a generation, indicates that the Christian faith is becoming less meaningful to those under 25 years of age. The findings present a serious challenge to the church and those involved in religious education."
Mr David Quinn of The Iona Institute commented: “It's likely that many people will find the Northern Ireland results surprising in that the general impression is that the North is more religious than the South. Judged by both religious practice and religious knowledge this is definitely not the case. It's time to consign that notion to the dust-bin."
He continued: "As with the poll conducted in the South, we find that levels of religious knowledge in the North are very low, especially among young people. It shows that knowledge of Christianity, both North and South, is disappearing from general knowledge."

They lied, at times by omission, at times by distorting the truth and at times just blatantly. The most senior leaders of the Catholic Church in Ireland lied to and deceived us all, and sacrificed children in the interests of their authority and most damningly, their money. Not terribly Christian of them was it? Can you imagine what Christ might say to Cardinal Desmond Connell and his fellow Bishops about their bizarre relationship with the truth and their willingness to turn the other way whilst children were raped and abused by their Priests?
Reading the Dublin Report was a shocking experience. Even after all these years, after all that I know about the scale and extent of the abuse and the cover up by Church leaders, I was profoundly shocked. The depth of the self-deluded and self-preserving betrayal of all that is decent by men sworn to a higher power and who placed themselves in positions where they told the rest of us we were flawed is staggering. In their world their lies are not lies, merely examples of ‘mental reservation’. Ever hear of that one? No? Well it means that an Archbishop can tell a blatant untruth as long as he lies by omission and then ‘reserves’ the missing words that would turn his lie into truth to himself, saying them only inside his own head.
So when Cardinal Connell failed to tell the truth, he didn’t lie. He just omitted the bits that would have been self-incriminating and said them to himself, inside his head. Children remained at risk and victims and their families were deceived. But that’s ok, because the Cardinal can tell himself he didn’t lie.
The State failed too of course. In traditional style, it deferred to the crosier. Too often, state officials, with some notable exceptions, failed to investigate credible reports of abuse and looked the other way, deferring to the majesty of the Church and its princes.
It may be the past, but this is not ancient history. The Commission investigated cases of abuse right up to 2004 when Cardinal Desmond Connell surrendered control of the Archdiocese of Dublin to Archbishop Diarmuid Martin.
Back in 2002 when I began to campaign on this issue, our Government didn’t believe the abuse of children by priests was any of its business. Asked for a comment of the Ferns scandal in March 2002, then Taoiseach Bertie Aherne retorted that is was a matter for the Church, and he wasn’t going to cross religion and politics.
Unsurprisingly Cardinal Connell agreed with him. The Church, he proclaimed, was above the law of the Land. Canon Law, the rules of the Roman Catholic Church was superior to state law. The State could not investigate the Church.
But the past is not some other country, or some faded reality with little relevance to us today. This history matters today. It affects the lives of not just those who experienced abuse, but all of us, most especially our children. It reveals huge flaws in our child protection law which leave children at risk today.
Back in October 2005 the Ferns Report found an alarming gap in Irish child protection law. Mr Justice Frank Murphy discovered that the HSE had no explicit legal power to act in cases of third-party child sexual abuse, i.e. cases where the abuser is not a family member. The HSE could investigate and validate the abuse, but once it had done so, the only power it had was to inform the employer of the abuser of the risk. It could do little to ensure that people who pose a risk to children were prevented from accessing children.
The Ferns Report recommended that the Minister for Health and Children explore the introduction of new legislation which would give the HSE power to apply to the High Court to restrain any employee, including a priest, from having unsupervised contact with children where a concern exists about his ability to interact safely with children.
The Dublin report again details the same gaps in our current child protection law, four years on from the publication of the Ferns Report.
Responding to the publication of the report, Minister for Children Barry Andrews said, “Judge Murphy in writing this report noted the extraordinary delay in introducing child protection legislation in this State. Successive Governments failed in their responsibilities as legislators to put in place a comprehensive child protection legislative framework.”
We now know the consequences of such delays. The four years which have passed since the publication of the Ferns Report is a current and unacceptable example of this, as is the delay to enshrine children’s rights in our constitution.
So enough of delays and apologies and procrastination, instead, it’s time for resolute action. Where the state fails to guarantee and defend the rights of children and abdicates responsibility for their safety, then abuse and exploitation are all too often the consequence. Our children are our responsibility, and not the responsibility of any agency which places itself outside or above the law. Today we see the consequences not only of cover up and deceit on the part of the Catholic Church, but also of state failure to guarantee children’s rights and child protection.
Yesterday was an important day, a day on which as Minister Andrews put it “Church and State respond with words of sincere and fulsome regret.”
And those are good words, but they remain just words. And they are not enough.

I left Catholicism for the safety of my children because the stained-glass curtain hides too many dark secrets.
For months, I’ve been following one of my favorite authors, Anne Rice, via social media sites. What intrigues me so much about Rice is that she, like most writers, says the things that most people fear to say. And she says them loudly and without regret.
When Rice proclaimed that she left Christianity in the name of Christ, many people balked. Even more judged. Everyone had an interpretation about her proclamation. For me, her announcement had much more meaning than words could convey, because Anne Rice wasn’t just publicly leaving organized religion, she was renouncing her lifelong association with Catholicism.
Like Rice, I was raised a strict Catholic. My parents ensured that I went through every applicable sacrament: Baptism, Penance, Communion, Confirmation. Eventually, I added Holy Matrimony to the list. When my children were born, I had them baptized in the Church. For me, it just felt like the only way.
Catholicism was comforting to me. The rituals of the Church were comforting. The Mass, which I had memorized at a young age, was familiar and all I had ever known. I stayed, because the Church was my home.
However, time changes many things. And as the controversies surrounding the Catholic Church grew, so did my doubts.
I discovered that two priests from my childhood were accused of crimes against children. One of those priests baptized me, the other married me and my husband.
I still sometimes think of those allegations when I look down at my wedding band.
I left the Church when my two boys became old enough to enter Sunday school. I left, because my boys put their faith in me to keep them safe.
As allegation after allegation came forward about childhood sexual abuse within the Church—each one seemingly more horrific than the one before—I knew that the Church’s walls were not my home anymore. Those walls certainly couldn’t be trusted to protect my children. I had no faith left in the Catholic Church.
Leaving behind the stained-glass comfort of my childhood was one of the hardest decisions I've ever made. I still pray Catholic prayers. I still say prayers to the Saints. And, in my new life as a Protestant, I still, when receiving communion, have the urge to make the Sign of the Cross.
I am angry with the Catholic Church. I’m angry that secrets were kept and that priests were shuffled to other parishes to prey upon more children.I'm angry that these abuse cases were known throughout the Church's hierarchy and that these high-powered men allowed the abuses to be covered up.
Most importantly, I’m angry that God’s children were the last priority and that Canon Law took precedent over criminal law.
But unlike Rice, I haven’t completely given up on organized religion.
Raising my children with religion is important to me. After many careful searches, my children have a church home where I feel we can provide a safe and nurturing religious environment.
I am determined for my children to have a childhood rooted in faith—but just not the Catholic faith. For me, the only faith that matters is a strong faith in God.

Ireland exported Catholicism (that came with some inherent evil baggage) to the world through its many Irish missionaries in centuries past but it may also as well export the key necessary changes in Catholicism– based on today’s standards - to end the Totalitarianism of the Vatican in the 21st century. An important issue today is the invincible Sacrament of Confession caught in the crossfire between the Ireland Government versus the Vatican City or Vatican “country” -- as Ireland condemns the Vatican for its secrecy and cover-up of 19 pedophile priests in the wake of the 400 page ‘Report of the Commission of Investigation into the sexual abuse of children by priests in the Diocese of Cloyne’ published on July 13, 2011. It is commendable (but action speaks louder than words) that Prime Minister Enda Kenny, on July 14, immediately the day after the report was released, said that "The law of the land should not be stopped by a crozier or by a collar" and the Children’s Minister Frances Fitzgerald said Catholic priests could be jailed if they fail to report child sex abuse crimes they hear in the sacrament of confession, even if that ‘seal of confession’ is decreed by church law, and the Justice Minister Alan Shatter said that he does not want to wait “weeks or months” for the Vatican’s response to the Cloyne report. The Irish government was at war with the Vatican last night over its silence on the Cloyne sex abuse report as anger grew at the failure of Bishop John Magee to publicly apologise for his role in the scandal.
Relations between the Republic and the Holy See deteriorated dramatically yesterday, with Mr Kenny describing the Vatican's attitude towards the reporting of abuse allegations as "absolutely disgraceful".
Mr Kenny backed tough new laws that will compel priests to report paedophiles to gardai, even if they are told of the abuse in the confession box.
Present status of clerics mentioned in the Cloyne report

The report as published refers to allegations, concerns or suspicions concerning 19 different clerics which were brought to the attention of the diocese between 1996 and 2009.
The terms of reference of the Commission extended to all complaints received by Church or civil authorities since 1996. These complaints received in that time frame referred to cases from the 1930s, 1950s, 1960s, 1970s, 1980s 1990s and 2000s.
Of the 19 clerics mentioned in the report, 2 are not priests of Cloyne diocese – 1 is a member of a religious order and 1 retired from Brisbane diocese – and 1 is unidentifiable. Of the complaints received against the remaining 16 clerics of the diocese, in 11 cases the complaints/concerns received met the criteria for credible allegations of sexual abuse. One of these priests was subsequently prosecuted and convicted of an offence in this regard.

HIS Excellency Archbishop Giuseppe Leanza looked distinctly rattled as he stood on the steps of Iveagh House. Shortly after the Cloyne Report had been published on Wednesday, the papal nuncio had been made an offer he couldn't refuse.
The Tanaiste and Minister for Foreign Affairs had summoned him to the department to present him with a copy of the latest account of the failures of the Catholic Church and also to express the extreme displeasure of the Government over the report's finding that the Vatican meddled directly in Irish matters of state.
And so the papal nuncio was wearing the hunted look of a chap who had been hauled unceremoniously over some piping-hot coals when he emerged from the 30-minute meeting. In a barely-audible voice he read from a prepared statement -- which was all of 38 seconds long.

Throughout the long scandal of sexual abuse by rogue priests, the Vatican has blatantly resisted the idea that civil law must trump church rules in confronting criminal acts. This was evident again in the revelation that the Roman Catholic Church in Ireland continued to cover up abuse cases long after it had issued rules to protect children in 1996.
“The law of the land should not be stopped by crosier or by collar,” Prime Minister Enda Kenny declared after receiving a detailed report on Wednesday showing that abuses were occurring as recently as 2009.
A principal factor in the cover-up, the government study found, was a Vatican letter in 1997 warning Irish church leaders against full cooperation with law enforcement authorities. The papal representative wrote that the anti-abuse policies conflicted with church law and should be considered “merely a study document.”

Ireland’s prime minister has said Catholic clerics would be prosecuted if they failed to tell the authorities about crimes disclosed during confession, the latest blow to the prestige of the once-dominant Church. A report this week found that the Church concealed from the authorities the sexual abuse of children by priests as recently as 2009, and that clerics appeared to follow Church law rather than Irish guidelines to protect minors.
“The law of the land should not be stopped by a crozier or a collar,” Prime Minister Enda Kenny told journalists on Thursday, referring to the hooked staff held by Catholic bishops during religious services. Kenny said his government would submit legislation to parliament that could jail clerics for up to five years if they failed to report to authorities information about the abuse of children.
The law will override the confessional privilege in Church law that prevents clerics from sharing information, he said. A series of revelations of rape and beatings by members of religious orders and the priesthood in the past have shattered the dominant role of the Catholic Church in Ireland.

THE CLOYNE REPORT ON THE BISHOP AND THE VATICAN: TOUGH NEW laws to force the disclosure of information on child sexual abuse are to be introduced in response to another damning report on the failure of the Catholic Church to protect child abuse victims.
The withholding of information about serious offences against a child will be made a criminal offence, Minister for Justice Alan Shatter announced yesterday following the publication of the report on the handling of sex abuse claims in the diocese of Cloyne.
Further measures, including a statutory child protection code, are to be announced by Minister for Children Frances Fitzgerald tomorrow.
The report found that the Bishop of Cloyne, John Magee, misled the minister for children by claiming the church’s guidelines for handling abuse cases were being fully complied with. It also found he falsely told the Health Service Executive (HSE) that allegations of abuse were being reported to gardaí.

OPINION: Unless the Catholic hierarchy examines its obsession with power it cannot reform itself
MUCH OF the Cloyne report brought no surprises to the people of Ireland and those of us in other countries who had anticipated its publication. In many ways it was a continuation of the revelations that came with the three commission reports that preceded it.
The report was met with the expected “heartfelt” expressions of regret, apology and even shock by officials of the Catholic Church, followed by promises of reform and the promulgation of yet more procedures, policies and boards. By now the Irish people, however, are beyond suspicion and cynicism. They have broken through another layer of the protective clerical veneer and have named the responses for what they are: a mendacious smokescreen.
It is no consolation to the Irish people but they are certainly not alone. This debacle in the Diocese of Cloyne is reflected in the recent publication of the report of the grand jury in Philadelphia, Pennsylvania. Five years after a first jury exposed widespread cover-up and shameful treatment of victims, followed by the usual promises to clean up the mess, a second grand jury found that the expressions of regret and promises of reform were a deceptive cover for an intentional lack of commitment to bring justice to victims and protect children.

PROPOSALS for a Papal visit to Ireland next summer are likely to be shelved in the wake of the Cloyne report.
The State and the Catholic Church remained on a collision course after the chairman of Fine Gael called for the Pope's representative in Ireland to be expelled.
It was also suggested that the Government could close our embassy to the Holy See as public anger grows over the failure of Bishop John Magee to publicly apologise for the scandal.
Asked for his reaction to calls for the Papal Nuncio to be expelled, Justice Minister Alan Shatter said the direct interference by another state in preventing the application in Ireland of child protection guidelines is unacceptable.

BISHOP JOHN Magee produced two written accounts of his conversation with “Fr Caden”: one, true, describing an admission of abuse by the priest, the other, fictitious, a flat denial and protestations of innocence. Significantly, Magee filed the true version with the Vatican, the fictitious account with the diocese of Cloyne. What mattered was the Vatican. (No question of going to the Garda.)
In doing so, however, Magee implicitly acknowledged what the Vatican has been trying to fudge for years in its responses to the worldwide abuse scandals – that a firm line of authority, and hence of moral and legal responsibility, runs all the way to Rome. Vatican protestations that national hierarchies are autonomous, not wholly owned subsidiaries, are wearing distinctly thin.
Legally the Vatican has insisted both that it, as an independent state, has “sovereign immunity” and so cannot be held liable before a court for the actions of its agents, and that in any case priests cannot be regarded as its agents/employees in a legal sense.

The vast majority of people here still call themselves Catholic—87% on the most recent census. But many of the most faithful church-goers in Ireland today aren’t even Irish.
This Sunday mass in Limerick is said in Polish for some of the thousands of immigrants who poured in during the economic boom of the past decade. But it’s hard to find an Irish congregation this packed, and especially this young, in bigger cities.

You’ll see them at first communions, you’ll see them at confirmations, you’ll see them at funerals. They’re taking a very much an a la carte view to the practice of their religion.
POTTER: As recently as the 1970s, almost 90% of Irish Catholics went to mass at least once a week. Today, the number is closer to 25%. And in some parts of Dublin, just two or three percent of self-described Catholics regularly go to church.
To Irish woman: Did you grow up Catholic by chance?
WOMAN: Yes.

The latest report on sexual abuse by clergy in Ireland lays the problem firmly on the pope's doorstep: "The reaction of the Vatican to the Framework Document was entirely unhelpful to any bishop who wanted to implement the agreed procedures." The Framework Document was drafted in 1996 to establish procedures for handling abuse cases. But the Congregation for the Clergy refused to "recognize" it, principally because it included a mandatory reporting requirement. A confidential communication to this effect gave license to Bishop of Cloyne John Magee (and any other bishop who didn't like the Framework) to decline to report cases that came to his attention--leading to his resignation in 2009. What the Cloyne Report does is connect the dots.
The Irish government now seems prepared to deal with Vatican, Inc. the way the English government is dealing with News International Ltd. The papal nuncio has been dressed down. An apology has been demanded from Rome. There is talk of closing the embassy in Vatican City. And parliament is poised to require reporting of evidence of abuse to the civil authorities, including such evidence as emerges under seal of the Confessional.
As Ann Doyle of BishopAccountability.org points out, the Cloyne Report is "eerily similar" to the report of the Philadelphia grand jury report earlier this year, which detailed that archdiocese's flouting of national norms for the handling of abuse cases. But unlike Bishop Magee, Cardinal Justin Rigali remains in office, as has almost every other bishop who has failed to deal properly with abuse cases.

After all the bishops’ talk of learning curves, and nearly twenty years after the Brendan Smyth affair brought down a government, we discover not only that a bishop had no interest in protecting children, but that the man he appointed to deal with complaints has little respect for Irish law compared to Roman Catholic rules, which he regards as superior in all respects.
There is no place called Cloyne, except in the minds of the clergy. The so-called Cloyne report is about North Cork, a real place with real people, not some demented ecclesiastical Middle Earth. And the inhabitants of Cloyne are not Hobbits but real people, who were terrorised, unfortunately, by the fiends of Sauron Magee as he languished in his Dark Tower, aka Cobh Cathedral.

Momentum is building for an inquiry into clerical child abuse in Northern Ireland.
With four inquiries now completed south of the border – Ferns, Ryan, Dublin and now Cloyne – northern abuse victims are rightly asking: what about us?
Their calls have now been echoed by SDLP MLA Conall McDevitt and deputy First Minister Martin McGuinness:
I absolutely believe there should be the same thorough investigations in the northern dioceses as there have been in previous dioceses in the south.
We cannot north of the border view ourselves as being in the clear from all that happened in the south whenever I think many of us now know instinctively that that’s not the case.
What is this all about? This is about the protection of innocent children and there is a duty and a responsibility on all of us who are in important positions.

Well done, first of all. When the Murphy Report on the Dublin Diocese was published, I (and others) suggested that the Papal Nuncio should be summoned to account for the behaviour of the Vatican then. But he wasn't.
Your decision to demand accountability reflects, I think, the genuine anger of the people of Ireland at the disgraceful behaviour of the Holy See.
The Cloyne Report makes it clear that the Vatican in effect encouraged bishops to reject the Irish church's own child-protection rules. Back in 1997 they wrote to Ireland's bishops basically telling them they should place the church's law above the law of the country. The consequence of that intervention was not just to ignore Ireland's sovereignty, but also to give comfort to people who were content to protect the child abusers in their midst.

‘Fr Corin’
IN 1994, “Nia” complained to a bishop outside Cloyne about abuse by Fr Corin. She said he moved to her parish when she was nine or 10 and had a housekeeper in her late teens. When she visited the house he would sit her on his lap and put his hands under her clothes. The abuse continued until he left the parish when she was 16.
Interviewed by Msgr O’Callaghan, Fr Corin denied “serious interference” but admitted fondling between four and six girls in the 1960s. He said he petted Nia and on occasion this went too far.
Msgr O’Callaghan concluded there had been no abuse, only “overfamiliarity”.
The commission says: “It was clearly and unequivocally child sexual abuse.”
A second complainant, “Oifa”, recalled an incident when she was 10 in the 1960s and Fr Corin sat her on his lap and put his hands beneath her clothes. In 1996, Fr Corin met Bishop Magee and acknowledged he was guilty of child sexual abuse. He resigned his ministry and died in 2002.
The commission says there was no attempt to have Fr Corin assessed to see whether he was a continuing danger to children and no attempt was made to establish the extent of his abusive behaviour. There is no evidence that he was restricted from ministering in public and parishioners were not told of the real reason for his resignation. It is also critical of the lack of a proper Garda investigation into complaints.
‘Fr Darien’
Fr Darien died in 1997, a few months after a complaint was made about him. The complainant, “Rona”, said she had been sexually assaulted by him when she was aged about 16 and working in the laundry of a girls’ home in the 1960s. Nothing was done about the complaint because, Msgr O’Callaghan said, Fr Darien was terminally ill at the time. The commission says proper procedures were not followed. There was no reporting to the civil authorities and no further inquiries were made.

Minister for Justice Alan Shatter, who announced the upcoming legislation in the wake of the publication of the Cloyne report, also expressed the State’s “sorrow and profound apology” for any failings on its part in relation to the revelations contained in the report.
He strongly criticised the Catholic Church’s handling of allegations of clerical abuse in Cloyne, saying the findings “could not be starker or more disturbing”.

FOREIGN Affairs Minister Eamon Gilmore (who publicly opposed the holding of a second Lisbon referendum while reportedly telling the US Embassy in private that he would support one) expects the Vatican's ambassador to account for his church's two-faced approach to child abuse.
And the Minister for Justice of a Government whose two most senior members made misleading promises about the future of Roscommon Hospital, last week condemned the "disingenuousness" of Bishop John Magee.
Justice Minister Alan Shatter won headlines last week by proposing new legislation that appears to promise that priests will be jailed if they fail to report abuse, even if they learn of it in a confessional. But the small print does not actually say that. As the person who asked him at his press conference if priests would be expected to break the seal of the confessional, I can say reports of its demise are premature.
In fact, his proposed new law allows those with a "reasonable excuse" not to report allegations of abuse, and those excuses explicitly include the situation where an abused person makes it known that he or she does not want the gardai to be told. Existing legal precedents also suggest that courts could find other "reasonable excuses" implicitly include those of lawyers, doctors, bishops or priests who believe they have a privileged relationship with a patient, client, priest or penitent.

Pope Benedict is said to be reviewing his planned trip to Ireland next year after the Irish government issued harsh criticism of the Vatican over the latest church cover up scandal, according to the Irish Independent.
Prime Minister Enda Kenny and Deputy Leader Eamon Gilmore have slammed the Vatican for their policy of urging bishops not to accept the guidelines laid down by the Irish hierarchy on reporting child abuse.
The criticism came after the retired Bishop of Cloyne John Magee was harshly criticised after 19 priests in his diocese suspected of pedophilia were given kid gloves treatment, apparently at the behest of the Vatican.

The Irish government was at war with the Vatican last night over its silence on the Cloyne sex abuse report as anger grew at the failure of Bishop John Magee to publicly apologise for his role in the scandal.
Relations between the Republic and the Holy See deteriorated dramatically yesterday, with Mr Kenny describing the Vatican's attitude towards the reporting of abuse allegations as "absolutely disgraceful".
Mr Kenny backed tough new laws that will compel priests to report paedophiles to gardai, even if they are told of the abuse in the confession box.

The report as published refers to allegations, concerns or suspicions concerning 19 different clerics which were brought to the attention of the diocese between 1996 and 2009.
The terms of reference of the Commission extended to all complaints received by Church or civil authorities since 1996. These complaints received in that time frame referred to cases from the 1930s, 1950s, 1960s, 1970s, 1980s 1990s and 2000s.
Of the 19 clerics mentioned in the report, 2 are not priests of Cloyne diocese – 1 is a member of a religious order and 1 retired from Brisbane diocese – and 1 is unidentifiable. Of the complaints received against the remaining 16 clerics of the diocese, in 11 cases the complaints/concerns received met the criteria for credible allegations of sexual abuse. One of these priests was subsequently prosecuted and convicted of an offence in this regard.

HIS Excellency Archbishop Giuseppe Leanza looked distinctly rattled as he stood on the steps of Iveagh House. Shortly after the Cloyne Report had been published on Wednesday, the papal nuncio had been made an offer he couldn't refuse.
The Tanaiste and Minister for Foreign Affairs had summoned him to the department to present him with a copy of the latest account of the failures of the Catholic Church and also to express the extreme displeasure of the Government over the report's finding that the Vatican meddled directly in Irish matters of state.
And so the papal nuncio was wearing the hunted look of a chap who had been hauled unceremoniously over some piping-hot coals when he emerged from the 30-minute meeting. In a barely-audible voice he read from a prepared statement -- which was all of 38 seconds long.

Throughout the long scandal of sexual abuse by rogue priests, the Vatican has blatantly resisted the idea that civil law must trump church rules in confronting criminal acts. This was evident again in the revelation that the Roman Catholic Church in Ireland continued to cover up abuse cases long after it had issued rules to protect children in 1996.
“The law of the land should not be stopped by crosier or by collar,” Prime Minister Enda Kenny declared after receiving a detailed report on Wednesday showing that abuses were occurring as recently as 2009.
A principal factor in the cover-up, the government study found, was a Vatican letter in 1997 warning Irish church leaders against full cooperation with law enforcement authorities. The papal representative wrote that the anti-abuse policies conflicted with church law and should be considered “merely a study document.”

Ireland’s prime minister has said Catholic clerics would be prosecuted if they failed to tell the authorities about crimes disclosed during confession, the latest blow to the prestige of the once-dominant Church. A report this week found that the Church concealed from the authorities the sexual abuse of children by priests as recently as 2009, and that clerics appeared to follow Church law rather than Irish guidelines to protect minors.
“The law of the land should not be stopped by a crozier or a collar,” Prime Minister Enda Kenny told journalists on Thursday, referring to the hooked staff held by Catholic bishops during religious services. Kenny said his government would submit legislation to parliament that could jail clerics for up to five years if they failed to report to authorities information about the abuse of children.
The law will override the confessional privilege in Church law that prevents clerics from sharing information, he said. A series of revelations of rape and beatings by members of religious orders and the priesthood in the past have shattered the dominant role of the Catholic Church in Ireland.

THE CLOYNE REPORT ON THE BISHOP AND THE VATICAN: TOUGH NEW laws to force the disclosure of information on child sexual abuse are to be introduced in response to another damning report on the failure of the Catholic Church to protect child abuse victims.
The withholding of information about serious offences against a child will be made a criminal offence, Minister for Justice Alan Shatter announced yesterday following the publication of the report on the handling of sex abuse claims in the diocese of Cloyne.
Further measures, including a statutory child protection code, are to be announced by Minister for Children Frances Fitzgerald tomorrow.
The report found that the Bishop of Cloyne, John Magee, misled the minister for children by claiming the church’s guidelines for handling abuse cases were being fully complied with. It also found he falsely told the Health Service Executive (HSE) that allegations of abuse were being reported to gardaí.

MUCH OF the Cloyne report brought no surprises to the people of Ireland and those of us in other countries who had anticipated its publication. In many ways it was a continuation of the revelations that came with the three commission reports that preceded it.
The report was met with the expected “heartfelt” expressions of regret, apology and even shock by officials of the Catholic Church, followed by promises of reform and the promulgation of yet more procedures, policies and boards. By now the Irish people, however, are beyond suspicion and cynicism. They have broken through another layer of the protective clerical veneer and have named the responses for what they are: a mendacious smokescreen.
It is no consolation to the Irish people but they are certainly not alone. This debacle in the Diocese of Cloyne is reflected in the recent publication of the report of the grand jury in Philadelphia, Pennsylvania. Five years after a first jury exposed widespread cover-up and shameful treatment of victims, followed by the usual promises to clean up the mess, a second grand jury found that the expressions of regret and promises of reform were a deceptive cover for an intentional lack of commitment to bring justice to victims and protect children.

PROPOSALS for a Papal visit to Ireland next summer are likely to be shelved in the wake of the Cloyne report.
The State and the Catholic Church remained on a collision course after the chairman of Fine Gael called for the Pope's representative in Ireland to be expelled.
It was also suggested that the Government could close our embassy to the Holy See as public anger grows over the failure of Bishop John Magee to publicly apologise for the scandal.
Asked for his reaction to calls for the Papal Nuncio to be expelled, Justice Minister Alan Shatter said the direct interference by another state in preventing the application in Ireland of child protection guidelines is unacceptable.

Ireland's foreign minister scolded the the country's papal nuncio over Vatican complicity in the cover up and mishandling of clerical abuse in Ireland, as revealed in the Cloyne Report.
Now Irish media are reporting that the leader of Fine Gael, the largest political party in Ireland, is calling for the nuncio to be expelled and that Pope Benedict XVI's expected visit next summer was "likely to be shelved."

The Vatican has never confirmed that Pope Benedict would be visitng Ireland next year -- it wouldn't until much closer to the trip -- but there has been much speculation that a papal visit was being planned. Sicne this spring, Irish media have been reporting that the pope would be the chief celebrant at an open air Mass to end the week-long International Eucharistic Congress next June.

BISHOP JOHN Magee produced two written accounts of his conversation with “Fr Caden”: one, true, describing an admission of abuse by the priest, the other, fictitious, a flat denial and protestations of innocence. Significantly, Magee filed the true version with the Vatican, the fictitious account with the diocese of Cloyne. What mattered was the Vatican. (No question of going to the Garda.)
In doing so, however, Magee implicitly acknowledged what the Vatican has been trying to fudge for years in its responses to the worldwide abuse scandals – that a firm line of authority, and hence of moral and legal responsibility, runs all the way to Rome. Vatican protestations that national hierarchies are autonomous, not wholly owned subsidiaries, are wearing distinctly thin.
Legally the Vatican has insisted both that it, as an independent state, has “sovereign immunity” and so cannot be held liable before a court for the actions of its agents, and that in any case priests cannot be regarded as its agents/employees in a legal sense.

The vast majority of people here still call themselves Catholic—87% on the most recent census. But many of the most faithful church-goers in Ireland today aren’t even Irish.
This Sunday mass in Limerick is said in Polish for some of the thousands of immigrants who poured in during the economic boom of the past decade. But it’s hard to find an Irish congregation this packed, and especially this young, in bigger cities.
PATSY McGARRY, The Irish Times: People still identify themselves as culturally Catholic even though they no longer go to mass or go to confession. You’ll see them at first communions, you’ll see them at confirmations, you’ll see them at funerals. They’re taking a very much an a la carte view to the practice of their religion.
POTTER: As recently as the 1970s, almost 90% of Irish Catholics went to mass at least once a week. Today, the number is closer to 25%. And in some parts of Dublin, just two or three percent of self-described Catholics regularly go to church.
To Irish woman: Did you grow up Catholic by chance?
WOMAN: Yes.
POTTER: Do you go to mass now?
WOMAN: Not really that much. Not that much at all.

The latest report on sexual abuse by clergy in Ireland lays the problem firmly on the pope's doorstep: "The reaction of the Vatican to the Framework Document was entirely unhelpful to any bishop who wanted to implement the agreed procedures." The Framework Document was drafted in 1996 to establish procedures for handling abuse cases. But the Congregation for the Clergy refused to "recognize" it, principally because it included a mandatory reporting requirement. A confidential communication to this effect gave license to Bishop of Cloyne John Magee (and any other bishop who didn't like the Framework) to decline to report cases that came to his attention--leading to his resignation in 2009. What the Cloyne Report does is connect the dots.
The Irish government now seems prepared to deal with Vatican, Inc. the way the English government is dealing with News International Ltd. The papal nuncio has been dressed down. An apology has been demanded from Rome. There is talk of closing the embassy in Vatican City. And parliament is poised to require reporting of evidence of abuse to the civil authorities, including such evidence as emerges under seal of the Confessional.
As Ann Doyle of BishopAccountability.org points out, the Cloyne Report is "eerily similar" to the report of the Philadelphia grand jury report earlier this year, which detailed that archdiocese's flouting of national norms for the handling of abuse cases. But unlike Bishop Magee, Cardinal Justin Rigali remains in office, as has almost every other bishop who has failed to deal properly with abuse cases.

This is not the Lord of the Rings. This is Ireland in the 21st century, and the Cloyne report is about events that happened, not a millennium ago. Not even a half century ago. The report includes events that happened two or three years back. Today, in other words.
After all the bishops’ talk of learning curves, and nearly twenty years after the Brendan Smyth affair brought down a government, we discover not only that a bishop had no interest in protecting children, but that the man he appointed to deal with complaints has little respect for Irish law compared to Roman Catholic rules, which he regards as superior in all respects.
There is no place called Cloyne, except in the minds of the clergy. The so-called Cloyne report is about North Cork, a real place with real people, not some demented ecclesiastical Middle Earth. And the inhabitants of Cloyne are not Hobbits but real people, who were terrorised, unfortunately, by the fiends of Sauron Magee as he languished in his Dark Tower, aka Cobh Cathedral.

Momentum is building for an inquiry into clerical child abuse in Northern Ireland.
With four inquiries now completed south of the border – Ferns, Ryan, Dublin and now Cloyne – northern abuse victims are rightly asking: what about us?
Their calls have now been echoed by SDLP MLA Conall McDevitt and deputy First Minister Martin McGuinness:
I absolutely believe there should be the same thorough investigations in the northern dioceses as there have been in previous dioceses in the south.
We cannot north of the border view ourselves as being in the clear from all that happened in the south whenever I think many of us now know instinctively that that’s not the case.
What is this all about? This is about the protection of innocent children and there is a duty and a responsibility on all of us who are in important positions.

Well done, first of all. When the Murphy Report on the Dublin Diocese was published, I (and others) suggested that the Papal Nuncio should be summoned to account for the behaviour of the Vatican then. But he wasn't.
Your decision to demand accountability reflects, I think, the genuine anger of the people of Ireland at the disgraceful behaviour of the Holy See.
The Cloyne Report makes it clear that the Vatican in effect encouraged bishops to reject the Irish church's own child-protection rules. Back in 1997 they wrote to Ireland's bishops basically telling them they should place the church's law above the law of the country. The consequence of that intervention was not just to ignore Ireland's sovereignty, but also to give comfort to people who were content to protect the child abusers in their midst.

‘Fr Corin’
IN 1994, “Nia” complained to a bishop outside Cloyne about abuse by Fr Corin. She said he moved to her parish when she was nine or 10 and had a housekeeper in her late teens. When she visited the house he would sit her on his lap and put his hands under her clothes. The abuse continued until he left the parish when she was 16.
Interviewed by Msgr O’Callaghan, Fr Corin denied “serious interference” but admitted fondling between four and six girls in the 1960s. He said he petted Nia and on occasion this went too far.
Msgr O’Callaghan concluded there had been no abuse, only “overfamiliarity”.
The commission says: “It was clearly and unequivocally child sexual abuse.”
A second complainant, “Oifa”, recalled an incident when she was 10 in the 1960s and Fr Corin sat her on his lap and put his hands beneath her clothes. In 1996, Fr Corin met Bishop Magee and acknowledged he was guilty of child sexual abuse. He resigned his ministry and died in 2002.
The commission says there was no attempt to have Fr Corin assessed to see whether he was a continuing danger to children and no attempt was made to establish the extent of his abusive behaviour. There is no evidence that he was restricted from ministering in public and parishioners were not told of the real reason for his resignation. It is also critical of the lack of a proper Garda investigation into complaints.
‘Fr Darien’
Fr Darien died in 1997, a few months after a complaint was made about him. The complainant, “Rona”, said she had been sexually assaulted by him when she was aged about 16 and working in the laundry of a girls’ home in the 1960s. Nothing was done about the complaint because, Msgr O’Callaghan said, Fr Darien was terminally ill at the time. The commission says proper procedures were not followed. There was no reporting to the civil authorities and no further inquiries were made.

Minister for Justice Alan Shatter, who announced the upcoming legislation in the wake of the publication of the Cloyne report, also expressed the State’s “sorrow and profound apology” for any failings on its part in relation to the revelations contained in the report.

FOREIGN Affairs Minister Eamon Gilmore (who publicly opposed the holding of a second Lisbon referendum while reportedly telling the US Embassy in private that he would support one) expects the Vatican's ambassador to account for his church's two-faced approach to child abuse.
And the Minister for Justice of a Government whose two most senior members made misleading promises about the future of Roscommon Hospital, last week condemned the "disingenuousness" of Bishop John Magee.
Justice Minister Alan Shatter won headlines last week by proposing new legislation that appears to promise that priests will be jailed if they fail to report abuse, even if they learn of it in a confessional. But the small print does not actually say that. As the person who asked him at his press conference if priests would be expected to break the seal of the confessional, I can say reports of its demise are premature.
In fact, his proposed new law allows those with a "reasonable excuse" not to report allegations of abuse, and those excuses explicitly include the situation where an abused person makes it known that he or she does not want the gardai to be told. Existing legal precedents also suggest that courts could find other "reasonable excuses" implicitly include those of lawyers, doctors, bishops or priests who believe they have a privileged relationship with a patient, client, priest or penitent.

Pope Benedict is said to be reviewing his planned trip to Ireland next year after the Irish government issued harsh criticism of the Vatican over the latest church cover up scandal, according to the Irish Independent.
Prime Minister Enda Kenny and Deputy Leader Eamon Gilmore have slammed the Vatican for their policy of urging bishops not to accept the guidelines laid down by the Irish hierarchy on reporting child abuse.
The criticism came after the retired Bishop of Cloyne John Magee was harshly criticised after 19 priests in his diocese suspected of pedophilia were given kid gloves treatment, apparently at the behest of the Vatican.

RATIONALISING Ireland’s diplomatic service in Rome could save the taxpayer €2.4 million.
That sum would be saved if Ireland moved its embassy to the Italian state to the site of its embassy to the Holy See, and in turn moved its Holy See ambassador to a base in an existing embassy in a neighbouring country.
